Property Tax arrear

Recently we have receievd a letter from MCD regarding unpaid property
tax for the period prior to 2004 w.r.t. our property at Dwarka. We
bought this property in 2004 and ever since we are regularly paying
the property tax. The letter is silent about the method of computing
the property tax and also there is no bifurcation of principle amount
and interest thereon. It simply says that if paid till 31.03.2012,
there will be 100% waiver on interest payment.

Has anyone of you received any such letter? What step are you taking
on that? I think MCD should disclose the method of arriving at that
amounrt as well. Waiting for comments.

Dear Manisha,

Members of our society also received similar notifications from MCD though most of the members had already paid the property tax. Some of our members personally visited MCD office and were surprised to find that no records have been maintained at MCD. However, I have personally discussed the matter with a few people having knowledge on the subject and was advised that a few points to be considered for the purpose are (i) Date of issue of the possession letter (ii) Date of issue of completion certificate (iii) Whether the property has been assessed by MCD before 2004. Please, find out whether the person from whom you have purchased the property has paid the property tax prior to 2004, (if applicable). If not, then the arrears will have to be paid by you since the property tax is recoverable on the property. 

I must confess that I am not competent to advise you with authority but have conveyed to you on the basis of advice I myself sought. However, many of us, based on the advice, have decided not to pay since we had also paid the tax upto date. Also forwarded a letter to MCD confirming that the property tax has been paid and enclosed zeroxed copies of the receipts. I have also been told by these gentlemen that it is not unusual for MCD to issue such notices in order to collect funds before 31st March.

Dear Mr Rawat and Mr Gupta,

Some of our members in our society also got the similar notification.

While two had earlier paid Rs.8,000/- (when the demand was for 32,000/- or
so) in 2004-05 they again
paid Rs.10,000 now.

They had met Mr M S A Khan (who had issued notices to all the societies
asking for property tax for common areas etc. which is now
nullified by Mr Chandolia, Chairman) he has asked them to pay Rs.10,000/-
They then went to the Najafgarh office and paid it.

There is another case in our society who got the flat allotted only in
2010. The demand was for 38183/-
For him they have calculated the PT as under and somewhat made it 33764/-
(!!!!).

The amount 12728 was arrived by the following:

In this case vaccancy remission for the rest of the years should also been
calculated !!!

But you know how the MCD works ...

Dear Mr. Jayaraman

Since 2004 onwards the property tax has to be paid on the basis of unit area system, as per MCD notification. The amount of tax mentioned by you certainly appears too high.
