Split A/C units on terrace by the top floor residents

I want to ask if it's permissible by DDA rules to install the split A/C units on the terrace of CGHS by the residents of the society?

It is not permissible to install the split AC unit on the terrace as per the DDA rules. If reported formal action can be taken by the MC/DDA. Removal and /or fine can be imposed and the cost of removal can be recovered.

Can someone please clarify, legally, In a CGHS, who has Roof Right, is
it for all members, or only for Top Floor members, please advice.
Like in DDA buidl apartments, DDA has given rights (partial) rights to
top floor owners.

it is quite interesting to learn of this strange rule! is it forbidden to install Split AC at all otherwise where one is expected to dispose off the waste, garbage, drain or even the heat etc if not outside of the building, although it is a separate ecological issue if one must install the Air-conditioners to begin with in the interest of the humanity as they are anyway adding to the global heating up. where is this rule put up by the way!

Keeping aside the rule, I don't understand what is the issue in putting split ac on terrace? How that impact neighbour? I don't have installed that but would like to understand the logic? Is it simply being jealous or not able to use the terrace? I don't think split ac unit takes much space and can be in corner. Also longer copper pipe reduced cooling capacity therefore must be used by resident in top floor only. And DDA gives permission to use terrace by top floor resident in written after paying required fee and also allowed to construct a barsati with urenal. This permission comes with the clause that rest 3 floor resident will be given access to Cary out repair work of their water tank.

Roof in a society is a common area and can be used by any member of the Society. But I fail to understand why there is so much hue and cry over such a petty issue. Whats wrong if a person has used the said common area. I totally agree with Mr. Ranjeet Kr. We also stay at top floor and few of the neibours have installed split ac. We never objected to the same. Its all waste of time and nothing else. No law talks about such petty issues. Also there is  a concept called community living. Live and let live!!  Do not waste Ms. Vergese and carry out some constructive work.

In CGHS, roof right is not with any member and used by association to installed water tank etc.

In DDA, it is allowed to top floor owner by paying adequate fee but only in max 4 story building and certain large area. I have taken the roof right from DDA and also built a barsati after map got approved by DDA only. However it should not impact any structural and water tank. However water tank can be re-located after permission and passage must be given by water tank owner for periodic maintenance.

Practical scenario: getting permission from DDA is not easy. But very easy by other mean....even get in 3 days a else more than 2-3 years is short period. Also once you construct barsati all other member in that building will turn automatic enemy of your...by natural theory - neighbour envoy. Even you take care all care. Be careful they might be disastrous.
