Subject: Request for introduction of new tenant/servant police verification form in all district of Delhi and whole country.
Sir,
I would like to draw your kind attention towards a most important aspect of tenant and servant police verification process of the country. The police verification of tenant and servant is the most important step to ensure the security and control the unwarranted person of criminal background in the flats of residential area. Without proper residential and identity proof no one gets flat on rent as per rules. The whole paper of whereabouts is submitted in the police station for further investigation. But in practically speaking, this is not properly enforced or implemented by the people of the country. Generally one can get flat on rent through property dealers and estate agents and they themselves conduct the police verification. As per rule it is the duty of owner of the flat to conduct tenant and servant police verification otherwise legal action can be taken under section 188 IPC. But almost all owners of flats ask property dealers to do police verification. It is fact that in most of the cases property dealers or estate agents does the verification without putting the signature of owner of the flats. The responsibility of wrong verification is not fixed against the property dealer in spite of commit mistake in verification.
The present police verification form does not have any column for property dealers or estate agents. Without fixing any legal responsibility of property dealers and estate agents no action is possible against the wrong doing in verification. There are innumerable property dealers and estate agents are spreading throughout the country and they generally open their office in residential areas like Dwarka Sub-city, New Delhi. They do not require any legal documents and permission of any kind from the authority. It is strange but true. They are doing huge business of estate for sale and purchase of the flats or rent out the flats. But they do not have any responsibly and accountability. This is a great lacuna in the law that they earn money without any legal bounding. That is the reason that they are engaged in wrong things most of the time. They do not bother to give flat on rent without any social responsibly. They are also engaged in unauthorized construction or encroachment in even government land and flats. It is not easy to apprehend or find out the culprit without proper police verification. The time has come to streamline the tenant/servant police verification and make it mandatory owner and property dealers. The following suggestions can be inducted for making the system more concrete or spotless:
