You probably don't remember us, we met at just one of the meetings.Yes there is some movement and it is possible to sell apartments now - Dubizzle has most of the asking rates, though actual selling price is lower (isn't it always !!)The developer is a full con - we tried to sell through them and their commission was exorbitant too. (D1 actually sold apartments as low as 1480 / foot in end 2012) but somehow D1 actually manage to sell too.Please send me your email id and I can put you to one or two agentsChin up and we all hope you get well soonBest regards

Hi Nigel,Sorry, I was not able to respond your previous mail.I will try help you, if I can.First of all, I have big experience for last 5 years in real estate disputes in Dubai. Let me share with you:
- No one developer refunds money by good will. You have to go to Court.
- Dubai Court does not accept Force-major reason - don't worry about that.
- But: Dubai Court rejected refund money from developer for completion delay reason for almost completed property. Only compensation for delay (if you fulfilled your obligations - paid installments in proper time, they giving 3-9% from paid amount per annum.)
Dubai Supreme Court issued decision like that.So all previous First instance Court refund judgments were canceled later on Appeal or Supreme. We all lost our refund cases.I won only one refund case because developer stopped to build.My advice anyhow to complete payments and sell your flat.The viable options:to complete payments, then demand delay compensation from developer (court procedures appr. 1-2 year) and sell. You cannot sell until you finish in court- but you can give to rent.Or- to complete payments, then sell by market price.Dear Nigel, believe me, it is easiest and best way.I spent so much funds, my times for lawyers and court fees for nothing.Tell me what you decide and how I can help you.

So if any investor as got a copy of the force majeure letter, I would very much like to see a copy of it, because I heard that they were claiming force majeure on the grounds that the utilities (power and water) were not in place to allow them to complete the building and handover the finished Apartments. At the time they had got RERA to agree they were 70% complete making us pay 70% of the Apartment price, then at the beginning of 2014 they made a statement in the press that they were 90% complete and the Apartments would be finished in 2014.Now in the last correspondence I had from them which was a couple of weeks ago they told me they were looking to get an engineers report to allow them to start handing over Apartments in December 2014, so if they can handover Apartments they cannot be waiting for utilities and if this is the case they cannot now claim force majeure on that basis, so we should be entitled to a full refund for them not completing our Apartments within the time frame they originally gave us.Some feedback from D1 investors regarding my comments would be most welcome.Best RegardsNigel
