Dear Members,

Just a note for investors looking to take the legal route, one of our
members as managed to negotiate a legal cost with a well established
Dubai law firm, which has Advocates that can represent you in court.

The fee will be 2% of your claim plus court costs, 1% to be paid up
front and the remaining 1% once you get your money back from the
developer.

This fee is subject to numbers, if insufficient numbers then a greater
fee, so I am looking for people to come forward if this offer is
acceptable.

Anyway this is a very good deal! I will talk to our firm's partner to see if we can compete on this figure.

Do you know anyone who invested with IFA Hotels and resorts? I am going to meet them (again) on Sunday for a power play. If anyone has info on them I would greatly appreciate to receive any comments.

No, more to do with volume and duplication 
What I need to collect is a list of names and details of cases to be filed. Many cases will be very similar in what Laws have been violated by the developers. It is this duplication that is in effect bringing the law firms fees down, so volume of cases is important.
 
To get the discount all cases will have to come through our group, we are looking to get a letter from the law firm confirming the 2% fee for our group members. Until I have this letter I cannot disclose the Law firms name, because it could jeopardise our negotiations.

So kindly legal suit should be an individual decision.We as a group can help till investor goes to court and once investor goes to court,we can bring proofs,witnesses and all the help during the case,but WINNING -losing is not the responsibility of the group.

Since the GROUP can advise,NOT ACT on anybodys behalf.

Hope we all agree to this fact.Let us help each other,but do not get into a position of taking responsibility for some decision being taken.

Please note the Law firm is giving group discount based on volume, the cases will be filed on an individual basis, so if 10 members come forward from one project on the same day then 10 cases will be filed with the court, the deal is not on the basis of file 1 of the 10 then wait and see. The deal will only be attractive to members who are serious about taking their developer to court and spending their money to do so, but do not want to pay 7% for the privilege.

We can obviously do all the above, but a group with many members brings buying power and that is what we are trying to obtain through our negotiation with different law firms, many do not want to play ball, but some do. The group is hear to help investors in whichever way possible, the more judgements in investors favour the better. It is only the judgements that will prove to everyone around the world that we are entitled to our money back, if there is no money in the escrow accounts to pay us back, then we look at our different options.

Ok I understand!

I have to say this is the lowest fees I have ever heard of so far and will probably be the lowest ever.

They must be very confident about the cases if they agree on this fee. Very interesting though to see how low they are willing to go.

I hope their low fees will not incur low performance. I have heard of many lawyers taking lump sums with no success fees but never worked on the cases. Ask them to show you cases in which they have won. It will be in Arabic but my partner could translate it for you to check the information.

You may have already done this but ask for as much info as possible on them that you can check on paper. A low figure shouldn't blind you!

I truly hope this works out for the group.

2% is waaaaaaaaaaaay below market value ( according to me ), I am
paying 6% + Court related Fee's and I am extremely Happy about my
deal, since I started negociations at 9%.

All Nigel is trying to do is resolve an issue which all our investors are facing. Lawyers are trying to take undue advantage of the situation and trying to milk us for as much money as they can and even then some or not doing anything after taking the money. Another major issue as already pointed out by some investors is the ridiculous up front fee which most of our investors are finding very difficult to swallow. I have had several discussions with Nigel on this. All he is trying to do is use the quantum of members we have to try to negotiate not only a bulk discount but also we can then exert pressure on them for results. Now a days u have to be extremely careful as people have made a business out of referrals to lawyers and are getting some sort of kickbacks. Its become a very dirty game and we cannot let anybody take advantage of the group for ones vested interests. Hence I've seen that Nigel is contemplating various options. Of course it is not our responsibility whether the firm can win the case or not we are just facilitators who are trying to do whatever we can for the group as a whole. We will be there through out to guide and assist where ever we can.

Don't put all the lawyers in the same bag of crooks. Some of us are actually trying to help. Beware of your choice of words.

I have already pointed this out: some get paid and do nothing after. Just be sure that they will not collect 1% here and there and then sleep. This is why I strongly recommend that they prove success in court.

I have been approached to do this "dirty business" but have never accepted. The scary part is that people with good marketing and sales skills are able to sell the virtue of a scum bag lawyer... I've seen it. AS a result we are dealing with angry and suspicious clients...

