Reg: Complaint about violation of dust control norms.

 

Delhites are dying and passing through acute suffering due to ever rising pollution. Despite a serious concern at top level there are ample instances at ground level indicating total lack of seriousness. In Delhi at numerous places we see roads not swept for weeks all together leading to the collection of heavy dust at road side. Like-wise digging as a menace continues despite strict direction from NGT to follow the procedure for controlling dust emitting from the site. However, in total defiance BSES continues to dig many places in Dwarka and not following any guidelines, neither DDA which is the land owning agency is bothered at all.  The digging also continues at several places even today.

 

It is understood that every site which violates dust control norms is liable for a fine of Rs.50,000/- on daily basis. So we produce 3 photos from actual site where digging has taken place and now for several months the road is not restored leading to a dust blow with passage of every vehicle. We request you to impose penalty of Rs.50000/- for each site per day on BSES and also on DDA which has failed in fulfilling its duty to enforce the law.

(iii) Opposite Bal Bhawan International School sector 12 Dwarka.

 

Should you avoid levying penalty please let us know the reasons.

Dear Sir,

 

Reg: Complaint about violation of dust control norms.

 

For unknown reasons DDA has dug up road in sector 11 Dwarka and left it as it is or past 3 months. This has increased dust pollution on this stretch. It is surprising as to why DDA dug up road here. No project is going on, there were some potholes but instead of repairing those DDA dug up road and now plans to recarpet it at a whopping cost of Rs.52 lakhs. This is really an innovative way to generate work. The job which could have been easily done perhaps in 1-2 lakhs will now be done at a cost of Rs.52 lakhs. However, DDA officers are not bothered about increased dust level. They are hell bound to violate all possible dust control norms set by NGT. They belong to species which is not part of this society and are busy in their own interest area. Delhites are dying and falling ill due to high level of dust pollution but DDA officers are resting in their office. Delhi is passing through pollution emergency but DDA officers are enjoying life at the cost of heavy social cost.

 

Request you to level penalty @ Rs.50,000/ per day for gross violation of dust control norms. For a period of 3 months, this works to Rs.45 lakhs and continue.

 

In case you don’t plan to levy it please let us know the reasons.

Please inform following under RTI:

 

(i)           If a municipality fails to sweep the road and there are heavy layers of dust accumulated on roadside. Is there any provision under which DPCC can challan the respective municilpality.

(ii)          Digging is a favourite activity of some of the departments. While carrying out digging no dust control norms of any kind are followed and dust continues to blow for several months before the dug up road is restored in original condition. Please inform what are the penal provisions applicable to book the culprits those are responsible for increasing dust level in the environment.

(iii)         How DPCC discharges is duty to catch hold of culprits those don’t follow dust control norms during construction process. In Dwarka at so many places digging is going on but we have never seen any action by DPCC. Are there any kind of dedicated teams constituted by DPCC to identify sites by surprise inspection where digging is happening without any kind of dust control measures. If yeas please provide full details about such teams.

(iv)         Is there any dedicated email where complaints about violation of dust control norms can be filed with DPCC.

(v)           We have sent 2 complaints about violation of dust control norms wide reference number No. SKG/CPCB/012 dated 28 Nov 2017 and No. SKG/CPCB/011 dated 25 Nov 2017 from email address cwa...@gmail.com to chd...@nic.in msd...@nic.in. Please inform the latest status of these complaints.

RTI can only provide information that's not remedy. It is in utter violation of pollution (dust) for which NGT has also issued orders to stop construction whereby dust particles will float in the air. Bust as Goyal Sir has suggested DDA has their own convenience and violate law.
