The Baby Moses Law has been in place since 1999, but there were insufficient funds available to educate the general public about the law. The Baby Moses Law provides a responsible alternative to parents who might otherwise abandon, neglect or harm a newborn child. The law states that a parent may leave an unharmed infant up to sixty days old in the arms of a hospital personnel, firefighters or designated Emergency Medical Service Provider with no questions asked and no penalty to the parent. Texas State Law 262.301 and 262.302.

The Baby Moses Law was passed in Texas because of the growing concern about the number of abandoned infants. It is estimated that each month two infants are abandoned in life-threatening situations in Texas and approximately 25% of all abandoned babies do not survive.

Babies cannot be dropped off at a fire station that is not manned. Volunteer departments are typically not manned 24-hours a day. There may be no one there to find and care for the baby. The goal of this law is to have parents place the child into the arms of someone capable of caring for the child and providing medical attention if needed.

If parents deliver a child into the hands of a person at a designated site there will be no question asked. Parents will be given a very short medical history profile to fill out on the baby for medical reasons only.

The state of California passed the Safely Surrendered Baby Law to give parents or guardians the choice to legally and safely leave a baby three days old or younger with an employee at any Los Angeles County hospital or fire station, no questions asked. The parent or guardian may surrender the baby without fear of arrest or prosecution for child abandonment. For more information about the law itself, please see the legislation passed on August 1, 2003 which strengthened the existing Safely Surrendered Baby Law.

The person surrendering the baby will be asked to voluntarily fill out a medical history form, which is useful in caring for the child. The form can be returned later and includes a stamped return envelope. No names are required.

Families who want to adopt a safely surrendered baby must be an approved Resource Family which means that the family can take in both children in need of foster care and children in need of long term permanence like adoption. There are many families that want to provide loving homes for these babies. While the process may involve long waits, adopting a child can be a rewarding experience.

The requirements for adopting a child can be met through the Department of Children and Family Services (DCFS) or a local foster family agency that is also licensed as an adoption agency. DCFS can be contacted at 1-888-811-1121 or via their website at To work through an agency, please ensure that the agency is contracted with DCFS.

What opportunities are available for safely surrendered children? In 2014, the Don Knabe Safe Surrender Scholarship Fund was established to provide scholarships for children safely surrendered in LA County. The Safe Surrender Scholarship Fund is administered by the Long Beach Community Foundation. Youth who were adopted as a Safely Surrendered Baby are eligible for the scholarship. The scholarship may be used for any purpose toward higher education, including trade school, community college and a four-year university. An Eligibility Verification Letter is sent to the adoptive family of a Safely Surrendered Baby at the time of finalization of their adoption. When the youth is 17 years old, the adoptive parents of the Safely Surrendered Baby may present the letter to the Foundation as verification of eligibility in the application for the scholarship.

Safe Place provides access to immediate help and safety for all young people in crisis. A network of thousands of businesses and other public locations across the country extend the doors of local youth serving agencies by displaying Safe Place's recognizable yellow and black diamond-shaped logo. Gainesville-Fire Rescue is proud to be a designated Safe Place for local youth in crisis.

The National Safe Place vision is to make the Safe Place sign the universal symbol of help and safety for youth by working with local communities to build safety nets that can prevent vulnerable children and teens from victimization.

The "Baby Moses Law" is the common name of a law which allows a parent to hand over a baby to authorized designated emergency infant care providers, including firefighters at a fire station, and walk away with no questions asked. The baby cannot just be "left" at a station but rather must pass from the parent to the provider. Of the over 100 babies who are abandoned each year in Texas, about 16 will be found dead. An unknown number of murdered babies are never found. The Baby Moses Law is a solution to the tragedy by providing a responsible alternative to mothers who might otherwise abandon, harm, or murder a newborn child. It states that a parent may leave an unharmed infant up to 60 days old at any hospital or fire station with "no questions asked."

The law is nicknamed "The Baby Moses Law" based on the biblical story of baby Moses. The group responsible for establishing the project chose the name Baby Moses because, in addition to being placed in a wicker basket by his mother to be saved from death, he was also carefully watched over by an anonymous protector until he was safely placed in the arms of a person who could provide the love and care necessary for life.

Gainesville Fire-Rescue stations are designated Baby Moses sites, or safe havens, where mothers can leave their newborns (up to 60 days old) with no questions asked and no fear of prosecution if the baby is unharmed. Babies left at a Gainesville Fire Station are transported to the local hospital by EMS for immediate examination and medical care. The Texas Department of Family and Protective Services will then take custody and place the child with a caring family. Mothers may voluntarily disclose background and medical information, but are not legally required to do so under the Baby Moses "Safe Haven" Law.
