- I had received call yesterday by the Paldi Police chowky as regards to the recording of statement pursuant to my email to the Honorable Chief Minister pertaining on 10 th April 2007. The same is annexed herewith and is marked as Annexure B. .
- It has been my personal past experience, with Mr. Goswami, PSI of Paldi Police Chowky that he does not take effective action except for calling the undersigned for recording the statement in Gujarati and the same get filed by him without taking follow up action. It appears that he lacks very much needed sincerity in performing the task effectively. On account of his negligence and indifferent attitude , I have had to suffer a lot.
- Please assign competent person who can conduct inquiry speedily without wastage of time so as to carry out investigation properly. I am furnishing a copy of my reply in English language so that the inquiry can be conducted smoothly without any loss of time. The same is marked as Annexure A. The Enclosures to Annexure –A would be hand delivered separately to you.
- I look forward to your whole hearted support in the matter.

SUBJECT:- LETTER FROM HOME DEPARTMENT IN MAY 2007 UNDER THE SIGNATURE OF SECTION OFFICER – N J MAKVANA (HOME DEPARTMENT ) VIDE REFERENCE NO VSF-31007-JSK-17-D addressed to Police Commissioner of Ahmedabad and marked to Paldi Police Chowky for necessary detailed inquiry pursuant to phone call from Paldi Police chowky yesterday and telephonic conversation today

Briefly my initial statement is narrated as under so that you can start making detailed inquiries as well as recording of statement and collection of evidences from various persons.
1. Span Medicals Ltd ( address:- 304-307 Meera Manan Arcade, Near Krupa Petrol Pump, Near Parimal Garden , Ellisbridge ) has sold the bunglow property in April 2007 (land admeasuring 3065 sqameters along with built up construction on Final Plot 768/10 in T P scheme 3/5 varied in Chadawad and located at Cross Roads of Municipal School near Parimal Railway Crossing and having Sign Board of Sahjanand Towers , a scheme put up by Harekrishna Developers). Span Medicals has done it with the assistance of advocate Mrs Swati Soparkar who has amalgamated Rupmanglam Investment Pvt Ltd , Flovin Plastics Pvt Ltd and Dhanyushya Financial Private Ltd who were owning the entire property jointly and obtained the High Court order on 23-1-2001.
2. I came to know (from the Scheme of Amalgamation order of Span Medicals Limited) that recently that the Registered office of Rupmanglam Investment Pvt Ltd and Flovin Plastics Pvt Ltd is located in Baroda. The shift of registered office to Baroda address from ahmedabad reflects malafide motive so that no one notices any advertisement of amalgamation appearing in the local newspaper of Ahmedabad and in this manner the entire company can be highjacked by way of amalgmation and misleading and deceiving the Honorable Judges of Gujarat High Court. There is shift in Registered office even when the major immoveable asset is located in Ahmedabad.
3. One Mr. Jatin Jalundhwala claiming to be in charge of Rupmanglam Investment Private Ltd and Flovin Plastics Pvt Ltd created charge on the referred property fraudulently with Global Trust Bank (Now Oriental Bank of Commerce) who sanctioned Rs 12.5 crore term loan to Core Healthcare Limited around year 1999.
4. Core Healthcare Limited did not repay the loan and interest and the default exceeded Rs 22.5 crores and took legal steps against Span Medicals Limited on paper but not in spirit.
5. Oriental Bank of Commerce acted as custodian and guardian of the property in guise of mortgage and possession of major possession of the property in the property.
6. I have been founder director and shareholder of Rupmanglam Investment Private Limited and Flovin Plastics Private Limited since inception of the company and the ownership of the company is in dispute and the companies have been amalgamated fraudulently by some one representing Rupmanglam Investment Private Ltd and Flovin Plastics Private Limited. Neither Span Medicals nor Swati Soparkar as well as Oriental Bank of Commerce are giving the details for obvious reasons of veiling the fraudulent acts in collusion with each other and other associates.
7. In my email to the Honorable Chief Minister of Gujarat on 10th April 2007 , I have made briefly stated in para 3 as under:-
Ø I have requested to hold the custody of the said property ( as described earlier) pending further detailed investigation which has not been properly carried out by the Police administration earlier.
Ø To take written statement of the management of Oriental Bank of Commerce in respect of email dated 10th March 2007. The same is marked as Enclosure 1
Ø To take on record written statement of the management of advocate Mrs Swati Soparkar pursuant to letter addressed to her in February 2007 ( Enclosure –2) and her written observations and written comments on the letter addressed to Jatin Jalundhwala as well as Handas on 16-3-2005 . The same is marked as ( Enclosure-3). It is also necessary to obtain her various documentary evidences from her as referred in Enclosure-7.
8. In reference to the contents of the para 6 of the email dated 10 th April 2007, I am marking copy of letter addressed to PSI Bhagora in April 2005 as referred in Enclosure-4 . I am also marking a copy of letter addressed to Jatin Jalundhwala and Sushil Handa on 16-3-2005 as referred earlier in Enclosure-3 . The copy of this letter was marked to PSI Bhagora at relevant time. I am marking a copy of letter addressed to J M Chaudhary in May 2005 ( pertaining to inquiry on the Oriental Bank of Commerce) and the same is referred in Enclosure-5. I am marking a copy of letter addressed to J M Chaudhary in June 2005 ( pertaining to recording of statement of Jatin Jalundhwala ) and the same is referred in Enclosure –6. The inquiry was not made.
9. I reserve my right to give further details on inquiry cum complaint that needs to be be conducted by you subsequently , once you start conducting inquiry. My past experience with Paldi police chowky is that they just record my complaint in Gujarati while never giving me copy of the same by the Paldi Police chowky and besides the complaint is used to file the papers without making detailed inquiries.
10. Kindly see that Gujarati version o my complaint is not insisted by you.
11. I would be marking the copy of the present letter to the Honorable Chief Minister as well as to the Home Department and Police Commissioner's office for their observations and remarks.

