It is HIGHLY IRRESPONSIBLE and evident of DENY Information sought on para 7 to 10

The Engineers spend PUBLIC FUND and if the Public seek info under due law of the land. How can they deny in the pretext the PIO have to do SERACH or RESARCH retrive info from files and share to appellant ?

What kind of transparency is this?

I think PWD Director works and EnC must seek explnation from this PIO M-124.

The data info sought is para mount interest of Public fund and also Public road safety.

Please ask FAA to direct to provide info.

Also file seperate complaint under Manual of Office Procedure and CCS (Conduct) Role against the official and suspicious nexus may be reason for denial of info thereby warrant VIGILANCE enquiry.

DDA says all contractors are OK. (the recent carpeting on Dwarka flyover did not stay even for one month).

After reading the reply from MCD. My comments/view as follows.

 

1. Absolute RUBISH this reply. We must ask the EnC of MCD Shri. Ravi Das, to REDUCE by 50% the salary of those who in MCD not impliment this UTTIPEC Policy.
2. The para 3 of the Reply by EE(P-I) Vogue - The info sought is QUESTION for which certianly an ANSWER/INFORMAITON available on RECORD. Take example this particular EE(P-I) "WHAT IS YOUR NAME" Is it query does it qualify to return with information ? I hope they know very well what is the answer FACTUAL Information to that query. But as it said in Move 3 IDIOTS few Engineers like this EE behavior is EVIDENT to supress FACTUAL INFORMATION- This need to be filed u/s 18 of RTI Act 2005 as complaint please.
3. The UTTIPEC Guidelines was duly passed by the UTTIPEC Advisory board which include EnC of MCD and other senior officials including Commissioner take part. After notification by none other than LG, these were provide to all Engineering departments workign in Delhi whether it is MCD /PWD/ DDA or any one else.
4. Ask him (EE) did he received various circular on Promotion/6th pay commission/DA and other benefits ? He will say yes and he will provide you copy . Because he know that it is public interest but not his interest.
5. Same is with PARA 4 & 5 . I think this EE should be PUNISHED SEVERELY for which specialy emphaisis must be given. As the ifnormatin sought is PARAMOUT Public INTEREST and PUBLIC SAFETY. How can he say who is the Grievance or Complaint authority as mere query? All emphasis must be put to get the name of the EE(P-I) then we will have to deal with him LEGALLY as it is not worth such people are allowed to kept in matter of Transparency Act. The reply  be treated as INSULT TO PARLIAMENT which passed the RTIA 2005.

Information from FOD1.

 

 

1.    Please inform the reason for not painting the newly made speed breakers on Dwarka flyover immediately after construction?

Reply:The speed breaker on the Dwarka flyover are painted as on date.

 

2.    What is your e mail ID? Does it get checked regularly,

Reply: The email ID is pmfly...@yahoo.com. This is a routine official work.

Rejoinder: There is another e mail ID pmfl...@dda.org.in  - who deals with it?

3.    There is pothole in Palam under pass for past one month. Please inform

a)    Whether the surface is under warranty?

b)   Whether agency has been intimated to repair the same?

c)    If yes, on what date?

Reply: No potholes exists on Palm underopass as on date as confirmed by the concerned EE. In view of above reply to paras are not required.

Rejoinder: Please see the attached photograph. How this still remains undetedted by DDA? There appears to be a regular problem with DDA small potholes are not repaired until they grow big. (??)

4.    Refer point 1c of your letter no. PM2(FO)F1(28)2011/RTI/SKG/DDA/984 dated 27 Oct 11. Please inform: Whether for each cleaning separate contract is awarded or the contract is awarded for some duration say six months or so?

Reply: The contract for cleaning are awarded for some duration say six months or one year.

5.    The flyover/underpass does not get sweeped for months together, which gives a doubt about the working efficiency of contractor as well as supervising officer. In this regard please inform the frequency of sweeping on the roads under your jurisdiction?

Reply: Due to administrative……….contracts received in 15 11 2011 and are under the process of award

6.    Refer point 1d II of your letter no. PM2(FO)F1(28)2011/RTI/SKG/DDA/984 dated 27 Oct 11. The work under reference is lying damaged for past 3 months. Please inform the date on which the agency has been asked to repair the stretch and what is the SLA for such jobs?

Reply: The agency was asked to repair the damaged road vide EE’s letter dated 19 Sep 11. In case agency fails to carry out the repir job, same will be got carried out at his risk and cost after issuing notice. However, the repir has already been done by the agency in this case.

Rejoinder: First agency has taken too long to repir the stretch. Now there are fresh crackes & gapes in the surface – please ask agency to repair these as well.

Sanjeev, thx 4 tireless follow up.

At the end of 2011 we may need to seek following info from the FO Div of DDA.

