Discussion Summary

1. Seepage Issues


The meeting began with the MC highlighting the increased seepage observed in the Lower Basement (LB) and Upper Basement (UB).


Asian Paints explained that they had previously made a detailed presentation to the former MC, outlining the nature of seepage and proposed solutions.


Observations


Major seepage points are located below the garden and mini-pool area. and the expansion joint at the podium.


Proposed Solutions (Earlier Presentation)


1. Primary (Positive) Solution


Remove the garden completely, waterproof the slab, and then address the pool area.


The previous MC declined this due to cost concern.


2. Alternative Solution


Inject PV solution into identified seepage points in LB and UB.


Asian Paints had cautioned that while this would close existing points, water may find alternate paths and seepage could recur elsewhere.


The previous MC opted for this solution.


Vendor Scope


Contractor was instructed to prioritize expansion joint treatment and terrace waterproofing.



2. Agreement & Annexures


Asian Paints and Zahabi will share the complete copy with Annexures 




3. Delay in Project Completion


The MC questioned why the project was not completed as per contractual deadline (September 2024).


The vendor explained:


Initial delay due to water shortage onsite.


Further delay because the previous MC did not finalise the colour scheme on time.


Manpower issue 


4. Pending Issues


The MC briefed the vendors about several pending concerns, especially the increased seepage and incomplete works. Vendors were asked to reassess and respond formally.




Information asked from Asian Paints & Zahabi


The MC instructed the vendors to submit the following:


1. Detailed statement of pending payments (if any).


2. Explanation for the delays in project execution. Upon receipt of this, penalties will be discussed and finalized.


3. Clarification for the increase in seepage despite completed works.


4. Tentative date for completion of remaining works as per agreement. 


5. Copies of all communications with the former MC, including Annexures 1, 2 & 3 of the agreement.


6. Complete details of paints and other materials supplied to Ozone Evergreens.

7. Break up of cost for seepage works and painting works separately.




Way Forward


Upon receiving the completion report, the MC will hold a joint inspection with the vendors and the Residents Committee.


Upon receipt of completion done from Asian paint and Zahabi, MC will send the notice to resident asking for pending work. The residents would be asked to respond within 15 days with any complaints they have regarding the painting work..


Final payment will be released only after reviewing the report and verifying the work completion during the joint inspection done and work completed as per agreement terms & time frame and Annexures.

Dear Sir,

I hope you’re doing well.

Please find attached the Proforma Invoice for the final payment. I request you to review it and arrange for the release of the payment without further delay.

As agreed in the meeting with the President and M C team, only the items within the approved scope will be completed at this stage, and all additional works will be taken up separately. Based on the work order and the checklist, every item within the defined scope has been completed and handed over. Accordingly, we are submitting the Proforma Invoice for the final settlement.

Painting is pending only in two duct areas due to accessibility constraints. A structure above these ducts needs to be demolished, which is why even the builder has not painted them. Similarly, the 1st and 2nd floor duct sections cannot be painted until the welded metal gates installed by the builder are opened. Once these access issues are cleared, we will complete the remaining patches immediately.

Request you to process the payment at the earliest so we can close this project formally.

Dear Team,

 

As per our meeting held on 15th November, two surveys were committed by Mr. Dhirender. Please find below the detailed summary of both surveys for your reference and confirmation.

 

1st Survey – Conducted on 18/11/2025

 

Present: Mr. Binoj, Ms. Prasanna, and Mr. Anil (FM)

 

The following points were noted:

                1.            Painting of basement plumbing pipe supporting grill angles.

                2.            Enamel painting of basement exhaust fans and their supporting grills.

                3.            Enamel painting of the lift doors.

                4.            Painting of external duct walls that were previously left unpainted due to fixed grill doors that could not be opened.

                •              Note: Manager to arrange opening of grills. Once access is provided, we will complete the work.

                5.            Painting of builder-provided balcony grills from the inside.

                •              Note: Manager will inform residents to raise tickets for pending balconies. Once we receive the list, we will complete the painting.

                6.            Completion of the pending expansion joint work.

                7.            Addressing multiple seepage locations on the retaining wall (already explained during the survey).

                8.            Seepage observed in the upper basement ceiling (podium area).

                •              PU injection grouting was previously completed; currently there is no scope for additional grouting.