Subject:- Need to take custody of the bunglow near Parimal Rly crossing and cofnduct inquriy on criminal acts of frauds .
- My situation is analogous to firebrigade coming after the building turns to ashes My family has been destroyed and am not in a position to bear the cost of internet messages as I have Two hundred rupees on hand. I do not have a home of my own as I stay with my old aged parents who do not give keys to their residence. Without financial resources I am continuing legal battles and most of the time is spent on correspondence AND RUNNING AROUND.
- In case you cannot render help , then either have me shot dead as I do not have any interest in pulling in corrupt and indifferent bureaucracy in the state of Gujarat and I do not want to pull life with negativity stored in my present life.
- Following urgent steps need to be taken immediately :-
- holding custody of the bunglow near parimal rly crossing on cross roads of municipal school/chappal bazaar at Parimal Rly Crossing.
- Simultaneously , it is necessary to interrogate Oriental Bank of Commerce situated at Samegh Building , C G Road , adjoining Associated petrol Pump on the basis of the contents of the email sent to Oriental Bank of Commerce on 10 th March 2007 . The text of email is annexed herewith .
- Simultaneously, it is necessary to interrogate advocate Swati Soparkar through Navrangpura Police station to whom I have sent email in February 8th ,2007 which has been completely ignored by Navrangpura Police station even though Swati Soparkar office is one block away from Navrangpura Police station. The text of the email is annexed herewith.
4. I would very much appreciate if you could depute senior person who has authority
to direct and supervise with agility from your office so that effective steps can be
taken immediately.
5. I do not know what you felt during Godhra Kand and Akshardham episode . Kindly imagine for a moment that if you did not receive help and support from
central Government - would you not have cried and feel helpless and having missing rage within you. My situation is similar , the only difference is that I am helpless and situation of great agony and despair. With great difficulty , I am shrugging away thoughts of attempting suicide because as a head of the family , I have obligation to my own family in the moment of great crisis.

As no investigation was carried out by PSI Bhagora, I had sought information under Right to Information Act. 13-7-2006 and the same was registered by Police commissioner office dated 17-7-2006 and the file number was assigned as 46/06 but the investigation was not carried out showing utter indifference.

- I humbly request the office of Chief Minister of Gujarat to supervise and monitor of detailed action taken by Navrangpura Police Station working under new Deputy Commissioner of Police for conducting detailed inquiry on Mrs Swati Soparkar , practicing advocate. A copy of the present email is being simultaneously marked to them as well as to the Police Commissioner of Ahmedabad and Home Department of Gujarat . The copy of the email sent to Mrs Swati Soparkar on 7 th February 2007 is annexed herewith for ready reference.

