Potential script error for goals and health concerns

Im recieving this error on both the goals and health concerns section of a CCDA.

Consol Health Concerns Section (V2) If section/@nullFlavor is not present, SHALL contain [1..*] entry such that it (CONF:1198-30768, CONF:1198-30769) Conforms to Health Concern Act (templateId: 2.16.840.1.113883.10.20.22.4.132:2015-08-01)

If the templateId for the Health Concern Problem Observation and  Goal observation are switched or the templateId's with the extension are deleted we then pass validation on the C-CDA R2.1 Validator for USCDI v3.

I think this is an invalid error from the validator.

Hello,

Our team has done initial review and determined that those errors should not occur with your xml validation. The validation should pass without having to remove the template Ids. 
We will review this further and make necessary updates to resolve the issue.

Hi Kim, 
Was this fix part of the June 3 update (2.367) or will it be coming in a future update?   We ran the validations today and continue to get the error. 

Error -
