Dear all

I was wondering is anyone has purchased any units in G&G Partner's
project, Villa Caria? I would very much like to hear from them as we
are trying to gather as many investors as possible to confront RERA in
cancelling their project and return the investors money.

G&G have a number of sever issues. Just to name a few;

1- The issued SPA's valued at 1 (one) AED but collected the entire
money for their units from cash buyers. This is against the law and
escrow rules
2- They sold the units when they did not have a NOC from the master developer
3- Thy sold the units where they did not own the land or have a NOC
from the land owner
4- They have been paying for the land using the funds in escrow
5- They created their own real estate agency and contracting company,
passing invoices for services rendered to take money out of the escrow
6- They have had the investors money for over a year. Still no
construction licences have been issued, no construction progress
7- They had a 30/70 payment plan. The banks have withdrawn end user
and development finance. They have refused to provide assurances to
the investors that they have enough funds to continue with the
development

Hi Sahba,

I have invested in Villa Pera by G&G Partners (bought from Dynasty Zarooni in April 2008). Paid 20% and still no construction, etc. Does this building have the same problems as Villa Caria that you described below?

Absolutely. I have paid 10%. G&G have requested for me to pay the
extra 10%. I am yet to be convinced that they have the funds to
construct and finish the project as the payment plan is 70% upon
completion.

We need to get RERA to ask them the same questions I have posted in
order to safeguard the investors. We can not do this unless we have at
least a representation of the the investor group which owns more than
50% of the total number of units in order to be able to go to RERA and
the court demanding the information or cancellation of their licenses.

I therefore urge you to gather as many investors as possible on the
Villa Heights projects (which include Villa Caria and Villa Para)

I look forward to your feedback and thoughts.

Won't such actions be interpreted by RERA urging investors to stop their payments? I guess it's illegal.

Nigel, what do you think? Otherwise, we could place an ad on behalf of the whole group and list all the projects we have invested to attract more members.

The word transparent seems to be used a lot be RERA, we would not be placing add to encourage cancellation. We all need the comfort in knowing when we make payment ours is not the only one, if a developer as a good customer base and that is shown be the investors that come forward, then we can continue making our payments in confidence.

Not all agents/brokers are supporting their clients.  There are a lot of fly-by-night agents and also people who have only sold to get their commissions.

I also invested in Villa Pera and paid for now 25%. As I know the completion of the project is postpone till second half of 2010. I have not been given the explanation for that delay. Lets keep updated. RERA is planning to announce what is the situation with individual project. Do u know How we can check the status of the project?

I have cash units in Villa Caria. Still fighting it out on the issue of AED 1.00 on the SPAs when we paid the full amount.  Let me know if something can be done jointly to put more pressure on them.

The prices going down drasticly, the investor did not start yet the construction. We should renegociate the price correction. The cost of material is less and the construction is delay. I talk to Mr Osman but he does not want to accept. Shell we address that issue to RERA in that case?

Following the market the situation changed a lot and right now we have
to fight for the price reduction with our developer. Investors who did
not pay 20% of project can easily walk away from their deal and buy
new property. Avoiding stress with mortgage and later rent out or
resale. On the other hand for those whose transaction have not been
register with Dubai Land Department within 60days can go to court and
receive money back including interests. Recent cases shows that people
get back they money. The National news: On Monday, the Property
Court ruled that Mizin, a development arm of the government-owned
investment company Tatweer, had to pay back Dh7.4 million (US$2m) and
9 per cent interest to an investor because Mizin did not register the
transaction with the Dubai Land Department within 60 days under a new
law. The ruling has triggered discussion among investors and lawyers
who believe the court is planning to take a literal interpretation of
laws relating to the property sector, which could mean many investors
getting their money back."
We should talk to G&G Partners to consider price reduction as the
investors will go to court to receive they money back, we can also
default on payments as the start of construction is delay for more
than 6 months since first payment. We have a lot of options right now,
lets use it for our good.

Dear All,

I just found this group. I have 2 units at Villas Caria at AED. 1 cash value too nd was about to register a case againt G&G in the Dubai Courts tomorrow.In Dubai land dept., the 2 units I on have a value against them so my lawyer asks me not to worry too much about the AED. 1 factor. Have you all gathered and taken any collective action? Any progress in last 4-5 years? I would like to join the effort or atleast get updates on what other unit owners are doing!! Dear all please let me know if you know a good lawyer with reasonable fees. Who is expert in real estate law. And have a tracking record of getting money back from developers. If a development project is cancelled by RERA what should we do ?!!! What is the investors rights at this time.

i know of it its on the cancelled list and u need not worry about the one dirham contract as long as you can prove how much you really paid should be fine.

The committee is in the court so I don't know how it will function yet but normally in court u need a lawyer to represent u but in this case we will see as soon as the first batch is done also how will you find out if it's come to the committee is another imp question. If you miss filling at that time when will the next turn come body seems to know the answers.

What I also heard is Rera first inform you thru email and also give you some time to submit your project and finance details incase your project name is in the list . 
You are right I agree we have to wait till first batch is over and then everything will be clear .

Hi I have 2 town houses in Reliance 17 I thought all Reliance projects were cancelled years back, not sure about land because Master Developer may have just claimed that back because Reliance were in default of their contract with Master Developer

Hello everyone!

I have to mention that it's highly unfortunate that I had not found about this group years ago to hopefully gain some clarity. I went together with my father back in 2008 and also purchased one apartment in 'Villa Caria' from G&G Partners (through Dynasty Zarooni).

Unfortunately, years have passed and nothing seems to have happened. Both my father became over time highly reluctant and anxious because of the purchase which seems to have been cancelled which seems to be the general interpretation of this incident discussed in this group.

I would greatly appreciate if anyone could share some insight on how did things turn out for you guys after all these years since this debate was active. There is nothing more than the urge to put this behind us now but first we want to know what actually happened.
