Gates open Due to a permitting and zoning issue?

Hello everyone, 

Per Kyles letters there is a permit and zone issue, does anyone on the board know what permit and zoning issue our community is in violation of?

I would assume permits were pulled by the contractors hired to install the gates so I am surprised that Kyle says it is a permit issue. Unless we have something that requires periodic renewal. 

Do we know what is working on resolving the issue and what is required?

Hi Kevin,

As per last discussion with Kyle, he is working with the county to get this resolved.  County officials stated that they could not locate the documents in their system of records.

I believe that the contractor (Lonnie Giles) and his company did do the permit and got the inspection done by the county at that time (in 2016).  That is a pretty standard process and was part of the contract also. County never does any inspection let alone clear it without a permit in place.  Lonnie passed away in 2024 and his firm was sold to his business partner. Kyle is in touch with the firm.

He had said that he will update us as progress is made and the issue is resolved.

This is the first I've heard that there's an issue with zoning or permits. How long have we had the gate?

I am curious now as to what caused them to look for our permits?

There are chances the new Builder next door might have complained to County. I’m positive that the installer might have got permits from the county.

I think we should push Kyle for more details on why the county started investigating to determine what the resolution will be if they can not locate the original permits. 

Another theory is the T-mobile fiber people who wanted to install in here caused them to question why they could not just come in like they did in Creekstone since it is a county road. 
Just an additional thought to ponder but Kyle or Fieldstone should have gotten this information. 

10 years is a long time to now have an issue.

Here is one permit I could locate relating to gate. Management company can track using this. This is about installing electrical lines at entrance gate.

I reached out to Kyle. He will forward the latest once he receives an update on the gate. The information below, which is bold, is the latest. I copied the information from an email chain. If you are not aware, our gate is unauthorized. Lawyers are involved. 


Hi Kyle,

I have copied Rachel Conrad, who is a partner at our firm. I will be assisting her with the road abandonment for Ravenswood. We can prepare all of the necessary documents on behalf of the Association. We will have to outsource the title opinion to another firm, but we can handle that for you. I have reached out to the county attorney to confirm whether the title opinion is necessary, since the roads are entirely within the neighborhood. I have also asked if we can use the description and plat referenced in the right-of-way deed to the County. If not, we can prepare a new plat and a metes-and-bounds description. Once the abandonment process is complete, title to the roads will be transferred to the Association, allowing it to keep the gate. The roads will be subject to property tax once they have been privatized. We will send the abandonment documents for board review before submitting them to the County.

Not that it really matters at this point. Who is paying the lawyers?

IMHO, this seems to be a mess in the county's records system. As Shyam showed, they provided permit for the Electrical cabling for the gate. Any such permit would require previous permits to be present.  

The procurement of the permit was also part of the contract that was signed with the contractor - this is seen in the PDF that Kyle has. Their firm is a reputed firm that has done several such  installations across GA. There is no way that they did not follow the due process. They had sent the CAD drawings for approval as well had the whole gate inspection done by the county at that time. County will not do inspection or provide electrical cabling permit if the gate permit wasn't procured to begin with.

Has Kyle (or the lawyers) asked the county about the Permit that Shyam sent from the County's website?

Did HOA board direct Kyle to approach a lawyer before reaching to county? Who has the official notice stating the gate was not authorized?

My main questions are:
  1. When will this be resolved? 
  2. Who is paying for the lawyers and any ancillary expenses? 
  3. Why are we not able to close the gate since it has been functional for 9 years without issue with the County? The mechanisms for them to get into the community are still functional, open or closed. 
  4. Who on the board received the initial communications in September? As you mentioned in a prior email this was the first of your hearing about it when Rick and I started asking about the gate being open. 
Although I would like to better understand how we go to this place, considering that there is zero chance this gate got erected without approvals considering that Shyhm provided the attached screenshots from the county's own website with some approved permits. We all realize that mistakes happen but this just seems really odd to me considering the gate is not new.   

Thanks for agreeing to be the point of contact for this.  Will you be the point person for future concerns or how should those be handled?
When is the next scheduled HOA  meeting?
