WE ALL STAND TO GAIN

On a regular basis, the French postal service (La Poste) participates in
AIDS
prevention events and "Sidaction" Days. Through these events, La Poste does

commit, in its own way, to fight the disease. But we should not forget that

these events are also a way to take advantage of the AIDS epidemic in order
to
sell financial products and buy a positive public image as well as a good
conscience.

When La Poste sells red pins at its counters or encourages customers to
write
to AIDS patients, its main goal is to make a financial profit which does
not
help to solve the problems of its own employees who are affected by the
disease. If those marketing events could help improve the conditions of
HIV-infected and AIDS patients, I would gladly support the effort. But this
is
not the case.

On the contrary, there is a total lack of information and education among
postal workers. Despite a few meetings organized by La Poste in small
committee, no information is allowed to circulate and reach the 300,000
employees.

La Poste has the means to get involved in simple and concrete actions (for
example, a postal stamp including a tax to go towards AIDS research, condom

distributors in its offices or the display of information about prevention
on
special bulletin boards). Yet it continues to hide the problem. Discussing
AIDS remains taboo. Nobody in management has had the will to commit to
measures that would improve communication or the integration of
AIDS-affected
workers within La Poste.

WE ALL STAND TO GAIN! La Poste refuses to consider creating an internal
AIDS
association. This association could help sick employees who are currently
treated in a demeaning fashion and harassed psychologically by postal
managers
whose goal is to exclude these AIDS victims.

La Poste recently added AIDS to the list of severe diseases which entitle
employees to long-term sick leave. Yet the organization continues to make a

profit from AIDS. This ambiguity should trouble each and everyone of us
because this doublespeak is choking. La Poste's new slogan could be :
DO AS WE SAY, NOT AS WE DO

TO SAY NOTHING WOULD BE TO CONSENT

Since July 25 1996, I have been refusing all medicines and medical care in
order to call for penalties to be imposed on certain persons of the Post
Office Ministry whom I consider responsible for having damaged my health. I
have been HIV-positive since 1985 and a Post Office employee since 1974.
In December 1995 I won a suit against the Ministry, which was ordered to
pay
25,000 francs in damages and interest. In his verdict, the judge of the
Paris Administrative Tribunal considered that the Post Office Ministry had,
by failing to act in a reasonable time to adapt the work of my post to make
it suitable for someone in my state of health as the law requires -- and
this despite the seriousness of my deteriorating medical condition,
attested
to by medical certificates --, had committed an error for which it must be
held responsible.
Despite this decision, against which the Ministry did not appeal, I
continued to have difficult relations with persons in responsible positions
in whom I had placed all my confidence and who were able to help me in the
steps I took to resolve my difficulties. Because of the odious and inhuman
behavior which I have had to confront, I have come to fear for my health.
Faced with this unwillingness to take responsibility, I have written to the
minister of the Post and to the disciplinary service of the Poste, as well
as to the department to which I am attached so that the Ministry should
turn
against them and that it should impose the disciplinary penalties the
situation required.
Once again I came up against the same indifference and unwillingness to
listen which I had encountered since the beginning of my story in 1991.
Some, for ethical reasons and in order not to undertake actions which they
might feel required to disavow later, do not want to impose penalties,
while
others do not even deign to listen to my request. Alone and cast by the
wayside, in the face of this general contempt, where personal interests
take
precedence over the human aspect, having used every possible approach which
could improve my situation, finding the way forward blocked, I have found
no
solution other than to endanger my life in order to seek justice and obtain
exemplary disciplinary penalties against the officials I have indicated
above who have frustrated my efforts to better my situation. I have taken
the very grave decision to stop receiving medicines and medical care in
order to obtain satisfaction and recover a certain dignity. Even if for my
position my action constitutes a form of blackmail, for me it is the final
means of resisting this perverse and discriminatory behavior and to improve
matters regarding the treatment of AIDS sufferers in an department which
sponsors efforts to combat AIDS.
TO SAY NOTHING WOULD BE TO CONSENT! To fail to impose penalties would be
to
give assent to their behavior and give them carte blanche and leave the
door
open to all these abuses and psychological harassments, and this is
unacceptable and unbearable to me after what I have endured for two years.
I cannot remain in this situation; matters are urgent and my life is in
danger. I need your help and support. It is an appeal for succor that I am
making, and I truly count on you, hoping that this time I will be heard.

I am a Post Office Ministry employee who has been HIV-positive since 1985
and who has been fighting the discrimination to which I am subjected in my
position.
In December 1995 the Paris Administrative Tribunal condemned the Post
Office
Ministry -- as an entity -- but declined all moral responsibilities as to
the physical persons who were responsible for these discriminations in
regard to my state of health. The judge considered that the Ministry had
committed a fault such as would entail its responsibility.
The social assistant, the divisional inspector, the establishment chief and
the director of human resources did not support my request for a reduction
of working hours necessary for one in my health condition. Since 1991 I
have
had, alone, to resist not only a serious attack of AIDS, but also the
cynicism of my employer, the Ministry, whose intention was to exclude me as
quickly as possible from the job market.
During all this time, I undertook many approaches to various personalities
which were however fruitless. I called for penalties to be imposed on those
officials of the Ministry whom I consider responsible. In the face of the
general contempt, I began on July 25 to refuse all medicines and medical
care.
At the moment, confronted by the immobilism of the trade unions (seven
members of the administrative council of the Ministry) and most
organizations devoted to the fight against AIDS, I feel myself betrayed and
cast by the wayside. Despite their timid interventions -- which do not
commit them to anything --, the unions have taken the same contemptuous
attitude as the representatives of the Post Office Ministry. To say and to
do nothing is to support and accept this kind of discriminatory behavior.
Further, although the Post Office takes part in programs to combat AIDS, it
is reluctant to involve itself in such a matter or to take the side of a
low-ranking civil servant of no interest who does not belong to any
organization. In these conditions, how do you expect to find favorable
support for putting a stop to these inhuman methods?
I have also taken this decision to defend and help my colleagues (300,000
salaried employees), some of whom suffer from AIDS and are completely
isolated until their death, and also for other cases equally dramatic which
lead inexorably to exclusion.
One can count only on oneself! In this world of egoists and personal
ambitions, we are far from all the fine statements we hear about good
intentions and solidarity.

because they didnt think about adapting his working condition to his health
Thougt the french post office has been condamned through administrative
court of Paris the office managers refuse to back his request
No saction mean accept Its unacceptable for such public entreprise which
should show the right examplefor HIV people integration
