Cheating by Tata Photon people ... a very poor service and looting ....

Dear Members,

I had a TATA Docomo connection, which was useless ... we just coughed up so
much but the service was very very poor.

I then decided to close the connection and I as advised by them through
phone made payment and closed the connection. They wanted to send it to
creati...@gmail.co. I sent it and also copied to
Tata-Indic...@tatatel.co.in, bi...@tataindicom.com these addresses.

But I kept receiving their bill even without using it. Now they have sent
me a legal notice. See below. What should I do? Should I pay these cheats

Tata Teleservices Limited, having its office at 2A, Old Ishwar Nagar, Main
Mathura Road, New Delhi-110065, serve you this notice of demand, the
contents whereof you may note as detailed herein below-

1.      Tata Teleservices Limited is a leading Unified Access Service
Provider in India and provides various Telecom and other services in
various telecom circle in India by virtue of Licenses granted by
Department of Telecommunications (DoT), Government of India.

2.      A connection was allotted and sanctioned to you on your request
on a duly executed Customer Application Form and other related
forms/documents ("Agreement" hereinafter). The aforesaid connection and
account ID was allotted to you. You availed best of the service/s
provided by Tata Teleservices Limited after activation of the said
connection.

3.      As per the terms of the Agreement, you were under an obligation
inter-alia to make payments of the periodic bills raised by Tata
Teleservices Limited upon you in respect of the availed services.
However, inspite of the receipt of the said bills, you have grossly
failed to make the due payment in time. Due to the non-payment of your
legitimate dues, Tata Teleservices Limited was compelled to
bar/suspend/disconnect your aforesaid connection.

We, therefore, call upon you on behalf of Tata Teleservices Limited to pay
the outstanding amount of Rs.1616 /. along with interest @ 2% per month
from the due date till the realization of the amount within seven (7) days
of the receipt of this notice, failing which Tata Teleservices Limited,
shall be constrained to initiate appropriate legal proceedings, criminal as
well as civil, against you at your absolute costs, risk and consequences.

This notice shall stand withdrawn soon after your payment is realized by
our company, as mentioned herein above.

This has reference to your email dated 09/12/2013 02:51 PM.

In this connection I would like to tell you that I had already asked them
to disconnect my services when I sent the transaction proof. See my mail
below. After than when I received a call again I told them to disconnect.
But they never did. In any case, I never used the connection also.
So how can I pay Rs.1616/-

I am also forwarding other mails which I had sent later also.

U can make a complaint to TRAI or Deptt of Telecommunication. 

Last year, Tata photon delayed activation of my device by one month, I took up the case with TRAI, after that, it gave me a rebate of Rs. 400/- as compensation.  I am not satisfied with this and planning to go to the arbitration route set up by the Deptt. of Telecommunication.  Will share more details with you when I will find time to file my case for arbitration next month.

In the meanwhile, you may reply to to the notice giving the full facts.

Yes, the proposed action is correct. I have also a sad experience with this company. They threatened me to file a case against no payment issue within an hour whereas there was no outstanding dies against me. I replied to them I myself  proposed to file a counter case them so they immediately disconnected the phone and thereafter nothing happened. Actually such companies hires the group to bully the targeted customer. Further I took up informally with TRAI . Subsequently the Tata Photon appolised me and confirmed that I do not have any outstanding dues. Hence it is better to take up with TRAI with a copy to Tata Photon
