Dear Board Members,

Thank you for yesterday's HOA meeting and for keeping the community informed about the ongoing gate access issue.

I wanted to share a perspective that may be helpful as we continue evaluating options. It appears possible that TFiber/Lumos identified our community from publicly available county road or development lists and proceeded under the assumption of access. Upon encountering our gated setup, they may have escalated the matter to the county, which could have contributed to the current situation we are addressing.

Given that our neighborhood is a gated HOA community, I would like to ask whether we are exploring options to have TFiber/Lumos assume responsibility for some or all of the costs the HOA is now incurring to resolve this issue. In many cases, when internet or utility providers install infrastructure within private communities, there are agreements in place that include compensation or cost-sharing with the HOA, often based on the size or scope of the community.

If such arrangements are applicable here, it may be worth considering as a way to help offset expenses for residents. Even if retroactive, there may be an opportunity to negotiate terms with TFiber/Lumos as part of any access or installation discussions.

I appreciate the Board’s efforts in managing this matter and representing the interests of the community. Please let me know if there is any way residents can support these discussions.