This is very sad but unfortunately Dubai is based on quick money regardless of how you do it. Real estate is the best example. You sign a piece of paper they call "contracts" and you hope to make big profits without thinking about the risks and reading what you signed.

Anyway don't let a good deal blind you. If it turns out to be in your best interest that is great! Even a very impressive deal! I am like all of you: I am suspicious especially on this extremely low figure. Please bear this in mind

Rate is 7. 5 percent of the claim value to max of 30, 050 to be exact just paid for two cases.

I agree half of what Guillaume Hess said there is question mark for
their low fees which
is really low as it may increase when the case is not big enough.
the rest half which i can't agree is that in this market, no law firm
could prove
their performance as not only lawyer, but also the law, the judger &
the government body are all new, everybody
is learner, i found that in many aspects, investors knows even more
than lawyers.
t/f, every investor needs to have their own assessment on the law firm
& lawyer
& should not only assess on the percentage.

As up to now, I only see two case succeed for the investor in Gulf

Hi Steven,

The main point I wanted to draw your attention to is not to go ahead too fast. Since it is the lowest fees ever heard of I think you should be careful. If they can't prove success then they should explain their strategies to you. Since you know a lot on the subject you will be able to quickly assess the firm.

You are absolutely right when you say investors such as some of you in the group know more than us in this mess. I shamelessly admit that I have learned a great deal from this group. I find this situation rather interesting as it changes the lawyer-client relation to a cooperation rather than the usual lawyer knows it all.

Is there any judgement by dubai court except for MIZIN, and the one
for 1.7Million which was against a developer in business bay.

It is important to know the atmosphere in the court room which can
only be done by knowing the judgement either they are positive or
negative. Please advise if anyone can help in getting the judgement
released by property court in past quarter. I am sure there should be
atleast 3-5 more judgements as mizin was declared approx 45 days ago.

Nigel,

This is an extremely good deal that has been negotiated.

Would the firm agree to shift the 1% upfront fee into a succession
fee, say 2% or even 3% (a higher percentage since they take on
additional risk) upon receipt of award? They can charge a minimal
administration fee for reviewing member cases if that is why they want
an upfront fee.

This way they will not accept cases they feel do not have a good
chance of winning since they will earn their money when they win the
case.

Folks

Don't forget that if we win a case, the developer will be asked to pay 12%
interest on the amount due ! so this should offset the cost of the lawyer.
This is what my lawyer said.

I think Ali's suggestion is constructive to the investors, however, it
might be difficult to the law firm,
yes, it is true that if we give condition to law firm to get all their
fees only upon winning the case, they gonna be
much careful in picking the case, but their is another worry from the
law firm, what if investor does not pay upon winning the case ? should
lawyer file another civil case against investor ? i don't mean that
any investor in our group has integrity problem in paying the lawyer
upon winning the case, but this is what i have heard from some law
firms for their bad experience.
however, since we have a huge group, so we have power in bargaining a
best term for our group.
also i would like to suggest that for the rest lawyer fee, we should
only give them fees upon redeeming our money instead of winning the
case, sometimes winning the case does not lead to successful money
redemption , which is the utimate target of investors. steven

Dear all

You have to be very careful with lawyers because the interesting part
doesn't come when you give them the case but when you pay the money even if
it is 10,000 dhs then you need to see the follow ups. Up until now I have
found only one lawyer (after having dealt with atleast 5 law firms) who
chases his clients as a broker does for property sale. So for me more than
money it is about customer service.

One more route that I have come across is third party mediators which one I
met accidently yesterday. These guys do not charge anything up front but
upon recovery they are expensive upto 40% in certain cases.

So we have to be careful in making choices and decisions about choosing
lawyers and trust me for a civil case you do not need a lawyer at all in my
opnion. If you have common sense and basic understanding of your case then
you can do all by yourself. Even in my case I draft almost all letters for
my lawyer to present to court etc. I am not a lawyer at all.

This fear of not being paid by the Law Firm can be allayed if we give
the Law Firm a performance/payment bond from a reputable local bank.

These type of bonds are common in the construction industry so there
should be plenty of Banks in the U.A.E. that can issue these type of
bonds.

