I think the only power we possess is 'UNITY' and the only way we can WIN is by being together. 

There was a clear instruction in the Supreme-court order that the builder cannot cancel the buyer's booking (atleast of those that have already given 10%)

Hello Everyone.

I feel the case should be registered in each city where the applicant reside. When this builder will start roaming in every court  uske samaj mein khud ajayega ki logon ko pareshan nahin karna chaiye. You take money at the value when it was two year back. Who will pay the depreciated value. Secondly agar muje flat book karna hotha uswaqt jab noida mein flat value noida mein jab gira hua tha tab wahan book karthe lets stratergise the plan of action collectively and swiftly.

Surely I will Join. In my view, all of us should be on same footing and try to get written assurance form the builder (instead of getting oral assurance as was done in past). Written assurance will form bases for future litigation, if required.

Hope everyone will agree on this point.

We should not accept any conversion from Villas to Flats.

Builder may try to divide and rule policy and may communicate one by one that others are accepting Flats offer.

We should not trust on them on their such fake communication and stick with our Villas.

First of all I thanks to all the members who attended the meeting (Approx-30 members), those
who has not attended the same for your information today three directors Mr. S.P.Yadav, Mr.
Hemant Kumar Singh & Mr. Manish Nigam are in the meeting and Minutes of the meeting are as
follows and got it in writing with signature.
1. The process of registration has been started and completed with in one month with Noida
Authority.
2. 140 members as informed by director Manish Nigam who had booked villas will be alloted
villas only of sizes adopted by them.
3. All the present members informed that they are interested in only villas without any kind
of inflated rates.
4. the directors has shown willingness to share the revised layout in a span of 30 days and
any other proposed change will be discussed with the proposed members.
5. Hence forth the management of Eleven Acacis will inform about the progress on weekly
basis. As it has been agreed that they will share the communication, they will share the list
with members with there contact no's and e.mail ID

some members are interested to take the legal action against him will be postphoned upto next
meeting that will be held on 25th May,2013 Saturday.Please co-ordinate by all the members
should attend the same so that we can take the legal action or make pressure on the
management.

I am on my way to GNoida Authority along with Mr Darminder and one more member as to accertain facts pertaining to builders claim of Registration Process and mainly to know the facts pertaining to villa or flat as the actuality and above all to know how serious our builders are  for commencing the project and what are shortcomings .

Dear Members,
 
This mail is in continuation to yesterdays meeting had with the Builder by our approx 30 members and i reached late owing to urgent meeting but came to know about the briefing done by Directors which was same as per the last meeting i had with them and in fact yesterday there should have been more moment on account of registry and other things which make me alarmed and today i decided to visit myself to Greater Noida Authorities to ascertain the facts and did sent mail and two members immediately responded and Joined me at Authority, Namely Mr Darmendra & Mr Satyeneder.
 
We did meet the officials of the Greater Noida authority and also visited the site and outcome of both is as hereunder and then below will be the road map:
 
A) MEETING WITH GREATER NOIDA AUTHORITIES
 
1) Our builders have spent lot but they are not serious in doing Registry as conveyed by officials
 
2) They(Our Builders) are not yet completing Registration Process in terms of Stamp Duty and other Paper work
 
3) Almost every builder in Noida Extension has started work on their project and only our Builder is non Responsive as conveyed by Authorities
 
4) They (Authority) can't follow or ask our Builder to Do Registry as it is wish of our Builders
 
5) Authority is also in view that Builder has spent a lot but are confused rather surprised as to why they are not doing Registry.
 
6) Authority has no Role in deciding whether Builder wants to Built Villas or Flats as it is entirely decision of Builder 
.
7) When Builder gets the Registry done then they will submit Map and if that map has Flats and not Villas then it is responsibility of Builder and not of Authorities as to why Builder has not gone for Villas and that Map will be approved within 3 days thereafter.
 
8) After approval of Map then nothing will change and the work will resume as per Map layout and it can be Flat or Villa as shall be proposed by Builder.
 
