Sir,
 
We found the MCD Property Tax and MVC report published on the mcd website following the RTI and Appeal(Portion only).
 
However http://www.mcdpropertytax.in/noticeslistdetail.php?id=17&type=N  Public notice had NO DATES where as the last date for submission was set days from publishing. Please let us know the publishing date and correct the Public Notice or re issue.
 
It may worth inform all the RWA office bearers through letters/emails/fax of inviting suggestions.

SUGGESTIONS RECEIVED FROM PUBLIC

Extra discount of 20% to others as is presently allowed to Group

Housing Societies.

This suggestion was also not found acceptable as the discount is allowed to the

Group Housing Societies for maintaining part of Civic Services which are

otherwise maintained by M.C.D. for others.

We would much appreciate the MCD MVC make it transparent on its process as we hear from News like above often but on RTI we are not shared information. Then issues like COMMERICAL establishment run from JJ Cluster, Illegal and legal Colonies, Farm Lands, Villages are exempted from tax and HUGE REVENUE LOSS for Govt.
 
We are only trying to get information,  pelase coo perate.

APPEAL UNDER SECTION 19 (1) OF THE RIGHT TO INFORMATION ACT, 2005 AGAINST THE INFORMATION FURNISHED IN RESPECT OF THE APPLICATATION UNDER RTI ACT VIDE I.D. NO- 722. DATED 9.7.2010.

 

MOST RESPECTFULLY SHOWETH:

 

1.         That the appellant had moved an application under section 6 (1) of the Right to Information Act, 2005 vide I.D. No. 722 dated 9/7/2010 seeking the information as enumerated in the said application. The photocopy of the said application vide I.D. No- 722 is annexed herewith and is marked as Annexure –I.

 

2.         After FAA mr. Khan in its order No. 319/344 dated 1/11/2010 the PIO of Mr. S C Yadav, responded vide ref 1670 dated 15/11/2010 provided information as per provision of RTI Act 2005.  The reply was well over prescribed 30 days period(Orginal application dated 9/7/2010) for which PIO is liable for punishment for delay.

3.         It is submitted that the information sought in the said question No. 5 neither falls within the ambit of Section-8 nor Section -9 of the RTI Act and hence the appellant is entitled to have access to the information sought. Thus, the denial of the said information by the Respondents  is illegal  for which Respondent are liable.  

4.       It is submitted that the information sought in the said question 1 (d), (e), (f), (h), (j) denied for which PIO is liable for punishment under RTI Act 2005.  The reason given is not justifiable under RTIA 2005. There is already existing directions of CIC in particular to Section 4 of RTI Act 2005 particularly where policy and formation are concerned http://rti.india.gov.in/cic_decisions/CIC_SG_C_2010_000345_8440_M_37452.pdf. In this case the info sought is about AGENDA and Minutes of Municipal Valuation Committee which qualifies well within the parameters of Section 4 of RTIA 2005.

5.         The PIO also mislead not provided information on Question No. 1 (a) (b) while claim the copy attached, where as no attachment included in the mailed envelop. Also as mentioned uploaded into website no web link provided and on search no such information found.

6.         The PIO Question No. 1 (c ) where info sought on the UPDATE date. Where no information provided by PIO.

7.         The PIO also denied information on question No. 2 (a) stating the relevant copies attached but no information provided to appellant. While info sought was COMPONENT of Rs. 320 charged for Category D(Dwarka) which found denied by PIO.

8.         The PIO mislead in the information provide in ref to Question No. 2 (d). The PIO of Assessment and Collection , Najafgarh Zone through its letter No. 771 dated 12/10/2009 informed that COMPUTERISATION OF MANUALY COLLECTED PROPERTY TAX YET TO BE MADE.

9.       It is submitted that the information sought in the said question 3 (b) on file noting were denied information sought, for which PIO is liable for punishment under RTI Act 2005.

10.       That the instant appeal is preferred within limitation period along with complaint under Section 18 of RTI Act 2005 against MCD authorities.

 

GROUNDS OF APPEAL

 

A.        Because the Respondent No.1 has denied access to the legitimately sought information under the provisions of RTI Act.  

B         Because the Respondent No.1 has denied access to the legitimately sought information under the provisions of RTI Act.  A detailed response and comments for appeal as per Annex II. (Below). THE PIO is MISLEADING and SUPPRESSING the INFORMAITON

C.      It is also noted the MCD and Property tax department to have all the information catalogued and indexed, computerised within stipulated time under RTI Act 2005. The reply by APIO confirms vital and statically information's are not maintained in line with various provision of work/conduct and service rules etc.

D.      The PIO/APIO have also DELAYED the information beyond the stipulated period for which a Complaint u/s 18 of RTI is being filed with CIC immediately.

 

P R A Y E R

 

In view of the above the following is humbly prayed:

 

(i)                Direction may kindly be issued to the Respondent to provide the correct, sufficient and clear information as sought for and all relevant information be uploaded to department website for public at large and set example in transparency.  

 (ii)     Direction be given to PIO/APIO to computerise all records and share all relevant information through website on Property tax..

(iii) Direction be given to CPIO/PIO/APIO to put all statutory information as per Section 4 of RTI Act 2005 computerising records and files, including all , tax Act, minutes, circulars, reports of various committee formations and its mandates etc and all other relevant information’s.