 

2nd Survey – Conducted on 23/11/2025

 

Present: Mrs. Prasanna, Mr. Hemanth, and Mr. Devraj

 

The following points were noted:

                9.            Painting of basement plumbing pipe supporting grill angles.

                10.          Enamel painting of basement exhaust fans and their supporting grills.

                11.          Enamel painting of the lift doors.

                12.          Painting of external duct walls that were previously left unpainted due to fixed grill doors.

                •              Note: Access to be provided by the association; work will be completed immediately thereafter.

                13.          Painting of builder-provided balcony grills from the inside.

                •              Note: Residents to raise tickets for pending units; upon receiving the list, we will proceed accordingly.

                14.          Completion of the pending expansion joint work.

                15.          Addressing multiple seepage areas on the retaining wall (previously discussed with Mrs. Prasanna).

                16.          Seepage in the upper basement ceiling (podium area).

                •              PU grouting already executed; no further scope at this time.

                17.          G Block – 1st Floor Corridor: Certain areas require proper cleaning.

                18.          A & B Block – Joint Duct Area: Two ducts remain unpainted.

                •              Note: No access currently. The association will demolish the covering to create access; once done, painting will be completed.

                19.          C & D Block – Joint Area: One duct remains unpainted.

                •              Note: Entry to this duct is fully covered by the terrace floor.

                20.          Lower Basement: Some stores remain unpainted.

                •              Note: As per our understanding, basement stores do not fall under the agreed scope of work.

 

 

To counter this, below is our submission team,

  4. Once the grills are opened and given by the association we shall execute the painting until then it can’t be accesed.
  5. Manager to provide the flat list were it isn’t painted and then we shall complete it.

  7. Explained to Mrs. Prasanna that this connot be arrested as it should have done at the time of construction by the builder itself but as its missed, nothing can be done now.
  8. Due to leakage from podium. For arresting it Podium excavation needs to be done followed by other remedies.

Discussion Summary

- The Seepage Issue is observed only in the basement area and not on vertical surfaces. 
- All vertical surfaces have been treated thoroughly as per scope. 
Horizontal treatment was not part of the original scope and was undertaken only on a goodwill basis as the client had requested.
 
A permanent solution requires access to the source (mother slab), which involves removal of the garden and Interlocking tiling area for proper treatment. This was discussed with the previous committee; however, due to budget constraints, a full-scale solution was not approved.
 
Accordingly, please note: 
- The horizontal expansion joint treatment is temporary in nature and not suggested by AsianPaints/Zahabi Inc.
- No warranty applies to horizontal areas (Basement Ceiling and Pillars), it’s stated in the agreement , Mentioned in Annexure

- Water shortage in Bangalore, which impacted exterior work and caused a delay of approximately 2.5 months. 
- Delay in colour finalisation. While the project was contractually scheduled for completion by 8th September (mentioned in Agreement), we received the final colour confirmation only on 29th October, i.e., nearly 1.5 months after contract expiry. This has impacted our profit margins as Project which was supposed to run for 8 months ran for more than a year which impacted us , as we had to deploy high skilled exterior labours to do interior works until exterior colour conformation, Labour Room accommodation and overheads. The Interior painting of the society (Tower staircase and lobby) was completed and handed over on August 19th  itself.

Despite repeated follow-ups from our side, there has been no meaningful progress regarding the pending matters and release of payments. Due to this continued delay, we are left with no option but to formally raise the pending invoice amount.

We request you to kindly clear the outstanding payment within the next 7 days, as per the agreed payment terms and submitted tax invoices.

Please note that we are an MSME-registered company, and continued non-payment of dues beyond 7 days will compel us to initiate proceedings under the MSMED Act before the appropriate authority for recovery of the outstanding amount along with applicable interest.

Good Evening Team,

This is a final follow-up regarding the outstanding payment against the submitted tax invoices.

We have been following up for a considerable period through calls, emails, and WhatsApp messages, yet there has been no meaningful response or accountability from anyone associated with the project. Despite our patience and repeated attempts to resolve this matter amicably, the issue remains unresolved.

We do not wish to pursue legal action. However, if at least 80% of the outstanding amount is not transferred by the end of today, we will have no option but to initiate proceedings under the MSMED Act from Monday onwards for recovery of the dues along with applicable interest.