9) There is nothing like Density for deciding whether it will be Villa or Flats as conveyed by Authorities.
 
10) Authorities also conveyed that they are ready to meet builder in our presence to know what shortcomings are there for builder to get Registration done.
 
 
B) VISIT TO SITE
 
1) Originally the Eleven Acacia Land was owned by Elev Acacia Villa and Beetel for Villas and Flat on an area of 34 Acres.
 
2) Now this land the board/ hoarding of Eleven Acacia has been teared down.
 
3) There are now 4 Projects coming on said said land (Eleven Acacia Board is Teared Down) which are:
 
     a) Prateksha-Morphis
 
     b) Rajnigandha
 
     c) Unibera
 
     d)Future Group 
 
4) The Guard present at Site is not aware of happenings.
 
 
SOS ROAD MAP TO BE IMPLEMENTED ON URGENT BASIS LATEST BY MONDAY 29TH APRIL 2013
 
1) Appointment of Lawyer
 
2) Creation of final group of members who are interested to go legal way and that Group will be separate from Goggle Group which is at present and its mail id will also be created separately
 
3) We need to hire advocate to give notice to our builder for our rightful claim of:
 
     a) Registration with Time Bound Process for Villas only
 
     b) Notice for Villas as dispute.
 
     c) Notice for Eleven Acacia Site as to how it has been compromised with other 4 projects.
 
     d) Existence of Eleven Acacia Villa Projects.
 
     e) Time Frame for completing said Project.
 
     f) All other Points which the Advocate will think is required to be given in Notice.
 
4) We need to create Corpus Fund by contributing at least Rs 1000.00 by every member so as to cover fees of Advocate and other expenses related to it.
 
5) This e-mail is notice to all members and those members who confirm today or latest by tomorrow to above road map , then the separte group will be made in each respect with respect to separate group email id and later tomorrow further briefing can be done.
 
6) The most active members who have time can please come forward to represent in case need be however i along-with Mr Darmender, Mr Satyender and Mr Sukhpal are ready at any given time.
 
7) All those members who confirm may have to attend the meeting with advocate as we will be asked to sign papers and give our Villa details along with sizes, Plot No and Amount paid etc and these modalities can be worked out by tomorrow
.
8) We need to hire advocate next to Greater Noida Authority office as they are very aware of the proceedings besides are on site and won't be any excuse of late or bust schedule in case we hire Advocate from Delhi or Noida.
 
I AM NOW LOOKING FOR YOUR VALUED INPUTS, CONFIRMATIONS AS OTHERWISE IT WILL BE NO CONCLUSION AS TRUST WITH BUILDER IS OF NO USE.

It is an excellent approach to start legal proceedings against the builder and prevent them from converting the layout from villas to flats.

Seeing the response from the builder i doubt if the builder has enough funds to actually construct anything on that site. That's a dreadful thought but very much applicable considering the long delay so far.

Pls count on me in any legal effort that we can take against the builder. I also suggest that we involve the brokers as well. They are also part of the commitment and overall responsibility.

I'll not be able to contribute in in person since i'm in U.S but will always/anytime be available remotely.

I do agree with you ...  Without making any further delay we should send  notice to builders as once builders put layout (without any Villas) , we will be looser ..   Authority will not verify what they committed to their buyers and then builder will start forcing us either to take Flat or cancel the booking ..

I agree with you.  I also believe this is due to some funds problem as I visited the accasia office n met Mr Manish and they have to pay the prasad to gov.  This is one of the reason why GN Authority wants it asap.

(1). Also did anyone check that for registory there is some particular time which is given to builder for payment otherwise plot is cancelled against the builder.

(2). Did this has been checked abt the timeline.

(3). For legal case builder can mention that they r going to make villas but specifically they don't mention the timeline. So being specific abt the timeline.

Secondly on the 1st attempt we have to involve the ic as they r the broker. I think someone from our group is in contact with ic manager.

