FYI the town is basically telling me that as they begin the legal process with the maintenance yard, they won't be able to share much. But at least that means things are progressing.

Hi Laurren,

 

We’ve had several inquiries from residents and at least one council member on the status of the CNGC maintenance facility. Right now, we have received documentation for a PD amendment to start bringing them into alignment on the site. We require both a PD amendment and site plan for them to be able to proceed on improvements on the site. At the same time, they are making some progress on code violations, and that is an ongoing conversation.

 

I do want to note that the PD amendment will be a quasi-judicial process, which means since it’s zoning, they’ll need to have a hearing both with Planning Commission and Town Council. This requires Council to be objective and to not discuss the project outside of the hearing and the information presented as part of the packet and during the hearing.

 

I’m always happy to give you an update on where things are, but will also have to limit some detail based on the specific process.

The property owner also said they would be submitting this week as well, which could result in us “pausing” the court proceedings if the submittal is complete and we see we’re moving forward on the solution.

Hi Sarah,

Thank you for the detailed response and for confirming the Town is actively working to resolve the issues here. I'm assuming you haven't heard anything regarding the Site Plan for the Friday deadline - can you confirm the Summons will be filed in the Municipal Court and when that might be expected to happen? I'm assuming this matter won't make it onto the docket for the 6/9 session, so we'd be looking at perhaps the 7/14 session for a hearing if it gets that far?

Thank you for formal complaint regarding the maintenance yard. At this time, the Town is working with the property owners on a solution for the site.

 

Over the past several years, discussions between the Town and property owner of the site (including through a transfer of ownership) resulted in multiple site analyses and potential solutions, but no formal action from the property owner. In December 2024, our department issued a code violation letter with timelines for action to address their noncompliance with zoning, site plan, and property maintenance.

 

  1. The violation letter outlined a timeline for steps to address the property issues. A pre-application meeting was held on 2/13/25 where staff provided guidance on next steps to bring the site into compliance.
  2. They are required to submit a PD Amendment application to first address noncompliance with zoning along with a Site Plan by this Friday, May 30th.
  3. Failure to comply will result in initiation of a summons process to move the matter to court.
