Apologies for the delay. The County has not responded to our request to use pre-existing records, such as the recorded plat referenced in the right-of-way deed, so the Association does not have to pay for a survey and other expenses that are unnecessary. I sent a follow-up email. We will have to proceed with the abandonment without the County's guidance if we do not receive a response.

 

I reviewed the information provided in your last email concerning permitting for the gate. The County will require the abandonment regardless of whether a permit was issued. One of the attachments was an email from the county in 2016 advising of the need to privatize the road. Had that been done at the time, it would have been reflected in the land records.

In relation to this point below:

As was shown in one of the emails, Fieldstone Reps at that time (Jim Sutton and Ryan Maki) worked with the County on the abandonment so Kyle should be able to recover records from Fieldstone's system about it since this was handled by the HOA.  If they failed to do it for whatever reason at the time -- that is on Fieldstone and they should address it promptly now.

Also - Kyle needs to answer the question that was raised by Kevin - why can't the gates remain closed while this issue is being resolved?  County and all required entities (Fire, Delivery carriers, School buses etc.) have the required access and have operated without an issue for 9+ years.
