Dear All,
I saw the attached write-up on additional FAR, which appeared in Dwarka
City in April 2012.
Is anyone aware of this? I tried searching both in the DDA and LG's web
sites. But could not find anything.
Any information on this would be useful to all of us. Thanks - Jayaraman M

In this connection, my mail of 20th April is reprodduced below:
"We very often come across the subject matter of utilisation of additional FAR and construction of additional rooms, coverage of balcony, etc. in Societies & in DDA pockets. A number of RWAs have already submitted proposal to DDA.
But in the meeting of Sr. officers of DDA held on 14-2-2012 at Raj Niwas, it was decided "not to grant approval for addition to existing structures as these could compromise their structural safety."
To get this decision reversed, RWAs may have to take up the matter collectively, preferably through Associations / Forums.

DDA Builder lobby will BLOCK such measure and increase of FAR.
However nor the LG nor God stops thos illegal construction happening across.
At least in those CGHS the management take Architect and other remedial steps to get this permission , I hope so? Also payment officialy to DDA for increase and Property Tax.
While in the other case ,look those Commercial LSC/MLU, Ramphalchowk etc..
I am sure most of the CGHS will accept this order and it will be binding. Then some one will do and have to grease the palms of the DDA Engineers at building then it will be back....
At the same time it is must all CGHS management take all memebrs due permission and not create what mentioned as some memebrs may have filed such increase of FAR.

On 1st Feb, few residents of Dwarka (who may be satisfied & contended
with their present flat area or may not be in a position to afford
extra cost for the enhanced FAR) gave a memorandum to Hon'ble LG with
a subject "Effects of Increased FAR in existing societies" and without
sensing the hidden agenda of those residents, Hon'ble LG has issued
this Tuglaki Farman. Before this order, LG office should & must
understand that MPD-2021 has made this provisions of enhanced FAR. MPD
is a law which is passed by the Hon'ble Parliament which is the
Supreme Power of our country, nobody is above the Law not even Hon'ble
LG or DDA who has issued this controversial office order. A memorandum
of few residents that too only of Dwarka can not be treated as a voice
of each & every resident of every society of whole of Delhi. Few
Dwarka residents has stalled the extra room availabilty in all the
societies spreaded over whole of Delhi. In comparison to new flats,
these extra rooms were available at a very nominal costs.
In every household, with the passage of time, children are growing,
some have got married, requirements are increasing, everybody needs
accomodation and for parents it is very difficult to acquire bigger
accomodations on these sky-rocketing prices. This was the very easy
way to keep the family united which has been taken away from us
mercilessly.
We should come forward and fight for our rightful right till this
controversial order be reversed.

In the subject matter does any one of you any idea on this DOGRA Committe Report and Its Implimention.
Have this been accepted and put on implimentation.

As far as I know, Dogra Committee committee was constituted by Urban Ministry to study both DDA flats and CGHS. The committee after detailed study, submitted their report in which they recommended legalising certain alterations/ modifications for both DDA and CGHS. DDA adopted the recommendations and adopted a policy in the year 2008 which clearly stated that "these are applicable to all flats built and allotted by DDA"". DDA didn't include CGHS flats while announcing this policy.
Dogra Committee recommendations are not applicable to CGHS societies.

Dear Reji & Respected Members
Plz don't mix up two issues. Dogra Committee issue is different. These
committees was formed before MPD 2021 and on the behest of Hon'ble
Supreme Court. Dogra committee's TOR was to look into ground realities
and illegal construction in DDA and CGHS flats. They had submitted
their report in 2007 before the issuance of new MPD. Once the new MPD
2021 was issued, Dogra Committee turned irrelavent. I too submitted my
suggestions/objections in that committee and had also attended the
public hearing and expressed my views in person.
Here we are blogging for our right of enhanced FAR which has been
provided to us in new MPD 2021. This issue is not related to illegal
construction. The society who wants to avail the enhanced FAR, has to
submit its new & amended lay-out plans to DDA and after the clearence
of new maps, the concerned society will be allowed to start the extra
rooms/balconies construction. So where is the question of illegelity
rises. This is my humble request to all the members, plz dont cocktail
the different issues, it will certainly complicate the issue and our
cause. In my earlier mail dt. 05/05/2012, I have informed the members
that I have both the papers, LG office minutes as well as DDA office
order. In that minutes/orders, they had banned the availability of
enhanced FAR with retrospective date means in April 2012 they said ban
has to be implemened from March 2012. More over the ground of banning
the issue (structural safety) which they have mentioned, is totally
wrong. This may be right in the case where socities want to built two
extra floors means want to convert their 8 storey building to 10
storey, but those who want to erect new adjoining structure, should be
allowed. In fact in these type of cases, new adjoining structures will
provide extra & enhanced structure safety. LG/DDA has to understand
and able to differentiate between both the issues.
I am in touch with the issue. Few societies again approached LG office
and pleaded that this ban has been enforced at the behest of only
Dwarka residents whereas this ban will effect whole of NCT of Delhi.
LG office once again issued a fresh instructions to DDA to put an ad
in local newspapers, informing about this ban to all the CGHSs of
whole Delhi. In my opinion, in this ad they can't say from
retrospective date, they have to give a future cut-off date because
this matter pretains to amendments in MPD 2021 which has been passed
by Parliament. Any office/official whether LG/DDA can't do this
without adopting the due process of inviting suggestions/objections to
file within 90 days.
I am also of the opinion that all the societies who wants to avail
this facility of enhanced FAR, have to unite and form a group, may be
under DWARKA FOURUM and/or FEDERATION to presue the matter with
LG/DDA. Availment of enhanced FAR is our need not greed. For example,
if anyone who wants to upgrade his accomodation due to family
requirements/extentions, has to spend arround 75-80 lacs, for example
if a 3 bhk owner (priced at about 1.5 cr) wants to shift to a 4 bhk
flat which is available at an average priced of 2.25-2.5 cr means he
has to cough up huge amount, apart from price difference one has to
spend 10-15 lacs on renovations/alterations/amendments/shiftings
whereas in present flat, one will get the extra 1 bhk simply spending
3-5 lacs. Similar is the case for upgradation from 2 bhk to 3 bhk.
Option is ours, what we want. We are not going to obtain it illegaly,
this is our right provided by MPD 2021 which we are asking for.

I have not personally approached but i live in DDA flat and some time ago there was permission to build one room on the top floor terrace and many people got that built, but when i approached through an application to the Architect i was told the decision has been taken not to allow such constructions on the grounds of structural stability etc.
It is strange how this reasoning became the basis after so many such rooms were already built. What new engineering in last one year has revealed that addition of a room on top floor would destabilize the structure, if that is indeed the rationale then should those already built rooms be not razed down in the interest of safety of that building?
Actually it seems whosoever can flout the rule is thriving and no one dares to take action against such encroachment that come cropping up every other week in all DDA flats including ours. Perhaps the corruption can never go out of our blood!

Attatching a judgment of Delhi High Court on Dogra Committee. The Court expressed its inability to direct DDA to adopt Dogra Committee. I wonder what will happen to the societies where MC's have gone ahead with constructing an extra room simply after submitting the plans i.e. without waiting for formal sanction from DDA.

As I hv blogged earlier, please dont mix up different issues. Dogra committee report and room in DDA flats are something different and dont relate to this issue. Our issue is EXTRA FAR LEGALLY AVAILABLE TO US AS PER MASTER PLAN OF DELHI-2021. Please dont copy-paste everything everywhere.

Management Committees of those societies who are interested in extra rooms by availing extra FAR, are requested to contact me so that a pressure group can be formed under the umbrella of DF.
