Discriminatory Provisions

Concerned Department: Central Board of Direct Taxes.

 

Grievance: There are several discriminatory provisions under Income Tax Act squarely favouring Government employees. For example, Government servants can enjoy unlimited amount of gratuity, leave encashment & upto 40% commutation value of pension at retirement, but against this employee of autonomous institutes, PSU & other private sector have been put to face the ceiling and bear the burden of tax. How can there be differentiating provisions for Government employees without spelling out any logic? It appears those who write the law have favoured themselves. Such arbitrary classification creating partiality among different sections of society and giving undue enrichment violates the principle of equality. Past precedent demonstrates the judiciary's disapproval of similarly provisions. In light of these considerations, it is requested that the anomaly may be reviewed and this artificial distinction may be removed to equate all.
