Powers of RWA MC & Guidelines for Socities

Greetings!

I wanted to know if there are any guidelines for societies with regards to the percentage of area that should be green, area that should be a playground, common area, parking area etc?

Also, what are the powers of a RWA to convert playing space into green area etc?

Which authority has the jurisdiction to overlook the working of Managing Committees of a RWA?

I shall be obliged if anyone from the members could enlighten me on this issue pls.

Dear Mr. Shobat Chauhan ji, Firstly the term Society is for CGHS Societies registered with Registrar of Co-operative Societies under the Delhi Co-operative Societies Act, 2003 and term RWA (Resident Welfare Association) is in 99% cases registered with the Registrar of Societies under the Societies Registration Act, 1860, which has been recently amended in 2012. The rights, powers and liabilities of members is described in the Memorandum & Articles of Association, in the addition to the relevant laws of the land. FOR GUIDANCE, there is a web-site http://legal-path.com which is run by a Trust. FOR SERVICES of management of Society/RWA, you have to have a meeting with them after fixing an appointment or writing query in their web-site itself. Kindly feel free if any more information required.

Mr. Sahota.. The Socities Registration Act 1860 amended ? Do you have a copy or link? i found only Haryana amended this and not delhi. As every one know this is where maximum FOUNDATION for corruption as the law is Ancient and still our Govts not interet to amend it.. Obvious reason as 99% of Trust and Schools are under this Act.

As far as building norms if you are referring about CGHS then its DDA Building Byelaw-MPD comes into play in such matters.
Please note RWA are in DDA Pockets or Plotted Lands and not in CGHS Apartments as mentined below by Mr. Sahota.

Management may be able to convert Green to Play or Play to Green, as I think in the Building norms for residential complex there is no MANDATORY provision to give or allocate space for Play but certainly % of green area is MUST.

Dear Sirs, 99% of the RWA and Schools are registered under the Societies Registration Act, 1860 but as far as the Trusts are concerned they have to be registered under the Indian Trusts Act, 1882. The Disputes Settlement Trust is registered under the Trust Act. Link is here http://www.legal-path.com/about-us. If any of the RWA wishes help to legally manage their RWA and resolve all the problems, they can register themselves once for all by paying Rs.1000/- fee. The membership list has to be deposited with the Trust and Audit Report copy is also required to be filed with the Trust. It functions on self financing basis but the verdict of the Trust functionary is equivalent to a Decree of a Court and executable in Courts under the Arbitration and Conciliation Act, 1996.

As regards CGHS is concerned they are governed by DCS Act 2003 and DCS Rule 2007. As Building is concerned by the governed by DDA's Building Bye Laws.
All these are there in web and can be perused.
