URGENT MEETING ON 19-01-18 Saturday at 4pm

Dear All,  

An urgent meeting has been called on Saturday 19-01-18 at 4PM at my Office no. 305, 3rd floor, Business Centre, Main Shahrah E Faisal, Block 6 PECHS. Bank Al Habib Branch on the ground floor, and entrance is from the side lane.

URGENCY OF THE MATTER:   

I had a meeting with Emaar CEO today 16-01-18, at their office. The main agenda of the meeting was the handover of the units. The recent handover emails that Emaar have sent to the customers are subject to availability of utilities and DHA approval of the completion plan. 

SSGC Gas  Connection: This has delayed the project completion, however they are expected to complete now till end of February so handover process could be initiated by March 2018. I will also follow up with concerned SSGC department to expedite the work. 

Most Urgent and Current Threat:

DHA Completion Plan Approval: This is a major concern that can prolong the handover of the units for an indefinite period. DHA is holding on to the completion plans submitted by Emaar for over 2years now. Since last 2 years DHA is maintaining status quo on this matter, only false promises to approve plans have been given to Emaar by DHA administration. Please do understand the urgency of the matter, without approval of building plans by DHA, nor we can get possession nor we will be able to execute a registry which is our title document. I will explain the several reasons for the delay by DHA in detail during our meeting. 

Action Plan: 

We need to join hands once again like we did in past to take up this matter, however this time with DHA Administrator.  We will jointly discuss and devise a strategy to take up this matter with DHA for immediate resolution, as there is 3rd party interest in the project and we need to establish that with DHA to get the completion plan approved, enabling Emaar to handover the units to us. 

I look forward to see maximum participation on 16-01-18 and also forward my message to maximum affectees. Remember strength lies in Unity and with unity we can resolve this matter.

Is it not the obligation of Emaar to obtain the completion certificate and ensure provision of uninterrupted 

utility services.  

The commissioning of the Apartment in EVERY respect for handing over to its customers should be the contractual obligation 

of Emaar.  And if Emaar fails to deliver on time, instead of passing on the buck, the penalty and consequential losses

should be borne solely by Emaar ,

Completion Plan:

It is absolutely the legal obligation of Emaar to obtain the Completion Certificate as the real estate developer and DHA being the authority to approve i) master plan ii) building plans.

I hope you understand what is a meaning of completion plan in the building industry, it is a process to ensure that the construction is done as per bye laws. If any violation in byelaws along with other possible issues than the approving authority holds back the completion. 

Without the completion plan the registrar will not execute registry or a registered sale deed. This is an urgent matter.