 

1. Total Budge Allocated for DDA FO Division-1.
2. Amount Spend from the allocated budget till 31 Dec 2011.
3. Please provide info per KM maintenance cost Allocated and Spend for the stretch On Flyover Dwarka- Palam and Dwarka Link Road.
4. The road sweeping contract existed from date to expirty date for 2010 & 2011 along with name of supervisory official of DDA FO Div-1 before releasing payment to contractor.
5. Please provide the procedure to INSPECT the road and flyover to assess the damage and Last six months inspection report copies.
6. The non maintenance of the area road and flyover under DDA FO Div-1 resulted personal injury and damage to properties to citizen residing in Dwarka. Please provide under which provision of DDA Act or Service Rule or Consumer Act the commuter seek compensation from DDA and respective supervisory officials hirearchy wise in DDA Fly Over Division.
7. Please provide list of Tender Called, Finalised, Work Awarded and Completion Certificate issued for the Dwarka Palam and Dwarka Link Road by DDA FO Div-1 for year 2011.
8. Have DDA FO Div-1 recommended any contractor for Deficiency or non execution of work awarded for black listing.As it is evident the agencies of DDA FO Div-1 failed to provide quality work. The roads whether on Dwarka Link Road or Palam Flyover is Damaged with potholes in many places still. Workmanship and Supervision is PATHETIC.
9. Have DDA FO Div-1 imposed penalty or got work re-executed during the warranty/service warranty/gurantee period for 2010 & 2011. If so please provide details.
10. Have DDA FO Div-1 EE & PM caused any REVENUE Loss to DDA and exchequer for 2011 ? If so pleae provide details after verifying all records.

You may amend/alter the points and language to fit..

 

Prima facie it found for the year 2011 the entire stretch had NEGLIGENCE only to highlight. Thankfully they restored the speed breaker with Dwarkites raisiing through Gandhigiri and other methods.

Unfortunately people are paid to do the job of SUPERVISION are not doing that instead we citizen end up doing that. We are happy to do that & will continue to do. However the kind of response we get from these DDA FO Div-1 Senior Officials is very negative, I must say.

 

I hope the 2012 they would mend their way of functioning.

Please provide me following information:

 

(1) Several crores rupees were spent on renovation of footpaths of Sadar Bazar Road and Maude Road roads. These footpaths are having a line of yellow tiles for helping blind persons to walk on the footpaths. Please inform whether any trial has ever been made to check the suitability of footpaths for such people?

 

(2) The planters were also made along with footpath on Sadar Bazar Road and Maude Road. Full rain season has gone and no plantation has been done on this. Please inform the purpose & motive of spending huge money of these planters by DCB?

 

(3) It is understood that road on which Air Force Museum is located leading to Palam railway crossing is maintained by DCB, please inform:

i) When this road was last carpeted?

ii) Whether the road is under warranty?

iii) What was the thickness of road surface as per bill of quantity?

 

(NOTE this road is having potholes immediate after carpeting) 

 

The requisite fee of Rs.10 is enclosed vide IPO No. pay order no. 92E 273878.

(A) Ref: Your letter No. PM2(FO)F1(28)11/RTI/SKGoyal(9)/DDA/1172 dated 30 Dec 2011.

 

In response tp my querie you have provided information about obstructive boards. The information sought & provided is summarized below for ready reference.

	As per UTTIPEC guidelines sign boards are not allowed to be fixed on footpath and a clear barrier free width of 1.8 metre has to be provided for pedestrian movement. However it has been observed that many sign boards are existing on footpaths under the jurisdiction of FOD 1. Surprisingly most of the boards belong to Govt agencies & politician. In this back ground regard please inform me:
a)	Is there any exemption to Govt agencies/politician to fix the boards without any prior approval from DDA,	No, there is no exemption to Govt agencies or politician to fix the boards without any prior approval.
b)	Reasons & facts for non-removal of same by the concerned supervising officer,	No such representation has been received against any board fixed by other Deptt./Politician in this office.
c)	Reasons & facts for not taking any legal action against the agencies/politicians which have fixed such boards,	In view of reply above in para 2 no action has been taken
d)	Who may be held responsible for violating the norms fixed by UTTIPEC.	UTTIPEC norms are required to be implemented by the Deptt under which the area fall

 

I personally feel that in view of your acceptance to facts at a) & d) above the statement at b) & c) only shows signs of gross carelessness & irreposnsible attitude. Perhaps your department is waiting for some one to file a complaint, without which you would not take any action (??). I myself have given multiple references about such obstruction but instead of taking action your department is always hiding behind excsuses.

 

Please treat this letter as a specific complaint about obstructive boards fixed on footpaths on roads maintained by FOD-1 including those fixed by DDA. Please also inform the date by which all such oards would be removed and legal action initiated.

 

(B) Reference your letter No. PM2(FO)F1(28)11/RTI/SKGoyal(8)/DDA/1156 dated 27 Dec 2011, concerning reoval of malba from site. This is to inform you that information provided by you is false, even as on date the malba of speed breaker is there on the site. Refer attached photograph. Further, the malba of mastic repair work done (after crossing underpass where cooker was functional) almost 6 months ago has been removed only after my RTI application, the photograph of which is attached as had been mailed to you a few days ago.
