(b)   Particulars of information required: Background: Attending a court is considered extremely troublesome in India due to uncertainties involved in the schedule. Considering time being the most valuable elements of one’s life the greatest uncertainty is being about time only - when you will be heard. It is understood that one should go court ready to keep his pulse high for whole day & sacrifice whole day. In this background please inform in respect of Delhi High Court & all sub-ordinate courts:

 

                    i.  What the standard timings of court for hearing are? Is it different for lower court, district court & high court?

                  ii.  Is it necessary for summon issued by any court to mention time at which one has to attend the court?

                 iii.  In case summon does not state any specific time of the day when the person should appear before court?

                 iv.  In case summon state timings beyond normal working hours – is it binding on the person to appear at that hour?

                  v.  Whether there are different time slots in a day where people are called for hearing or all persons are supposed to come right in the morning only?

                 vi.  If at designated time court is not sitting or is engaged in hearing other cases – how long one has to wait for his turn?

Sanjeev ji, in the cause list, case number is mentioned and from that, we can have a cue about the timing of the hearing.  As per my experience, it is generally from 10.30 a.m.to 1.30 p.m.  Cases in which arguments are expected to take more time and unheard cases till lunch are heard after the lunch hours i.e. after 2.00 p.m. - 2.30 p.m. 

Central Information Commission gives time slots for the hearing but there, hearing are generally for maximum 15 minutes in most of the cases.  I have noted that Mr. Acharyavelu and Yashovardhan Azad try to complete hearing within the shortest possible time.

Gupta Ji,

Before writing this RTI I visited sites of DHC & several sub ordinate courts none of them had mentioned timings in the cause list. So it means you keep whole day with you. The point is why courts have no regard for time of public, this also crowds courts unnecessarily. There is no point in calling every one at 10 am.

Surprisingly, High Court Transferred (?) the application to Tis Hazari, and now PIO says this does not fall in the definition of information?

What does it mean? Lakhs of people are daily attending court but there is no information about timings?

If we insist they may turned it as Contempt.Style of functioning in a court is of course what it was in dependent India.Lots need to be done.

Do you mean that if we file appeal they may term it as contempt? Not understood please elaborate.

Who knows.This has happened in the past also.Tell me how High Court can transferred it to Tis Hazari when it is directly related to High Court.
As I told you Court has its own way.It is a fact that court in India has delivered the goods but it also requires be more transparent and user friendly.
