USCDIv3 - Patient 4 Sex Observation Error

HI, 

We are running a check on the USCDI3 for Sender, Sample 4(Mahal,David) , for View Download transmit and getting an error for Sex Observation.  

"Error- The scenario contains Sex Observation data with code asked-declined, however there is no matching data in the submitted CCDA" 

The test Data doesnt appear to include the sex observation of 'asked-declined' for this patient.  Should this be giving this error?