- I do hope that Navrangpura Police station obtains following details from Mrs Swati Soparkar:-
· How did she ascertain that Mrs. Maniben Parbhulal Shah was alive in year 2000 and how her written consent was obtained in year 2000 and 2001 before she made application in Gujarat High Court..
· What steps did she take to find truth after she received my letter dated 1-3-2006 wherein the letter dated 16-3-2005 addressed to Sushil Handa and Jatin Jalundhwala was enclosed. Did Mrs. Swati Soparkar take action on the person who claimed that the consent of amalgamation was obtained from the preference share holder was obtained .
· What further action did she take to bring out truth.
· Whether she obtained written confirmation from the auditors of Rupmanglam Investment Private Limited as regards to whether the first name preference share holder that is Mrs Maniben P Shah was alive or not in year 2000 onwards.
· To collect all the papers filed for amalgamation filed by her as regards to amalgamation of Rupmanglam Investment Pvt Ltd and Flovin Plastics Pvt Ltd.
- Depending of initial findings and replies from Mrs Swati Soparkar , I shall take up other suitable action.
- It should not be difficult for Navrangpura to collect the details within next two to three days of present email being marked to them . Your office would be able to assess the agility, efficiency and effectiveness of the changes in Police administration that has taken place recently.

- You have filed Company Application in Gujarat High Court in the year 2000 at instance of someone representing Rupmanglam Investment Private Limited for amalgamating this company with M/s Span Medicals Limited and it appears that you have ignored my letter dated 1-3-2006 addressed to you where in I had annexed copy of my letter dated 16-3-2005 addressed to Mr. Sushil Handa and Mr. Jatin Jalundhwala.
- By now , you ought to have made thorough detailed and exhaustive inquiry in this regard by talking to your husband Mr. Soparkar as well as the person who made application to Gujarat High Court for amalgamation of the companies as well as Mr. Jatin Jalundhwala and Mr. Sushil Handa as well as Mr. Kamlesh Shah (Kamlesh shah representing representing Core Healthcare Limited and Span Medicals Limited).
- It has been reported in Annual Report of Core Healthcare Limited for the period 2004-2005 that its subsidiary Span Medicals Limited comprises of Preference share capital of 1,69,000 shares. On a closer examination at your end, you would have learnt that a total of 1,67,000 preference shares have been issued to my Late maternal grandmother Mrs. Maniben P Shah as they pertain to the shares standing in her name in Rupmanglam Investment Private Limited ( 14,900 preference shares of Rs 100 each) and Flovin Plastics Private Limited ( 18,000 preference shares of Rs 10 each ). It is needless to state that you as an experienced advocate would have carried out due diligence exercise by verifying and matching the signatures of Mrs. Maniben P Shah (giving approval for amalgamation) with those in the company records.
- Mr. Jatin Jalundhwala has filed documentation for Rupmanglam Investment Private Ltd with Global Trust Bank in 1999 for availing Rs 12.5 crore loan from them for Core Healthcare Limited and therein he has enclosed death certificate issued in 1988 certifying demise of my maternal grandmother Mrs Maniben P Shah and could not have been alive in year 2000 or thereafter.
- In view of contents in above paragraph , it is crystal clear that my maternal grand mother Late Mrs. Maniben P Shah in the year 2000 or in the year 2001 could not have given her written consent for amalgamating Rupmanglam Investment Private Limited with Span Medicals.This is in light of order passed on 23-1-2001 by Honorable Justice Mr. K.R.Vyas on 23-1-2001 in Company Petition 288 to 295 of 2000.The extract of order specified: " The meetings of the preference shareholders of two transferor companies were directed to be convened and the scheme was unanimously approved at the respective meetings" . As to how Mrs. Maniben P Shah was made alive in Year 2000 is a mystery to any person .
- It is therefore necessary that you rectify the situation by approaching Gujarat High Court and telling the truth failing which on the basis of facts and circumstances it is obvious that you are remaining silent to protect yourself , your husband Mr Soparkar and your client Core Healthcare Limited,etc from illegal and fraudulent acts . Any reluctance on your part in this regard would confirm that you wanted to mislead the Gujarat High Court to protect yourself as well as Mr. Soparkar along with your clients and Mr Jalundhwala.
