APPEAL UNDER SECTION 19 (1) OF THE RIGHT TO INFORMATION ACT, 2005 AGAINST THE INFORMATION NOT FURNISHED   BY THE PUBLIC AUTHORITY IN RESPECT OF THE APPLICATATION UNDER RTI ACT VIDE I.D. NO-  nil   DATED 16/11/07. 

 

MOST RESPECTFULLY SHOWETH:

 

1.         That the appellant had moved an application under section 6 (1) of the Right to Information Act, 2005 vide I.D. No. nil  dated 16.11.07 seeking the information as enumerated in the said application. The copy of the said application vide I.D. No- nil is annexed below:  .

 

2.         That the requisite fee of Rs. 10/- was duly deposited  along with with application throug postal order No.  59E 079136 dated 16-11-07.against the said application under RTI Act, 2005 vide I.D. No- Nil.

 

3.         That the Respondent No-2 has  denied the information sought against the Questions. It is submitted that the information sought in the said question neither falls within the ambit of Section-8 nor Section -9 of the RTI Act and hence the appellant is entitled to have access to the information sought. Thus, the denial of the said information by the Respondent No-2 is illegal  for which Respondent are liable.

GROUNDS OF APPEAL

 

A.        Because the Respondent No-2 has wilfully denied access to the legitimately sought information under the provisions of RTI Act.

 

P R A Y E R

 

In view of the above the following is humbly prayed:

 

(i)                Direction may kindly be issued to the Respondents to provide the correct, sufficient and clear information as sought for.

(ii)                Any other or further relief which this Hon'ble Authority may deem fit in the interest of the justice under Right to Information Act, 2005.

Subject:  Application under RTI Act 2005

 

 

 

Dear Sir,

 

Under the right to information Act 2005, Kindly provide the following information:

 

1.                  As per your reply (dated 8/12/06 Ref No. RTI Reply no. 486) in response to my RTI Application No. 4713: You have stated that LSC at Sector 22(32 shops?),Dwarka finalised and will be disposed off through tender by Jan 2007. Kindly let me know the following:

a.      Current status of LCS of Sector 22?

b.      When was the completion of LSC at Sector 22, Dwarka was informed to Commercial department by civil construction department(or concerned department). Please provide copy of the same.

c.      Was there any delay in tendering/auctioning this LSC on part of Commercial Department?

d.      If so reason for the same.

e.      Please provide the dates on which Tenders were published ?

f.        Please provide the number shops? And type (type of activity reserved) of shops designed in this LSC?

g.      Do DDA permits the allottes to change the use of particular shop from what it is been originally allotted?(for example vegetable shop to ATM or Property Dealer office etc)

h.      If so under what rule?

i.        If the same is not allowed, what action will be taken by DDA against the shop allottes in changing the use of shops in LSC/CSC?

j.         Can a shop allotment be cancelled ?

k.      Why not the DDA Commercial department displays a board on all LSC/CSC constructed by DDA to display the type of shops and allotte name along with map?

l.         If the above is not possible, please provide reason for the same

m.    What measures/policy DDA have to control the change of use of shops or alteration without the permission of DDA?

n.      Have DDA marked parking areas in CSC/LSC under its jurisdiction?

2.                  Have DDA Commercial Department received information to allot/auction/tender the Model Plaza Shops at Sector 22, Park near Nav Sansad Vihar ?

a.      If so what is the status of the same?

b.      By when the Tender/Auction/Allotment will take place?

c.      Please provide us the type of business that these Plaza huts will be allowed to use?

d.      What measure will be included in the tender that restrict any misuse and cancellation of shops in the event of damage to environment or parks from such huts allottes? Will such clause will be included in the terms of agreement?

e.      Please provide us tentative date of operation/opening of such huts in the above said area?

3.                  Have all CSC/LSC in Dwarka been constructed under DDA Commercial jurisdiction been allotted? If any CSC/LSC is pending in any sectors of Dwarka , please provide the list of pending CSC/LSC.

4.                  What measure are taken by DDA on Land allotted to Commercial Department not misused   the open areas/pedestrians/roads surrounding such plots?

 

 

 

Please provide the all requested information as above(If possible give all relevant information through DDA Website), once the information is received as per request and as per RTI the inspection of the records/files will be done   in coordination with concerned departments.

If any of the information sought above does not pertain to you, kindly forward it, under intimation to me, to the respective department under section 6(3) of RTI Act 2005.

Whether RTI or letters finally one mother diary (milk)is coming up for
sect dda market.
Any progress in other sectors?
