As you may well aware that all the buildings require permission and plan from MCD in its area ? After recent court directions and MPD 2021 there were clear provisions were incorporated in MPD2021 and building plan to have ECS(Equal Car Space for 100 sqmt ?) and conversion charges.
 
We noticed a large number of buildings have come up.  Legally or illeagly with nexus with some MCD staff is matter of findings. However prima facie it appears all of the building have NO PARKING as per MPD2021 or heard of any CONVERSION charge paid ? Did MCD approved the buidling plan for this area ?
 
Would it be possible for your department to confirm the above and revert to us URGENTLY?

Dear All,
                       I would here by like to share with you the result of
a R.T.I. Application that I recently filed with M.C.D.

In a R.T.I. Application filed in early July 2009 with M.C.D. I sought some
information regarding Conversation Charges collected by M.C.D. the gist
being ; *

1) How many Firms have registered & paid conversion charges on one time
basis ?

2) How many Firms have registered & paid conversion charges on annual
payment basis ?

3) Has any firm which has opted & paid conversion charges on annual basis in
first year but not paid later eligible to avail benefit of M.P.D. 2021 ?

4) How many firms that registered under annual basis have not paid
conversion charge in next years ?

To my utter disbelief & shock the M.C.D. which is believed to have Collected
around Rs. ONE THOUSANDS CRORES in CONVERSION & PARKING CHARGES its Building
HEAD QUARTER Replied - It has NO RECORDED REPLYAVAILABLE  to my Questions 1,
2 & 4 and referred them to All 12 M.C.D. Zones but on 3rd Question the reply
was clear - the payment is mandatory every year.

*The shock was further aggravated when replies from Zones started coming in
to me and *shockingly most zones replied most brazenly - NO RECORD IS
MAINTAINED. ** *Infact the most commercialized Central & City Zones called
me to inspect what ever record they had - *the record offered for inspection
was - hundreds of Receipt Books kept in a dirty dingy room. They wanted me
to check them out at Rs. Ten per hour and elicit details.

The Civil Lines Zone topped the list of evasive zones - It Gave Me A Single
Line Reply - NO RECORD OF CONVERSION CHARGE IS AVAILABLE.

*Karol Bagh Zone offered a C.D. that contains details of Benefits of
Conversion Charge in the name of Conversion Charge Detail at Rs. 50 per C.D.

*Friends I hope this amply proves the callousness with which M.C.D. works. A
body that has statutory duty of collecting Conversion Charge and has already
believed to have collected Rs. 1000 Crores has No Record from Whom it has
Collected and How Much Total it has Collected speaks volumes on the state of
affairs in M.C.D.

*God Save Delhi !

It seems that the Municipal Corporation of Delhi (MCD) does not know from where the lion's share of its revenues come from and how much of it is still untapped.

The civic agency gets the majority of its revenues in terms of property tax paid by Delhiites. However, out of the total 40 lakh assesses only 9 lakh pay their property tax.

The MCD admits that it does not have exhaustive data of its taxpayers due to "shortage of staff".

Standing Committee chairman Ram Kishen Singhal said, "We have asked Commissioner, KS Mehra to come up with a concrete proposal so that tax evaders could be nabbed. Either the MCD will rope in the power discoms or take help of any other agency to find out the real number of properties and bring all the property owners in the tax ambit," said Singhal. When asked why MCD has failed to do it so far, he said: "We do not have adequate staff to undertake such a cumbersome exercise," he added.

MCD Commissioner KS Mehra said, "There were various reasons as to why we failed in identifying the tax payers. But now MCD is coming up with a comprehensive plan to identify them and make them pay tax. MCD has received a report from Survey of India and sought help from resident's welfare associations is also being taken."

He added that engaging the power discoms is also proposed. "Now, we are moving in right earnest," Mehra.

Why people don't pay tax?

MCD officials say there are various reasons for it. They said lack of political will and interference from the "influential netas" are the main reasons behind it. "Every party kept on ducking the issue just to score browny points over others," said an official, wishing anonymity. 

"And most important of all reasons was that those responsible for collecting property tax themselves advised the people how they could evade it after they were bribed," said the official.

MCD officials said even after the introduction of unit area method in 2004, the number of taxpayers has been apparently static. "One reason is that we have not been able to nail the defaulters, but after the introduction of this method those who were paying the tax got more scientific and accurate calculation. So, those whose tax was being calculated wrongly have got it right now," he said.

More tax

Property tax rates in the capital are all set to rise from April 2010. After rejecting the proposal for introducing professional tax, Municipal Corporation of Delhi's (MCD) Standing Committee cleared the proposal to hike property tax.