A performance bond can be issued by a reputable local Bank that binds
it to pay the Law Firm the percentage of fees owed to it after certain
criteria are met. The bond can expire if the member loses the case or
if the Investor is not paid within a certain time period (negotiated
with the Law Firm).

We can define the criteria such as money must be paid to the Investor
after the case win before the Law Firm can receive its fees. The Bank
will release the money directly to the Law Firm if they fulfill the
criteria without the Investor ever being involved removing the risk of
the Law Firm not being paid after the Investor has been paid.

Banks will most likely ask for the full amount they are responsible
for to be kept in their custody if the member has no account/funds
with them.

Or it can be the other way round, we can ask the Law Firm to give us a
performance security/bond from a reputable local bank and members can
give them the 1% upfront. That way they will think carefully about
cases they select as they will be held accountable because the Bank
will have to pay back the member if the criteria we define are not
met.

I am sure out of 800 people in this group there must be several
members who are case studies in all Laws broken in the U.A.E. and
Internationally. In a fair Judicial system they would be awarded and
paid without problems. So the Law Firm must have faith in the
judicial system it is operating in and must expect payment to be
awarded (and paid) it if takes on a member case since it will only be
paid its fees if it satisfies the criteria in the bond.

However with the Laws changing every other day, I can fairly assume
almost all Law Firms (unless a Lawyer here says otherwise) will be
cautious to put faith in the UAE Judiciary system to put their own
resources fully at stake. So maybe we could ask them to remove the
percentage upfront fee but we will probably have to cover their
operational costs even if we have very strong cases from members in
the group.

We now have the deal in writing from the law firm, so any of our members who wish to take advantage of the discounted fee will have to become fully paid up members of our group, which will cost you 200 AED pa.
The 200 AED is to cover the cost of designing and running the website, their may be additional costs associated with making our group a legal entity and also any advertising required for our group to attract new members to enable us to have more say in whether a project is viable or not.
 
The deal with the Law firm is 2% of the claimed amount of which 30% is payable up front and the remainder, only when you get paid by your developer. e.g. 1,000,000 AED claim = 20,000 AED, of which 30% = 6,000 AED is payable up front. The additional costs are that of filing you case, which is 7.5% of your claimed amount, capped at 400,000 AED, so maximum amount of court fee for any claim over 400,000 AED would be 30,000 AED. The only other cost is document translation into Arabic, which we can get done for approximately 30 AED per A4 page. If you lose your case, then you will not have to pay anymore money to the Law firm, so your total commitment is 30% of the 2%.
 
For the group to be entitled to the above discounted fee, we need to file cases to the value of 30 Million AED, from the information I have received to date, we have collectively paid over to our developers 944 Million, so this is not an unrealistic amount for members that are serious about trying to get the money back through the legal system. I have already had members come forward with claims to the value of 11.5 Million, so if the group can achieve another 18.5 Million we can get the benefit of the 2% fee, once we have reached the 30 Million then all other members will get the benefit of the 2% fee on an onward going basis.
 
I can tell you it is a well established local law firm, but any members wanting to take advantage of the 2% fee will have to sign a confidentiality agreement, so they do not disclose the name of the firm. This is because the firm will have clients that have paid a lot more than 2% for their services and they will still wish to attract individual clients at the open market value for their services within the present market.

Nigel has done a great job in getting this rate. I am sure the Law
firm is reputable and established in Dubai and has won real estate
cases.

I think the reason they are offering this rate is because they expect
Volume business from our group. Those of us who are interested in
going to court should inform Nigel about the value of their respective
claims. He will then aggregate the claim amounts to reach the total at
which we can get this attractive rate.

Also, i dont think many reputable law firms in dubai would be
interested in purely success fee basis. However, if there are, lets
work out a deal with them. In any case this is not exclusive and we
can have more than one law firms.

I second your idea and think it is great to have some sort of performance
bond thing on either side. However lets see if any lawyer will agree to it
as they are already getting monies from already broken investors. But to be
fair for all sides I wish this can be implemented.

