Notice from MCD for Property tax in respect of common areas such as guard room, society office

Here is the copy of the notice received.

We are asked to appear on 10 October 2011 at 3.00 p.m. at MCD Najafgarh
Zone, Kakraula Housing Complex.
If all the societies who have received similar notices can inform the date
and time, it would be useful.

I am not a technical man but being a legal person, I feel that in a cooperative soceity the in the area of the flats defined super area, which includes commona areas.  I feel that in the sanctioned plans includes  common areas.  A flat owner when give house tax which is callculated  as per the super area of his/her flat which includes common areas, Hence in soceities property tax is being paid for all the covered area.  In this respect we may may use a formula wherein we must total the entire area of flats in a society and then compare it with the Coverned area mentioned in the sanctioned plans.  This will clear the situation.  This is a debatable queston.  Moreover I feel that instead of towing the dictates of MCD Every society must challange such orders in the Court of law. Our society was called on 12 SEP with a notice mentioning

NO RETURNS FIELD IN R/O COMMON AREA SUCH AS GUARD ROOM
SOCIETY OFFICE , GENERATOR ROOM , COMMUNITY HALL, COVERED
PARKING SPACE , VACANT LAND ETC.

giving the opportunity to produce the relevant documents in support of

why the assessment should not be made /revised/re-opened.

Societies may also be liable for interest or penalty in addition to tax, as

per provision of DMC Act.

We are asked to give the following information/documents

1. When was land allotted

2. When construction started/completed

3. Drawings from Architect

4. when were flats allotted

5. DDA allotment letter

6. Vacant land tax exemption letter

7. Drawings Guard room, Community hall, Generator room etc.

should always be kept out from the preview of property tax. 

However, a meeting of office bearers of the societies may be called to take a united stand

and to represent our case with the concerned authorities.

Thank you very much for your efforts. I wonder is there any other society
in the whole of Delhi where they have asked for this type of tax!!!
Because there are several group housing societies in Mayur Vihar,
Patparganj etc. and I have never heard of MCD collecting taxes from them.

Pay Rs. 1 lakh more this Diwali, MCD tells flat owners

 

In the festive season, the Municipal Corporation of Delhi (MCD) has dealt out a real dampener for Delhiites.

It wants as much as a crore from each group housing society in the city -which averages out to about a lakh for every home in these 500-odd societies. Even guard rooms, clubhouses, community centres and swimming pools inside the society will be taxed.

The group housing societies have been served property tax arrear notices by the MCD.

The civic agency collects property tax from house owners every year.

The MCD says that property tax has to be paid from the time the land for flats was allotted. Which means that if a society took four years to allot flats, even that period will be taxed.

“Each society collectively owes us between R1 crore and 1.25 crore. Even societies caught in legal battles will not be spared,“ said SA Khan, assessor and collector, MCD.

The money has to be paid by the next month.

The cash strapped MCD is hoping to earn R400 crore through this exercise.

The societies that have been served such notices claim they are being targeted.

“This is nothing but harassment. If tax had not been paid by us why didn't they serve us notices earlier? One lakh is a huge amount to be paid by each owner. MCD has done no work in Dwarka, our roads are lying in a state of disrepair. Why should we pay them tax?“ said Anil Rajput, a member of Dwarka's Gold Craft housing society in Sector 11.

“The MCD has not updated its record and flat owners who have already paid this amount are also being harassed,“ said SR Sangar, general secretary of IP Extension Part II.

are doing our self , Water , Roads, Street lights,

We are not united and dont take concerted actions.

 

Anyway once again spoken to Mr. Gehlot to know the status, he told us that the matter was discussed but due to some documents & date a decision could not arrive. This will be done after Dushera.

 

So in case all the CGHS who are facing the latest notice(which we already taken up with higher up in MCD along with notice received socities). We have asked for Rollback on imposing tax on COMMUNITY Utitility structures. 

 

As mentioned in Rajeev email.. Kindly check with Mr. Rama of Chitrakoot CGHS for details who have worked on this matter & which was earlier also shared.

Those societies where land is allotted and flat not allotted stil have to pay LAND TAX, I think there is no exemption in that.

The MCD is by BJP and for BJP

 

None this belong to PEOPLE.

 

Regarding in return what.. Dont you know ?? They paid Rs. 33 Crore fro Dwarka Garbage..

 

The question is how many MCD employees pay thier house tax or MCD itself how much paid for the Dhalo, Urinal and new Building at Minto Road?

 

They got an EASY target.. Law abiding CGHS and Dwarkites.. who have money as an assumption.

 

Every Govt babu think a person living in Dwarka is CRORE PATI as even small flat price is so high.. So they think they can afford.

They dont realise those residing here are not SELLERs or INVESTORS One Item is not for SALE how can you fix it rate ?

 

Anyway.. Keep UNITE people of Dwarka...  take up..

 

Mr. Jain, DF alaready taken up with all authorities, Property Tax Committe of MCD, Commissioner, Delhi Govt.

Most importatnly one of our Councillor Mr. Rajesh Gehlot, out of 5 have PRO ACTIVELY come forward and assured us that he will deal with it. It is matter for the councillors to deal with it. not by MLA or MP. So get back to your coucillors. Those need to meet Mr. Gehlot can be easly met at Ramleela Ground he is there always, as I found some other CGHS Members also met in group with him other day..

While discussing this issue with the people the information

I collected is that it is notified by the LG and if we go to

the court with a WRIT PETITION we are suppose to wait

and any ruling given by the court will be binding on both

the parties , it has to be with a political pressure and passed

by the assembly to get it condone . MCD will come out with

some other scheme to collect money from the law abiding citizens.

“I have a meeting with the Chairman, Standing Committee MCD, Mr. Yogender Chandolia for waiving off the proposed tax to be levied on common areas in the society.  I need a letter on your society letter head.  Please forward yr email address so that I can forward a draft copy of the letter. At least 100 letters required.
