Hi Members,

I need suggestions from you all regarding the newly formed RWA at LIG Flats Sector 23B Dwarka:

LIG flats of Sector 23 B Dwarka were allotted last year to the winners of the draw result. It has one clause that these flats can be sold only after 5 years of the allotment. Also DDA took 1.5 Lacs from each allottee as the maintenance charge of the society for the next five years, and for that DDA has given contract to third party to keep maintenance of the pocket including deployment of guards at the gate.

Around three four days before i got a message from a member of the society  that some people have formed the RWA and are asking for one time membership fees of Rs 500 and Rs 200 as monthly maintenance charge.

This society has been formed by a group and 8 - 10 people without conducting any elections.

So i have few questions:

  1.  Is this a legal process and ethical way to form RWA without elections.
  2. When DDA has taken Rs 1500000 as maintenance fee for five years , why they are forcing people to pay Rs 500 and Rs 200.
  3. Whose all permission do we need to form RWA.
  4. To check the legality of the RWA , from where i can get info about this RWA.

As there are 2360 flats in the pocket, if we calculate, then This RWA will collect Rs1180000 as membership fee and Rs472000 per month as maintenance charge which is a huge amount, this is despite the fact that DDA has taken Rs 35.40 crores from the members of the society as advance maintenance charge. if we take interest at 8% per annum, then DDA is getting Rs 23.6 lacs per month interest on that amount forget about principal. and i think half of the interest amount is sufficient enough for maintenance.


So Some how i am smelling some corruption erupting out of this. DDA has already taken so much amount from us and this so formed RWA is also eying on around 5 lac collection per month and society condition is becoming horrible day by day.


So from experienced persons i would request please do suggest what can be done against this loot (what i feel).


My question is if RWA is taking care of maintenance then DDA should refund us Rs 150000 and if DDA is doing maintenance then RWA should not take money.


Please comment.

Mr Rajesh,
First RWA has be set up without election as it has to be registered with Registrar. Subsequently,it has to be confirmed in general body as per terms of memorandum and article of association.
You can check its validity from the office of Registrar of Society.
Maintenance charge taken by DDA is not for security and other arrangement it is taken for any fault in construction or coloring at large scale in common area.

PL go through DDA HOUSING SCHEME btoucher 2014 which mentions how housing pkts to be maintained and who is responsible for such day to day maintenance. few months back DDA put more information on this matter on its web site regarding on time mainrenance charges. pl go through information provided.
secondly is it mandotory to form an assosiation of apartment owners who will look after long term interets of all . it is in the interest of appartment owners to get register such AOA WITH DDA which would than transfer one time maintenance charges in an escrew account jointly held by DDA and AOA. All maintenance works then will be carried out of interest earned .