However, for residential properties, rather than the 5 per cent increase for categories A to H, as proposed by the MCD commissioner earlier, MCD's Standing Committee has proposed a hike of 2 per cent for categories A and B, 3 per cent in categories C and D. The maximum increase in property tax rate has been proposed for category E where the tax rate will increase from 6 per cent to 12 per cent. While in category F and H, the increase will be 1 per cent.

This all sound nothing but mockery of system.
REVENUE LOSS is for MCD/Exchequer not to Political boses their chamchas and corrupt staffs.
STOP SALARY OF THE STAFFS WHO DIRECTLY INVOLVED IN REVENUE COLLECTION. PAY THEM SALARY + INCREMENT/PROPORTION TO COLLECTION OF REVENUE. The graph will go up automatically.
 
Short of staffs? Look at the self disclosure page of Municipal Secretary Office in Town Hall. Any short of staff ?
Every year lakhs of building are build and lakhs of properties are exchanged or registerd/mutation etc. The MCD gives NOC/or approves building plan without collecting property tax ?
I doubt, a good number of may be goes below the records and revenue vanishes ?
 
It just need 1 Week to asses 10% of the property can be easly be surveyed by all MCD field staff if RIGHT INTENTION are there.
Yes, the data from BSES/BRPL/MTNL and Telecom companies and put all into one to compare who paid and who not paid.
Those not paid just send an SMS REMINDER.. if not 100% at least we can achieve revneue by 40%.
FEAR OF LAW is not there (y.day was our REPUBLIC DAY).. who will bring that in order.
 
There are many HOLE in revenue pocket of MCD. Some are from non-license,coversion charges,advertisement,parking charges, are name few.

Note: Recently we sought information on total collection of Property tax from Dwarka Sub-City and MCD spend in Dwarka. The reply from Asst. Collector(Tax) and Asst Commissioner denied information that no records maintained. Matter is now with CIC.

New Delhi, Jan 28 (IANS) The Municipal Corporation of Delhi (MCD) Thursday said that it would begin inspecting farmhouses under its purview from Feb 1.
“The property tax department of the MCD will carry out inspections of all the farmhouses from Feb 1,” MCD spokesperson Deep Mathur said.

The owners and residents of the farmhouses as well as their relatives or employees must cooperate and make available the information and documents required by the inspecting team, he said, warning those who do not cooperate will be prosecuted under the Delhi Municipal Corporation Act, 1957.

Absolutely right Reji. These scoundrels work hard at devising new scams each day. Hiring consultants will generate more lining for the pocket. Property tax department is one where staff are hardly to be seen. Your suggestion about salary plus increment related to collection is very dangerous as this will result in harrassment of consumers. Instead there should be a system of penalties to discourage non-performance. Not every return need be examined thoroughly. It is not beyond man to devise a simple system of checks and balances and thorough checking by exception. 
 
Most departments of MCD are over-manned. What MCD needs is a more accountability and transparency and a re hash of their systems and procedutres to make them efficient.

Delhi HC directs MCD to remove encroachments in Delhi without serving prior notice

Coming down heavily on the encroachers who grab public land by erecting structures in front of their houses, the Delhi High Court allowed the MCD to remove all such constructions on public land without serving prior notice to them.

Justice S N Dhingra made it clear that the Municipal Corporation of Delhi has a right to remove encroachments from the public land without giving them any notice.

‘No notice is required where roads, public land and public ways are encroached upon, such encroachment should be removed forthwith,’ Justice Dhingra said.

A group of people from Vishnu Garden (West Delhi) have filed a contempt petition against the MCD alleging that it was not obeying the Court’s order given earlier to widen the road.

The MCD told the court that since the people who had encroached on the public land were not willing to vacate it so the MCD have removed it.

The MCD submitted photographs showing that the road has been restored to its original condition and a motorway had been created.

The Court overruled the plea of the encroachers, who said that they have the requisite proof to show that they have been residing there from a long time.

The court said unless the occupants have a title deed of the land, it cannot be believed that the land belonged to them.

Without having any title over the land, no person can be considered to be the owner of the public ways, the Court said.

The Court directed the MCD to remove all constructions on the public land and file its action taken report (ATR) by April 14.

The court had earlier ordered the MCD to widen the roads in that area after protests from the residents and shopkeepers, but the MCD had failed to take any action.

I always admire his orders.. may be ashok-ji have some more indepth to give and experience of his verdicts.
 
 
Well this is good order in terms, I would suggest give it all heads of agencies DDA/PWD/NDMC and act immediately to remove everything from public area in respect to existing matter of order.
