If you have queries about the existing BRT corridor or the bus clusters scheme — two major transport projects of the Delhi Integrated Multi Modal Transit System (DIMTS) — you can get answers under the Right to Information Act now. The Delhi High Court on Friday upheld the Central 
Information Commission (CIC) order that DIMTS is a public authority and it should appoint a public information officer and first appellate authority to provide information on people’s queries.

DIMTS is a joint venture between Delhi government and the Infrastructure Development Finance Company Ltd (IDFC), and works in the field of urban transport and infrastructure development.

In his March 2010 order, information commissioner Shailesh Gandhi on a petition filed by Sachhin Sapra had ruled that DIMTS was a public authority as defined under Section 2(h) of the RTI act and had directed the company to appoint a PIO and First Appellate Authority before March 31, 2012.

Sapra had filed two queries regarding affairs of the DIMTS under the RTI act from the public information officer at the chief minister’s office but was refused. He then knocked the doors of the CIC, questioning on what basis the DIMTS did not come under the purview of the RTI act.

Glad that this NEXUS(Allegation) have brought under transparent act.
 
As every one know from BRT, to HSNP and what not every Delhi Govt tranport related project is doen through this particular SPV and it is imporant it is under RTI Act.
Sanjeev was raising the issue of Bus Sheltor that too build by this organisation.
 
PFA some of our correspondence to demand DIMTS under RTI Act 2005 and also we demanded for CAG Audit as we sincerely doubt such entity often end up eating or wasting public funds.

Public-Private Partnerships under RTI Act: V Narayanasamy

NEW DELHI: Information about Public-Private partnerships can be accessed by citizens under the Right to Information Act, Lok Sabha was informed today.

"Any information about Public Private partnership arrangement which can be disclosed under the RTI Act may be accessed through Public Authority which has entered into the said arrangement," Minister of State for Personnel, Public Grievances and Pensions V Narayanasamy said.

He said RTI Act 2005 is applicable to public authorities as defined under section 2(h) of the Act, which includes bodies owned, controlled or substantially financed by the Government and non-government organisation substantially financed directly or indirectly by funds provided by the appropriate government.

"Further as per section 2(f) of the Act, information relating to any private body, which can be accessed by public authority under any other law for the time being in force, is already under the purviews of the RTI Act, 2005," he said.

Replying to a separate question, the minister said no proposal to amend the RTI Act is under the consideration of the Government.

"It is the view of the Government that RTI Act, 2005 has contributed to improvement in Transparency and Accountability in the functioning of Government," he said.

In line with RTI Act 2005 we sought details of RTI Act 2005 implimenation by DIMTS-Delhi Integrated Multi Modal Transit System Ltd.  is a Joint Venture Company set up with equal equity of the Government of National Capital Territory of Delhi (GNCTD) and Infrastructure Development Finance Company (IDFC).
A large chunk of Delhi Govt Transport Infrastructure project is executed through this so called Special Purpose Vehicle or other named programme.
 
It is evident that the DIMTS is equity is by Govt of NCTD and qualify for Public authority in line with Section 2

 It is also to be noted the FUNCTION as disclosed in the DIMTS clearly indicate it is doing PUBLIC
We therefore request CIC u/s 18 of RTI Act 2005 to consider this complaint and call for enquiry and declare the DIMTS as Public Authority under RTI Act 2005.
 
As you are well awere it is highly important for an organisation like DIMTS to adhere Transparnecy when it deal with Public mattes and Exeuctive Public Projects using Public Exchequer.

As per definition it is very well under RTI Act 2005 and we noticed not even single information under RTI Act is reavealed on its website.
