Madam/Sir,
This is to bring to your notice the update on the RTI (Ref.: F11(2262)09/RTI/DDA/1466) filed by Shri P Menon and follow up mails by myself and Dwarka Forum dated 10th July 2009.
Pls find below the consolidation of replies received from DDA, and there has been no reply with regards to how this temple has been allowed to come up even when the master plan shared with us by DDA clearly shows that land to be vacant(refer the area, marked in red and written - disputed temple)and why no action has been intiated for its removal. All these questions have been left unanswered and the RTI applciation is being pushed from one department to another.
We request you intervention and ensure that such encroachments are removed as there has been regular additions to the structure of the temple and it may soon expand further.
On the same lines another illegal temple is operating in Sec-17 pavement, and soon the entire Dwarka sub-city would be full of such illegal religious structures.
All supporting documents are being attached herewith.
A summary of all the replies received from your departments are summarised below. So far, only Dwarka Planning Office and DDA LM (WZ) have replied.

Please provide following information under Right to information Act 2005:
Please provide the following information with respect to an illegal construction of a temple in Sec-12, Dwarka. (Dwarkadeesh Temple)
1. Whether DDA (your office) is aware of existence of a temple (Dwarkadeesh Temple) in Sec-12. Reply from DDA, Dwarka Planning Office, Manglapuri dated 31st July 2009: the matter related to plan implementation and enforcement are related to Dwarka Engineering Wing, Land Management Wing, Housing Deptt, etc. Sr. RO (RTI), DDA has already referred the RTI applications to the concerned departments.
Reply from DDA, Lands Management (WZ)dated 20th August 2009: Yes, there exists a temple named Dwarkadeesh Temple near Dwarkadeesh Apartment Sec.12, Dwarka.
2. Please provide the regularization and authorization deed for construction of the temple and details of the trust governing the temple available with DDA.
Reply from DDA, Dwarka Planning Office, Manglapuri: No information is available in Dwarka Planning Office. The matter related to plan implementation and enforcement are related to Dwarka Engineering Wing, Land Management Wing, Housing Deptt, etc. Sr. RO (RTI), DDA has already referred the RTI applications to the concerned departments.

3. Please provide details of the land on which this temple is situated as per the Master Plan for the area and for what purpose is the land earmarked.

4. Please provide an explanation as to why DDA is not taking any action on this illegal construction / encroachement

Reply from DDA, Lands Management (WZ): No such requisition for removal of unauthorized encroachment received from Engg. Wing / EE-WD-13.
5. Why this temple should not be considered illegal and demolished or relocated.

This is in response to the RTI filed by Mr Menon for information pertaining to illegal religious construction at Sec-12.
For your information, there are many more of such religious constructions happening all over Dwarka. One example is temple constructed on a footpath at Sec-17.
Can you pls let the residents of Dwarka know why no action is being taken by DDA against such contructions and why no reply has been submitted against the RTI submitted by Mr Menon.
It is a well known fact that such religious constructions are means to grab public land and the whole of Delhi has many such cases. Dwarka is designated as a no-tolerance zone, then why should such contructions be not demolished / relocated to land earmarked for religious purposes.
I am attaching the copy of the RTI, the postal order, and photos of the temple at Sec - 12 (Dwarkadeesh Temple) and another temple constructed on footpath of Sec - 17 Main Road.
Kindly explain.

Some latest info received this week from DDA, on the Illegal Religious Building Dwarkadesh Temple in Sector 12.
As per this matter is with Religious committe now and CE Dwarka sent to them in December 2011.

the land where Dwarkadeesh Temple is bulit was actually for the use as a Dustbin. The DDA in the past had taken the intiaitive of demloshing the temple but the attempt was unsuccessful becoz there was no temple in the area hence the resident supported the existence of temple. This was somewhere in 2003-05.
