Denial of registration of FIR by Dwarka Sector 23 police station

I am writing to you all for suggestion, support and advise.

My motorcycle no. UP 93M 6386 silver colour TVS Fiero was stolen from
the premises of my residence - 672, Plot no.2, New Millenium
Apartments, Sector 23, Dwarka, New Delhi - 110075 on 6th October 2008.
The theft took place at around 9:00 p.m. and was reported at the local
police station of sector 23, Dwarka at 10:00 p.m. We also had informed
the police by dialing 100.

The police had conducted enquiry at the night through Sub-inspector
(SI) Amar Pal of Dwarka Sector 23 Police Station. The society guards
gave a recorded signed statement in the presence of society members to
the police that they had seen the resident of Apartment No. 251 (as
per our information his name is Ravindra Singh) of the same society
drive away a motorcycle of similar colour around that time.

The accused even visited us at our house to offer money (against the
loss of bike) for support to settle the case on 09th October 2008 at
around 12:30 p.m. This of course we refused as our prime interest and
concern was to get the motorcycle back.

We have been following up with the police station through the duty
officer, Sub-inspector Amar Pal as well as the SHO Tilakraj Mongia,
however no FIR has yet been lodged by the police as yet. Every time we
visit or call we are told that the SI would register the FIR and on
talking to the SI, he says that the SHO would register the FIR. The
SHO has also not given proper attention towards us and have approached
the issue casually. It is difficult to access him since many times he
is not available. I have been harassed in trying to get an FIR lodged
despite more than 7 visits to the police station.

We have also sent a letter to the Commissioner Police, Jt.
Commissioner Police (Southern Range) and Deputy Commissioner of Police
(South West Delhi) informing them about the issue and requesting their
help. Copy of the letter and the post office receipt is attached.
However, no action has taken place till date.

We also registered a grievance with the Delhi public grievance
commission (registration no. PGC/2008/174/382) to no effect.

I am working as senior consultant with Wipro Ltd. having a demanding
work schedule that involves hectic travel.

I am completely harassed in getting FIR regsitered and proper enquiry
conducted.

I am writing on this forum to bring in awareness as well as seek
support for getting proper FIR registration and proper enquiry for
recovery of motorcycle. What appalls me is the fact that while crime
has been increasing in Dwarka, little activity is happening by the
local police. More importantly even senior police officials are not
interested in controlling crime rather they are trying to ensure that
crimes do not get reported. What further upsets me the fact that such
apathy is being shown by police against educated person like me, what
must be happening with poor people. These are the situations that
benefit terrorists.

Hello Mr. Naveen Prakash,

From this episode, the atriguing point is that the "accused even visited us at our house to offer money (against the
loss of bike) for support to settle the case on 09th October 2008 at around 12:30 p.m." and points to some nexus between the accused and the police personnel who have been evading registration of FIR.

The other puzzling factor is that the Delhi public grievance commission has not responded.

These facts must have left you with a feeling of disgust. However, you may take the help of some TV channels, like CNBC Awaaz, and I can assure you that you will surely receive an early and positive response.

God forbid, in these troubled times if the bike is found involved in some crime (say terrorist activity) Mr Naveen would be in great trouble in the absence of a FIR.

if this is how a common citizen is harassed in our country throughout the year, then to whom he should look for justice? if no justice is given to us then whyshould we even have police and other systems. thisis exactly the cracks in our system which allows the extremists to penetrate easily and have fun at the cost of innocent citizens and Braveheart officers who die unnecessarily for this nation.
i am sure soon public memory of the recent events will fade and our own domestic goonda elements will continue to rule on us. This is indeed disgusting!
Media must highlight all small & large incidents like this to expose the failures and incompetence of Govt. rather than highlighting the achievements like flyovers, metro rail etc. etc. which we have become accustomed to seeing daily in papers.rgds/pradeep

Hi all

The problem is not high statistics.. Its might be a good indication
that atleast Dwarkaites get more FIR registered than other sections of
Delhi..

About the accused, it might be a bit early to blame a person... He
might have approached you as he might be honest and proofs were
against him and thus to save self.. But he should first prove the bike
he has taken was his own or someone and produce that bike along with
written statement of owner that he has lended that bike to XYZ during
that time and thus he is innocent. If he can't show anyone he is
culprit and should be punished.. But do take care of his background as
no use of sending some family person to jail even if u know he is
culprit for first crime..He might have some urgent reason etc and one
should be compassionate towards this..

If he is drunkard etc or known bad character, than better get him
behind bars.

Suggestion- pl take the advise/ help of our legal advisor, Mr. Ashok Chaitanya in the
matter of lodging FIR. In the meantime, send a registered letter with A.D. to the SHO and ACP  informing the theft of the bike and request them to write FIR urgently.

Guys,

Thanks for your support. The only way that I think getting an FIR
registered is by forming a pressure group and approaching the senior
officials in the area. Have recently come to know that the DCP has
also started operating out of Dwarka. Let us approach there as a
group.


Frankly, after making a number of visits in the police station of
sector 23, I have lost hope from Mr. Mongia and the local policemen.
My only hope is if we can approach Dwarka court/senior official from
police (DCP/Jt. Commissioner and above although they have not taken
cognizence of the registered letter that I have posted to them) or
through the home ministry under which Delhi police comes.

If someone in the group has contact with senior official, it would be
very helpful indeed. I would be happy to coordinate this effort. I can
be reached at 09810904716 as well as on this mail id.

This is common occurrence in Police St. Dwarka. Some where some thing is amiss.Came across similar grieved party 2 weeks back. They were being made to run around for same.
