We thank you for your visit on the 7 January 2013, wherein you and Mr. Ayan Banerjee met us to address certain issues. Please find the details given below:-
Query 1 Increase in SBA.
We have showed the calculation details for SBA signed by Architect Agrawal & Agrawal, drawings sanctioned by HIDCO in 2007 and present drawings. We have briefed you on the increase in SBA from sanctioned drawings to present drawings. The increase in SBA was primarily on account of following reasons.
1. Sewage Treatment Plant (STP): There was no provision of sewage treatment plant in drawings sanctioned by HIDCO in 2007 as sewage was supposed to have been discharged to HIDCO sewer line. However, later on as per authority norms STP has been constructed to use recycled water for flushing and irrigation purpose. (Refer Attachment)
2. Landscaped Podium
3. Increase in area of Electrical substations(11KV)
4. Increase in area of pump house and water treatment plant room.
We have clarified in details for an increase of 5.7% SBA against each unit due to the reasons mentioned above. (Refer Attachment for Common areas calculation)
Query 2: Compensation for delayed handover
As per Clause 17 (iii) of the S & P Agreement, KMDPL is not liable for delay if it is for the reason of non- availability of electric supply. Hence, compensation for delay in handover will be paid to you on and from the date of power supply to the project (i.e. 17th October 2012) till your Scheduled Payment Date.
Query 3: Circulation of deed of Conveyance
We agreed to share Draft Copy of Deed of Conveyance to you and Mr. Banerjee
Query 4: Relaxation of Final payment dates for residents outside Calcutta
As per the Letter of Handover served to you and Mr. Banerjee, the scheduled payment date is within 15 days from the date of receipt of the same and within 30 days registration of the property should take place to get the possession of the unit. However, if you are unable to proceed as per the LOH due to any unavoidable circumstances, you are requested to inform us via email or letter citing the reasons for the delay. If it is found that the reasons cited by you are justified, we can consider the delay for some grace period as decided by us mutually. But, delay beyond the grace period would attract interest as mentioned in LOH.
Query 5: Proper records for common facilities being charged to each owner depending on his handover date
Reply: Individual account for maintenance funds usage will be created for each owner for usage of common facilities. Owners can approach the appointed Managing Agent, M/s Colliers International for a statement of their individual account.