I will check with Mr Manish n Mr Mrityonjay the exact reason for being late in process. Is it there partnership issue or funds issue. I m planning to visit this saturday.

In the last meeting also, after reading MOM, they never said villas owner will be given flats. As Praveen ji also said they have paid lot of amount to GNoida authority. So we should mount pressure to the builder. We have not done any agreement yet. Builder may scrap the project and say take your money. But  he never said he won't. I think we must find out the reason that they are not going for registry.
Legal action may be last action ,because if we win the case also in 2-3 years or whatever may be the time, then he can scrap the project. Because we have just booked the villas without any agreement. I don't know much about law.
But with due respect to all, we must mount pressure on builder by showing unity. and where we waited for 2 years we can wait 1 more month. and registries have been started in last 6 months only, before that no registry was being done.
This is just my small suggestion. Otherwise I am also with you guys.

I completely agree with Mr Praveen's approach here. We will have to be pro-active rather then re-active to whatever builder told us. 

First, I think we must meet ASAP personally and privately (including all the members we know) to discuss further course of action. 

Second, I also back the opinion of hiring a lawyer for the same. May I mention hiring a lawyer never means we are directly hitting the builder but we must consult and should seek advice for our situation and we may decide what to do on the basis of the advice. 

Last but the most Important, 'Unity' is the only power we posses and make us 'WIN'. 

I think we are making our talks 'public' by talking on this group as-is. We should either create a new group or let's talk to our specific mail-IDs(just copying every-one's email ID)

Let you please take the lead and yesterday at 4 pm I tried a lot to reach you so that you can take the lead but it seems you were preoccupied that time.

I would request you to first understand the modalities of hiring advocate in terms of:

1) whether all members who wish to pursue in legal way have to be present first time in Advocate office.

2) Do we need to inform our villa details etc to Advocate

3) Your help in Hiring Advocate and that too who sits at GNoida only.

4) Money of Rs 1000 to be collected on Sunday itself.

5) Creation of Final Group who opt for legal way.

I urge all members again to come forward in person and not on mail who opt for Legal way and yes I think Sunday is ideal day as all members can be present , besides we will also come to know the exact procedure to be adopted with respect to hiring Advocate  and the action line thereafter.
Today we are again meeting Authority officials through high level contact to accertain the exact happenings and it will be also conveyed but Mr Gupta you please chart a plan along with venue and time for all members to be present on Sunday and it shall be desirable for all members to discuss on same day with Advocate, so we should be ready with all.

