EAP Resident TTF Fee Discussion – White Papers Shared with AEDAB / Town of Erie Council

Dear EAP Neighbors,

I wanted to share the same materials I have provided to AEDAB, Town staff, Town Council, and related KEIK airport stakeholders regarding the ongoing residential through-the-fence fee discussion.

After watching this June 18 AEDAB meeting, I came away believing even more strongly that this issue needs a constructive, structured, and fact-based process. The discussion showed that there are still significant unresolved questions regarding legal authority, FAA compliance, airport finances, access categories, collection/enforcement, resident communication, and how affected homeowners should be heard before any final recommendation or Council action.

To help organize some of those issues, I prepared the attached working papers. These materials are intended as good-faith issue-spotting and educational documents. They are not legal advice, and I am sharing them only in my individual capacity as an Erie Air Park resident, homeowner, pilot, aircraft owner, and active airport user. I am not speaking on behalf of any HOA, association, neighborhood group, or other residents.

The attached materials address three related topics:

  1. Erie Municipal Code Chapter 7, the Airport Fund ordinance, FAA grant-assurance issues, and the residential TTF fee framework;
  2. TABOR considerations for any residential TTF fee structure; and
  3. Collection/enforcement mechanisms, including whether the existing Airpark association, a new taxiway association, Town-issued permits/access agreements, tax-roll collection, or another structure could realistically collect and enforce any future fee.

My hope is that sharing these materials helps improve the quality of the discussion and gives residents more context before any future AEDAB or Town Council action. These issues may affect a large portion of the neighborhood, depending on how access categories are ultimately defined, so I believe affected residents should receive direct notice and have a meaningful opportunity to be heard before any final decision is made.

I also want to be clear that this Google Group is useful, but it should not be treated as the only method of communication or notice to affected property owners. I do not know how many residents or owners are on this list, and I do not believe any informal email group or association presentation should be treated as speaking for all affected homeowners.

Constructive feedback, corrections, additional documents, or other considerations are welcome. If anyone has information that would improve or correct the analysis, I am happy to review it.
