Beware of Traffic police - an incidence with me.

This is an incidence happened with me while driving home via Dwarka. It left me so shocked that I dont feel that I can count on delhi police in any way.

On 7-Aug-12, at 10:30 PM, I was traveling in my car from my office at gurgaon to my home at Janak Puri along with a friend. I stopped by car at red light of Ganpati Chowk, sector-7, Dwarka and waited for it to turn green. There were already 4-5 cars ahead of me waiting for red light to turn green. When the light turn green I start moving along with other cars. It was still 15 secs to go when I crossed the green light. 50 meters ahead there is a left cut of approach road to Ganpati Apartment. I stopped my car after this cut to drop my friend. I see him off for 1 min and then I started moving ahead when HC Ramkishan appeared from somewhere from bushes waving hand to stop another car. This car does not stop on his directions. He was in my way so I stopped my car. Now when he turn over to me he asked me to produce my driving license which I promptly did. I asked him whats the matter, why I'm stopped?

I was shocked when he said that I'll be challaned for jumping red light. I explained him that I had crossed the light a long time back when it turned green and just dropped my friend. But he did not listen to me and said that every one who are caught lies about it.

I asked him did you actually saw me jumping the red light then his reply was not satisfactory. He started issuing me challan when I asked his name and told him that I'll complaint against him as I'm innocent. He got agitated due to this and started yelling "Jo ukhadna hai ukhad liyo, main to katunga tera challan, tu jyada wakeel mat ban"

He confiscated my driving license and issued me challan only based on his assumptions which is completely unlawful and unjustified. Now I have to recollect my DL from Mr Santosh Kumar Singh, Metropolitan Magistrate, Court No. 15, Dwarka courts, New Delhi.

I have complaint about this traffic police man to splcp-tr...@nic.in,
jtcp...@nic.in and cp.neer...@nic.in by email. No response from them so far.

The reason for my writing in this forum is to make you aware that to be very careful about all the check-points in Dwarka because police is unreliable which can easily go against you since many of them are not nearly civilized.

Don't get pissed off so soon.. Abhi court bhi jaana hai... Please share your experience about that as well...I always feel traffic police work should be privatized and nobody can issue challan unless u show a proof as quality of police is just pathetic in our "cultured" nation. DP is "best" so imagine what happens to rest.

At end i feel constable is not the root cause, its the people at top and overall babus.. If constable is near redlight, he can't stop as people just don't stop and laws are such cool that anyway who runs away don't get punished hard. Just imagine how frustrated that HC was when he waves and the car beyond you just doesn't stops?. In US, if you run away police will chase u till hell and won't hesitate to shoot you as well moment you appear a danger to public life. So at end, we all are responsible for this shit and no one else.

based on one person behavior shall  not blame the entire police force

Thanks Krishna, for the response.

I'm sure we all agree that we the people are the root cause of most of the issues and we are the most appropriate solution for the same. However, I just don't understand how police department work from my incidence:

1. Ok if people are not stopping even on indication by police then surely people are to blame. But what should we expect from policeman on duty in these cases - wouldn't policeman should not down the no. and produce it to department. Should they use wireless to notify the same to next post. This guy has got even bike and could have easily chased him down. It's usual to see police man chase down running cars using bikes in Dwarka. I have witnessed it lot of time since I commute via Dwarka for a long time.
This police man on duty just didn't do anything. He just let him pass.

2. I don't mind accepting that this guy might be very frustrated. If I would have been in his place I surely have been. But then we are mature and responsible enough to understand who is right and who is wrong. Biggest question I have is why our police looses temper so easily? This is the least expected behavior from police which never is the case. DP has opened a public forum on internet where they take feedback about how was your last interaction with any police man. I posted on it hoping that police man would be carefully given the feedback of improvements. Not sure if it works or not.

I'll surely post my experience of court also. My stand would be not to accept the punishment. I'm planning to refuse the red light jump charges in front of honorable judge. Honestly, I'm a bit scared coz I really dont know what to expect and how courts work in India(first time u see) . But lets see how it goes.

Thanks Rajiv, Indeed very good point. I understand the importance of police for us and still have faith in them. I might seem agitated from my post but honestly my frustration is with this guy only and not the complete department :-)
I'm thankful of DP since they are the best of the cops of India.

We should not blame the entire police force so soon. I have been quite closely associated with Traffic Police for a long time. I would suggest you to meet TI Vijay Pal Tomar in his Office on Second Floor in Dwarka Sector 23 Police Station. It will be on your way to Gurgaon. He will surely do the needful.

Similar instance happened with me on Dwarka Sec 20 Red light about 6 months back, I have taken a right turn on Red light when there was about 10 sec left. I was stopeed by policeman based on the fact that People standing on other side have moved forward so he asumed that Light on my side has turned right.

Policemen could not see light form the point he was standing and it was his assumption, I tried to convince him alot but at last I had to pay the challan.

There was no way I can prove my Innocence in that case so I choose to pay.

Such police ambush is illegal and this has been confirmed by Mumbai Police in reply to an RTI application. This may lead to accidents due to sudden appearance of a constable.

Generally there are bad elements in every sphere of life

Government agencies have more , that is why reforms are asked for .

Will need a senior with some guts to take the system on and we will see major changes.

Look at the Traffic police change in the last few years. At least we see them working.

Thanks Brij, for coming up with your experience.
Surely the way traffic police is working in Dwarka and challaning people without any proof is full of flaws. We need to bring up such incidence in notice of public and department and same was my intention to write in this forum.

I hope you wont mind if I take reference from your post if I meet any police officer about my complaint. It may not prevent such incidents from happening but possibly minimize it.