 (iv)     Suitable and STRICT appropriate disciplinary action may please be initiated against the Respondents PIO/APIO’s for acting against the statutory provisions of Right to Information Act, 2005.

   

(v)           Any other or further relief which this Hon'ble Authority may deem fit in the interest of the justice under Right to Information Act, 2005.

ANSWER : (a) The copy of the notification is enclosed. The same has been forwarded to DC(IT) for uploading on the Corporation website.

Comments: The PIO is MISLEADING and which is punishable. There is no info updated found on the MCD Website. Nor the Enclosement found on the envelope of the reply. The Despatch registry may confirm this. The MCD is habitual doing such mischief not enclosing attachments.

Appeal: The PIO be directed to provide copy of the notification by Regd Post urgently else send the Complete Web link where the information uploaded and shared in public domain.

b.       Please provide the list  MVC members and their appointment details through your website under Section 4 (1) B of RTI Act 2005 about the criteria and procedure adopted for appointment of chairman and members of committee.

2.       MCD Property Tax : 

a.       Please Provide List of Components' of Property Tax Value.(For example Rs. 320 charged for Category D. This Rs. 320 is for what all service components that MCD render to a property owners)

ANSWER : (a) The parameters taken into consideration are type of colony, use, age, type of structure and occupancy, status of the vacant land or building, as the case may be. However, the relevant copies are enclosed.

 

Appeal: The PIO be directed to provide copy of the documents(As no copy found attached with letter) . You may also send the Complete Web link where the information uploaded and shared in public domain. The info sought is COMPONENTS of VALUE or for what all services the MCD charge these property taxes. Not on how MVC arrived the rate (Rs. 320). Also in Dwarka on one 5.5 Acre land there may be over 256 flats.

ANSWER : (d) The method of calculation of Property tax value is well explained in the Property Tax. form, available at the website of mcd property tax. No such information is available with this department. The mode of payment of property tax has been computerized and maintaining the records.

Appeal: The PIO be directed to provide METHOD in arriving Property Tax Value for example D Category Area of Dwarka have Rs. 320. There is no such mention found on the property tax form http://www.mcdpropertytax.in/intProperty.php . The PIO of Assessment and Collection , Najafgarh Zone through its letter No. 771 dated 12/10/2009 informed that COMPUTERISATION OF MANUALY COLLECTED PROPERTY TAX YET TO BE MADE.  Now the question remain when this computerisation finalised and operational ?The online property tax have been accepting since 2007. However, those remit by manual forms and manual cash/cheque deposits are computerised or not?

Now question remain unanswered. Whether this is actual figure including manual collection and Online Collected? The PIO and Asst Collector MCD Najafgarh stated that there is no computerisation of Property Tax and its records in his reply dated

 

Appeal: The PIO be directed to provide information sought as above. Please note as per Section 4 of RTIA 2005 all the records need to catalouged and indexed. It is also known fact that the revenue collection need to be computerized. The PIO not provided information sought, which is punishable under RTIA 2005.

We have filed an RTI Appliction on 9th July 2010. Its well over 90 days the PIO denied the information within the time frame as per RTI Act and liable for punishment under RTI Act 2005.
 
We also here by request FAA to consider this as Appeal U/s 19(1) on this RTI Application.
 
Plese let us know at the earliest. We are processing the complaint u/s 18 of RTI Act 2005 agains the PIO for failure to meet RTI ACT 2005.

Panel wants civic body to hike property tax rates
 
New Delhi Ticking off the Municipal Corporation of Delhi (MCD) for its poor property tax collection, the Third Municipal Valuation Committee (MVC), in its final report, has recommended that the MCD increase its tax base or hike property tax rates especially since real estate prices have gone up across the Capital. The MVC has further recommended a consequent re-categorisation of 200 MCD colonies to increase revenues of around Rs 500 crore per annum.

In its report submitted before Chief Secretary Rakesh Mehta and Municipal Commissioner K S Mehra last week, the MVC, constituted by the Delhi government to review property tax rates, has said that the real estate value across the Capital has gone up by 40 per cent in the past three years, while the Corporation has managed to collect a mere 25 per cent of its tax targets.

The MVC has recommended that 17 colonies currently falling under Category B of house tax be upgraded to Category A. It has further suggested that MCD re-categorise 62 C category colonies, upgrading those to Category B and 57 D category colonies to Category C. The re-categorisation has been recommended based on road connectivity, proximity to markets and malls, road length, civic facilities and connectivity.

The re-categorisation, say MCD officials, is imperative, considering MCD’s dismal tax collections since the unit area method of tax computation was introduced in 2004. This change, if implemented, will result in a huge jump in property tax.

Areas under the jurisdiction of MCD are at present divided into categories A to H depending on the infrastructural facilities there. Any colony that has a grading of 89 or more in terms of facilities etc, comes under Category A while Category B has gradings between 75 and 88. At present, there are 28 Category A colonies in Delhi, where the tax rates are higher. These include categories like New Friends Colony, Vasant Vihar, Shanti Niketan, South Extension among the many.

But the committee’s is only an interim report and while enhancing annual valuation comes under the jurisdiction of Municipal Valuation Committee, the implementation of increase in tax rates is the exclusive jurisdiction of the deliberative wing of the MCD.