- Under the circumstances , it is necessary that you take immediate independent decision on your own and bring it on record in writing in the proceedings of Company Petition 10 of 2006 in COMA 357 of 2005 for the sake of transparency as well as for exposing the fraudulent acts of your client company and all the persons associated with them including Mr. Soparkar. Your failure to do so would confirm that you are deliberately turning a blind eye so as to cover up the fraudulent and illegal acts of Core Healthcare Limited , Mr. Jalundhwala , Mr. Saurabh Soparkar, Oriental Bank of Commerce, etc. Any tarnishing of your name as advocate would ultimately affect the future of your children.
- The present letter is being circulated shortly amongst all the Honorable Judges of Gujarat High Court as well as Bar Council of Gujarat so that they begin to view all your company application and petitions suspiciously as well as get your name suspended as practicing advocate in Gujarat HighCourt and your conduct gets well publicised.More details would be published on googlepages from time to time. Sir,
1. Kindly refer to action taken by you under Securitisation Act for grabbing the possession of property referred in the Civil Suit 5827 of 2001 in the Bhadra Court of Ahmedabad.
2. It has come to my notice that due diligence exercise has not been carried out before accepting Span Medicals Limited (SML) as legitimate owner of the entire property referred in the Civil Suit 5827 of 2001 inspite of email to you on 27-12-2004 and emails to you , thereafter.
3. In this connection , I have addressed letter to advocate Swati Soparkar on 7 th February 2007 and copy of same is annexed herewith. The contents are self explanatory . She and her husband has maintained stone silence and has no bothered to give any reply which means that she is hand in glove with the fraudulent practices followed by Jatin Jalundhwala for amalgamating RIPL and FPPL with Span Medicals Limited It also . Mr. Soparkar has appeared as counsel for Span Medicals Ltd in the court against Oriental Bank of Commerce and the bank has not brought it to the attention of the court the misdeeds of Mr Soparkar and Mrs Soparkar for obvious reasons.
4. It is crystal clear that SML is not legal owner of the property referred in Civil Suit 5827 of 2001 for which the steps under securitization act were initiated by you under Securitisation Act.
5. Kindly note that GTB has already produced document in Civil Suit 5827 of 2001 proceedings in the form of Confirmatory letter dated 3rd March 1999 addressed to the Assistant General Manager by Jatin Jalundhwala and it has been stated in the FIRST SCHEDULE vide Para 3 that he has furnished to the bank- certified true copy of death certificate dated 22-4-1988 of Maniben widow of Prabhubhai Bhikhabhai issued by Ahmedabad Muncipal Corporation. This clearly means that Mrs Maniben P Shah was not alive when the application of amalgamation of RIPL and FPPL was made in the year 2000/2001 for amalgamation RIPL and FPPL with Span Medicals Limited. It has been also referred by your bank vide your letter dated 21-10-1999 addressed to the undersigned that the shares continue to be held by the mody family and were not transferred then.
6. In case you do not take steps to protect my rights as well as interest in the property referred in my Civil Suit 5827 of 2001 , then you are protecting and shielding fraudulent acts of Mrs Swati Soparkar as well as her husband Mr Saurabh Soparkar , Jatin Jalundhwala as well as main promoter of Core Healthcare Ltd – Sushil Handa and the management of Span Medicals Limited.
7. It is needless to state that in case you do not inform the action taken against the above persons then you are violating the legal provisions especially when you are public servants over and above other legal violations connected with financial frauds. It is needless to state that all of you would be held liable by requisite authorities including the courts.
8. Kindly note that GTB has already produced document in Civil Suit 5827 of 2001 proceedings in the form of Confirmatory letter dated 3rd March 1999 addressed to the Assistant General Manager by Jatin Jalundhwala and it has been stated in the FIRST SCHEDULE vide Para 3 that Certified true copy of death certificate dated 22-4-1988 of Maniben widow of Prabhubhai Bhikhabhai issued by Ahmedabad Muncipal Corporation.

The copy of the present email is being circulated to various authorities so that they begin to investigate and look into the conduct of the bank officers of your bank for the reasons already known to you in case you do not take strong visible action again against Soparkars, Sushil Handa, Jatin Jalundhwala in next three working days from the present email sent to you.

Subject:- Company Petition No 10 of 2006 connected with Company Application No 357 of 2005 regarding Core Healthcare's demerger with M/s Nirma Limited.