Dear committee,

The required documents were shared with the Association several months ago, both via email and WhatsApp. Despite multiple submissions and follow-ups, no action has been taken to date.

We would appreciate clarity on the Association’s intentions regarding this matter. Is the objective to complete the project and hand it back to the Society in an orderly manner, or is the matter being indefinitely delayed, similar to what occurred under the previous committee?

Further, we seek to understand whether the continued inaction is a deliberate attempt to withhold payments due to the vendor despite the documents and information already being provided.

The prolonged silence and lack of progress are causing unnecessary hardship. We would also like to know whether any member of the Association intends to take ownership of this matter and bring it to a resolution.

We request a clear response and immediate action on the documents already submitted.

Good Morning committee ,

This is a follow-up to our previous reminders regarding the outstanding payment against the submitted tax invoices.

Despite repeated emails, calls, and WhatsApp messages, we have still not received any payment, response, or accountability from any stakeholder associated with this project. The continued silence and delay are unacceptable and leave us with very little confidence that this matter is being treated with the seriousness it deserves.

As a final gesture of good faith, we are providing time until the end of today to receive at least 80% of the outstanding amount along with a written commitment for the balance payment.

We have been patient for several months and have made every effort to resolve this matter amicably. However, we cannot continue to carry the financial burden of this project indefinitely while receiving no communication from your end.

If the above payment is not received by the end of today, we will proceed with initiating legal action under the MSMED Act for recovery of the outstanding dues, along with applicable interest and associated costs. Once such proceedings are initiated, the matter will move through the appropriate legal channels.

We sincerely hope that this step will not be necessary and urge you to resolve the matter immediately.

Dear Mr.Burhanuddin Zahabi,

We have reviewed your completion report and found that the work has not been completed in accordance with the contract requirements and agreed terms.

Our team has identified several areas where the work remains incomplete. In particular, the seepage arrest treatment carried out by your team has not been completed satisfactorily. Furthermore, the seepage issue appears to have worsened following the treatment.

The reasons provided for the delay in completing the work have not been accepted by the Management Committee, as they indicate shortcomings in project planning, management, and execution. Accordingly, delay penalties will be levied as per the terms and conditions of the agreement.

We have also observed that your company has carried out several civil works within our apartment complex. We request you to provide complete details of all works executed, along with the corresponding payments received against each work order.

Further, during our review, we found discrepancies in the payment details submitted by you. Certain payments made to your company do not appear to have been reflected in your statement of payments received. We request you to recheck your records and submit a revised and accurate statement.

In view of the above, we request you to complete all pending and deficient works at the earliest and provide an updated status report along with a clear timeline for completion.
Upon completion of the work, it will be inspected and reviewed by the Facility Management (FM) team, the Management Committee (MC), and the Residents' Committee. Subject to their confirmation and approval, the matter will be placed before the General Body Meeting (GBM). Following approval by the GBM, the pending payment, if any, will be processed and released.

We look forward to your prompt action and response.

Firstly, thank you for your response. We appreciate hearing back after several months of follow-up. We had hoped to receive a response from the Association earlier, but better late than never.

Before we proceed with any pending work, we would like to have a meeting with you and the Association to discuss and align on the project status, scope, and way forward. This is the same meeting that we have been requesting for the past four months.

Once the meeting is conducted and the pending matters are addressed, we will be in a position to move forward with the execution of the remaining work.

If you and the Association are interested in completing the project and handing it back to the society, kindly share a suitable date and time for the meeting at the earliest.

We met with you in November 2025; however, most of the action items discussed during that meeting remain pending, and the requested clarifications are still awaited.

As the election for the new Managing Committee is expected to be announced shortly, and our current tenure will conclude at the end of June 2026, we are not in a position to take any further decisions on this matter.

Once the new committee is formed in July 2026, you may meet with them, subject to prior intimation and their availability, to discuss and take the matter forward.

My office team and I would like to apologize, as we seem to be unable to identify which documents are being referred to as “missing.” We were under the impression that all documents requested by your team had already been provided and acknowledged.

I trust that you and your team have reviewed the documents shared. Therefore, it would be helpful if you could kindly provide a specific list of the documents that you believe are still outstanding. We will be more than happy to share them again, as repeatedly stating that documents are missing without identifying them makes it rather difficult for us to understand what exactly is required.