hereunder and then below will be the road map:A) MEETING WITH GREATER NOIDA AUTHORITIES1) Our builders have spent lot but they are not serious in doing Registry as conveyed by officials2) They(Our Builders) are not yet completing Registration Process in terms of Stamp Duty and other Paper work3) Almost every builder in Noida Extension has started work on their project and only our Builder is non Responsive as conveyed by Authorities4) They (Authority)can't follow or ask our Builder to Do Registry as it is wish of our Builders
5) Authority is also in view that Builder hasspent a lot but are confused rather surprised as to why they are not doing Registry.6) Authority has no Role in deciding whether Builder wants to Built Villas or Flats as it is entirely decision of Builder.7) When Builder gets the Registry done then they will submit Map and if that map hasFlats and not Villas then it is responsibility of Builder and not of Authorities as to why Builder has not gone for Villas and that Map will be approved within 3 days thereafter.8) After approval of Map then nothing will change and the work will resume as per Map layout and it can be Flat or Villa as shall be proposed by Builder.9) There is nothing like Density for deciding whether it will be Villa or Flats as conveyed by
Authorities.10) Authorities also conveyed that they are ready to meet builder in our presence to know what shortcomings are there for builder to get Registration done.B)VISIT TO SITE1) Originally the Eleven Acacia Land was owned by Elev AcaciaVilla and Beetel for Villas and Flat on an area of 34 Acres.2) Now this land the board/ hoardingof Eleven Acacia has been teared down.3) There are now 4 Projects coming on said said land (Eleven Acacia Board is Teared Down) which are:a) Prateksha-Morphis b)
Rajnigandha c) Unibera d)Future Group4) The Guard present at Site is not aware of happenings.
SOS ROAD MAP TO BE IMPLEMENTED ON URGENT BASISLATEST BY MONDAY 29TH APRIL 20131) Appointment of Lawyer 2) Creation of final group of members who are interested to go legal way and that Group will be separate from GoggleGroup which is at present and its mail id will also be created separately3) We need to hire advocate to give notice to our builder for our rightful claim of: a) Registration with Time Bound Process for Villas only b) Notice for Villas as
dispute. c) Notice for Eleven Acacia Site as to how it has been compromised with other 4 projects. d) Existence of Eleven Acacia Villa Projects. e) Time Frame for completing said Project. f) All other Points which the Advocate will think isrequired to be given in Notice.4) We need to create Corpus Fund by contributing at least Rs 1000.00 by every member so as to cover fees of Advocate and other expenses related to it.5) This e-mail is notice to all members and those members who confirm today or latest by tomorrowto above road map, then the separte group will be made in each respect with
respect to separate group email id and later tomorrow further briefing can be done.6) The most active members who have time can please come forward to represent in case need be however i along-with Mr Darmender, Mr Satyender and Mr Sukhpal areready at any given time.7) All those members who confirm may have to attend the meeting with advocate as wewill be asked to sign papers and give ourVilla details along with sizes, Plot No and Amount paid etc and these modalities can be worked out by tomorrow.8) We need to hire advocate next to Greater Noida Authority office as they are very aware of the proceedings besides are on site and won't be any excuse of late or bust schedule in case we hire Advocate from Delhi or Noida.I AM NOW LOOKING FOR YOUR VALUED INPUTS,

Hi Praveen ji,
Considering the points you have provided, I completely agree with you but my request is to let us arrange a meeting first with all the buyers on coming weekend and then decide our plan of action. I understand, that this is something very urgent to take necessary steps at this point of time but we need to hear everyone in deciding our next and very important step going ahead following legal formalities which you are mentioning.
 
As there may be some buyer's who don't check their gmail accounts so frequently or may be they are not part of google group (or due to some other reasons) so they may remain unaware of this recent and a very important development, hence we need to call them individually for our meeting first and get their views.
 
Also, my request for everyone among buyer's that if we have any lawyer among us then please be a part of this meeting and share us your valuable thoughts on it.
 
We also need to consider the timeline in the meeting as to how much time such court cases finally take to reach to conclusions (though frankly I don't have any legal background to understand these timeline's concerns).
 
Moreover, if we can arrange list of all 140 buyers (as claimed by builder) through brokers or anyone from builder's side and communicate with them then it will definitely make more impact.
 
Please let us know your thoughts on it.

I have discussed the matter with Mr SC Chauhan (Advocate and also Member of Eleven Acacia) and has suggested to go ahead and he will be arranging Advocate today itself.
Further we need to meet on Coming Sunday 28th April 2013 at around 3 PM at Cannught Place ---Central Delhi area.
We need to carry alll photocopy of the documents of the Villa to be submitted to Advocate including copy of Payment Reciept etc.
We need to contribute Rs 1000.00 on the spot itself.
 
Now Please confirm today by 5 PM Who all will be attending the meeting with documents etc as then we will decide the exact Venue and accordingly this has to be conveyed to Advocate who will be sending Legal Notice with respect to those members only who wish to join now.

Requesting you all to please share the latest update, as I also read somewhere on mail thread that land registry process has been completed and now builder is going to submit the layout plan to GN authority. I believe this is the right time to approach GN authority to check the layout plan if submitted by the builder.

I will be reaching India on May 6th and will try my best to meet you all in next meeting.

Also, some news is coming (as per conversation of Mr Rajeev with Mr Mritunjay) that registry has been done and they are planning to submit layout to Authority, though we are not sure about the validity of this news but considering it as true I think it is a very crucial time to expedite our actions now.
Please let us know any updates pertinent to it.
