FTB issues are not covered on your SEE, but we have already established that members of this study group are networking and meeting to strengthen our knowledge and skills as tax professionals (regardless of the information being relevant to the SEE).

Comment on the third point: [Jaws dropped on the floor] They are letting a MFJ couple claim child care credit on whatever income tax is left after taking foreign income exclusion? cf Pub 503 and Pub 514.  I'm loving this!  Thanks, de Gamarra, for stimulating whatever is left of my brains.

Anyway, maybe you can send this info to the others because each time I try to go into EA groups it gives me a black screen and tells me about their new email.  I wanted to know if everyone know about this:  that you can go online at the FTB on their new website to

  • Apply for an individual installment agreement.
  • Respond to a Head of Household questionnaire.
  • Respond to individual filing enforcement notices.
And that the HOH notices (100,000 of them ) are going to be sent out next week.  Also, notices to the tax pros who have been making mistakes in determining or falsifying EIC will also get a letter that says they have to take an EIC class before they can prepare taxes next year.
And lastly, the third thing, does everyone know that if a married couple is living apart (in two different countries) but they are filing married MFJ and excluding the foreign income and they have a child that is living overseas, they are still eligible for the Child Care Credit?