- You have filed Company Application in Gujarat High Court in the year 2000 at instance of someone representing Rupmanglam Investment Private Limited for amalgamating this company with M/s Span Medicals Limited and it appears that you have ignored my letter dated 1-3-2006 addressed to you where in I had annexed copy of my letter dated 16-3-2005 addressed to Mr. Sushil Handa and Mr. Jatin Jalundhwala.
- By now , you ought to have made thorough detailed and exhaustive inquiry in this regard by talking to your husband Mr. Soparkar as well as the person who made application to Gujarat High Court for amalgamation of the companies as well as Mr. Jatin Jalundhwala and Mr. Sushil Handa as well as Mr. Kamlesh Shah (Kamlesh shah representing representing Core Healthcare Limited and Span Medicals Limited).
- It has been reported in Annual Report of Core Healthcare Limited for the period 2004-2005 that its subsidiary Span Medicals Limited comprises of Preference share capital of 1,69,000 shares. On a closer examination at your end, you would have learnt that a total of 1,67,000 preference shares have been issued to my Late maternal grandmother Mrs. Maniben P Shah as they pertain to the shares standing in her name in Rupmanglam Investment Private Limited ( 14,900 preference shares of Rs 100 each) and Flovin Plastics Private Limited ( 18,000 preference shares of Rs 10 each ). It is needless to state that you as an experienced advocate would have carried out due diligence exercise by verifying and matching the signatures of Mrs. Maniben P Shah (giving approval for amalgamation) with those in the company records.
- Mr. Jatin Jalundhwala has filed documentation for Rupmanglam Investment Private Ltd with Global Trust Bank in 1999 for availing Rs 12.5 crore loan from them for Core Healthcare Limited and therein he has enclosed death certificate issued in 1988 certifying demise of my maternal grandmother Mrs Maniben P Shah and could not have been alive in year 2000 or thereafter.
- In view of contents in above paragraph , it is crystal clear that my maternal grand mother Late Mrs. Maniben P Shah in the year 2000 or in the year 2001 could not have given her written consent for amalgamating Rupmanglam Investment Private Limited with Span Medicals.This is in light of order passed on 23-1-2001 by Honorable Justice Mr. K.R.Vyas on 23-1-2001 in Company Petition 288 to 295 of 2000.The extract of order specified: " The meetings of the preference shareholders of two transferor companies were directed to be convened and the scheme was unanimously approved at the respective meetings" . As to how Mrs. Maniben P Shah was made alive in Year 2000 is a mystery to any person .
- It is therefore necessary that you rectify the situation by approaching Gujarat High Court and telling the truth failing which on the basis of facts and circumstances it is obvious that you are remaining silent to protect yourself , your husband Mr Soparkar and your client Core Healthcare Limited,etc from illegal and fraudulent acts . Any reluctance on your part in this regard would confirm that you wanted to mislead the Gujarat High Court to protect yourself as well as Mr. Soparkar along with your clients and Mr Jalundhwala.
- Under the circumstances , it is necessary that you take immediate independent decision on your own and bring it on record in writing in the proceedings of Company Petition 10 of 2006 in COMA 357 of 2005 for the sake of transparency as well as for exposing the fraudulent acts of your client company and all the persons associated with them including Mr. Soparkar. Your failure to do so would confirm that you are deliberately turning a blind eye so as to cover up the fraudulent and illegal acts of Core Healthcare Limited , Mr. Jalundhwala , Mr. Saurabh Soparkar, Oriental Bank of Commerce, etc. Any tarnishing of your name as advocate would ultimately affect the future of your children.
- The present letter is being circulated shortly amongst all the Honorable Judges of Gujarat High Court as well as Bar Council of Gujarat so that they begin to view all your company application and petitions suspiciously as well as get your name suspended as practicing advocate in Gujarat HighCourt and your conduct gets well publicised.More details would be published on googlepages from time to time. - In order to justify your innocence in the matter , it is necessary that you take immediate stern criminal action against Mr. Soparkar , Mr. Jalundhwala , Mr. Kamlesh J Shah as well as the management of Oriental Bank of Commerce failing which you personally are hand in glove with your husband Mr. Soparkar as well as Core Healthcare group and Mr. Jalundhwala to bury their fraudulent misdeeds .
