Sir,      

 

There are several provisions where municipality is duty bound to levy penalty on miscreants to bring discipline in society. But it is felt that job of charging penalty is also being handled with lack luster attitude as a result we are moving in a vicious circle where law enforcing agency itself is disinterested in bringing order & encouraging people to violate laws to as to provide a cover to hide the inefficiency of Govt machinery. In this reard please provide following information under RTI for our firther necessary action:

 

(i)            As per Guiding Principles of outdoor advertisement policy 2007 framed by The Environment Pollution (Prevention & Control) Authority under direction of Supreme Court on initiative of MCD no bill board can be placed on pedestrian walkway. SDMC is duty bound to remove all such advertisement/boards from walkways under section 146 of DMC Act 1957 and also file police case under section 283 of IPC & section 83 of Delhi Police Act. SDMC area is full of such boards which are advertisement board & information boards fixed on pedestrians walkways. More specifically large number of such boards are fixed on Bus Q Shelters blocking pedestrians way. Since policy is framed under direction of Supreme Court and no-compliance is a direct contempt of the directions of highest court of land. There is no exception in policy which allows SDMC to overlook obstructive boards fixed along with BQS. Since large number of such boards have come up on all the roads, the only understandable reason for this appears to be extreme carelessness of SDMC officers. In this back ground, please provide (a) list of officers who are supposed to carry out road inspection & remove such boards from walkway and against whom legal action can be initiated for apparent violation of SC orders. (b) Amount of revenue loss due to SDMC due to non levying of penalty for such violation.

(ii)           Please provide zone wise & month wise number of challans issued for spitting, urinating in public and littering on public places from December 2015 onwards.

(iii)          Please provide zone wise & month wise list of penalty imposed under section 3 of The Delhi Prevention of Defacement of Property Act 2007 from December 2015 onwards. In case of NIL report for any of the months please inform the complete contact details of concerned officer who has failed in his duty for initiating legal action.

(iv)          Please provide month-wise & zonewise number of challans issued Under section 11 of The Delhi Prohibition of Smoking and Non-Smokers Health Protection Act, 1996 from Dec 2015 onwards

We do hope and pray the SDMC NGZ will provide information.

First of al the PENALTY should be imposed on Senior Most Officials of  SDMC from Commissioner by Deducting % of their salary. Untill unless we fix the TOP Boses this MCD not going to change.

They are not penalising OFFICIALLY because the UN OFFICIAL PENALTY is collected by so called HAFTA system Be it encroachment or Pollution or other areas the MCD domain.

1) I think a estimate over CRORES are earned by PRIVATE person in MCD Najafgarh Zone alone from Dwarka by those illegal advt Banners, Posters, Boards erected.

2) The MCD is such bunch of people who have NO SELF RESPECT at all. They never install URINAL or other facilities in Dwarka, claiming that they are not ROAD owning or Land Owning agency(DDA). However at the same time across all the roads and footpaths the same DC to Commissioner and their subordinates issues permission for Hawking and TEH BAZARI . Every one know who are these Hawkers 99% either relatives of MCD own staff or Politicians.

3) Smoking: Who  is promoting the banned GUTKA & Smoking in Public.. None other than Commissioner SDMC & DC Najafgarh. Across Dwarka one find every 50 mtr there is Cigarette/Pan seller selling  Gutka and even may be other substances. It is evident PROTECTION is granted by SDMC to these people.

4) REVENUE: There is no dearth of Revenue for Municipal Service department like MCD. The only problem is the ZERO Accountability, Transparency. We can never ever talk of PARTICIPATORY GOVERNANCE with these people in MCD.   They have HUGE REVENUE from Property Tax Dwarka alone due to HIGH DENSITY and HIGH RISE Apartments. While on the other side
the revenue loss :

1) Every shop keeper keeps his material outside the Shutter area.. Now why and what stop MCD to make cancellation of the Shop and Establishment License & Seal them? because they have the UNDER THE TABLE COLLECTION.

2) The Building, look at he amount  of building build in Dwarka various sectors on plotted land and on Village Abadi, Extension, NONE OF THEM ARE officially on MCD records for due payments or approval. At the same time we all know it is the MAFIA that existing MCD who collect the amounts in CASH and KIND for allowing what ever illeagal.

3) The huge Revenue loss as mentioned in Advt.

4) The loss on Penalty or Charges. Even the weekly Bazar these MCD collect money but actually it never accounted.

5) Parking... The parking scam is fully known to all. During Diwali in some locations the MCD parking charges were over Rs. 150 per hour. Is that possible without nexus of so called RP Cell in MCD ? We all know the slips are issued while in NDMC or other areas proper Slips are issued. Why MCD is not adopting that ?

6) Study tour & other waste by MCD: These officials of MCD travel abroad to study. However, they never make an effort to study what is working fine VERY NEXT door in NDMC or Delhi Cantonment Board.

We the citizen can provide good feedback and input. However, these people whom I consider who have NO SELF RESPECT or LOVE for the Nation will never take it. They are there only for making their Salary, Perks and additional income under CASH & KIND SCHEME...

The list is endless...