It is not necessary that you will always win legal cases. Sometimes it is even better to find alternates like gathering investors for cancellations. I have even adopted mediation route outside RERA very recently. Will definitely let you know how it goes once I get results. You have to be very careful with lawyers because the interesting part
doesn't come when you give them the case but when you pay the money even if
it is 10,000 dhs then you need to see the follow ups. Up until now I have
found only one lawyer (after having dealt with atleast 5 law firms) who
chases his clients as a broker does for property sale. So for me more than
money it is about customer service.

One more route that I have come across is third party mediators which one I
met accidently yesterday. These guys do not charge anything up front but
upon recovery they are expensive upto 40% in certain cases.

So we have to be careful in making choices and decisions about choosing
lawyers and trust me for a civil case you do not need a lawyer at all in my
opnion. If you have common sense and basic understanding of your case then
you can do all by yourself. Even in my case I draft almost all letters for
my lawyer to present to court etc. I am not a lawyer at all.

Hi Nigel and Pravan,

Even I have 1 unit invested with ACW and they are not willing to give
discount or consolidate to a much smaller unit. Secondly whatever
they willing to give they want PDC which I will never give also.

They have just put a fence on the site to say that construction has
started.

I have invested in The Light retail outlet at 2250 per square feet
which the price is less than half now and paid 10% already.

I am willing to take any collective action. They have sent me forfeit
letter also which I have ignored as I want to get more clarity.

Hi - may I please introduce myself. I am an investor in Platinum One
and have so far paid 60% of purchase price, and reading threads like
this, I'm getting a bit nervous! I also know about 25 investors in
various ACW sites, and we are considering forming a group to review

some people met rera official mr. essa mansouri re ACW HOLDING PROJECT
and conveyed the sentiment of all investors
 
what is important is that we need to sign a petition and submit it immediately
most people will rather forfeit than pay any more money
 
we need clarification - nigel - farah - saqib - ali rakesh
he told the investors that funds which are in escrow from the investors money CAN BE PAID towards the plot dues to master developer - can u pls clarify this point

Who told you this Essa? I went to an investor meeting last night where RERA had allowed a further 10% to be taken out of the escrow account to make the next land instalment for a sub-developer. Apparently the land department/RERA said this was protecting the investors interests because the land had a value, but I fail to see how this helps investors. The land is worth nothing now and if the 10% was just another instalment the master developer can still claim back the land when there is no money in escrow to make the next payment.
 
What in effect is happening is the government are allowing master developers to become preferred creditors and they are helping themselves to our money which is stuck in the escrow accounts.
 
We need to look upon sub-developers in a different light they are just a vehicle for the master developers to get their hands on investors money to buy government land. Master developers sold of plots of land to get cash in quick and if the sub-developers didn't have the money, they came up with a simple plan, use your investors money to pay for it.

I want to pay 0.5% in advance and the balance after the winning of the case. The legal fee of Ali Al Shamsi is more and really, I cannot afford the same. Also I want to know if it is necessary to go to court.
 
Please let me know which legal firm is being hired for criminal case against Omniyat

Hi Mr Shafi I think it is useless to hire the legal firm as we know that legal firms are also corrupt and they are minting money on both side.it is better to wait because RERA might take some concrete steps against the small Developers.

I saw your mail and I would like that you explain to me what do you mean that RERA will take conceret steps against small developer? the reason I am asking I paid 25% to a small developer (name of the company AAA) and until now they did not start the project.

Starting from January 1, 2009, developers and banks have been ordered
to stop taking payments more than 20 per cent of the cost of
properties from buyers or investors until construction begins, a Real
Estate Regulatory Agency (Rera) official has revealed.

"We have sent out letters to 100 developers – as well as having
meetings with them and lending banks and institutions – telling them
to take payments from buyers worth only up to 20 per cent of the
contract value," Essa Saeed Ahmed Al Mansoori, Head of the Trust
Accounts Section at Rera's Real Estate Development Trust Account
Department, told Emirates Business.

"With properties that are already being built, developers who have
collected more than 20 per cent of the contract value from buyers will
immediately have to stop asking for further payments until they
correlate the escrow amounts already collected to construction
progress."

Rera has set up an 11-member Real Estate Development Trust Account
Department that will supervise and monitor the construction process
and ensure the escrow amounts are collected in accordance with the
agreed schedule.

"We have all the figures in our database and are asking developers to
stop collecting money from buyers," said Al Mansoori.

Rera Chief Executive Marwan bin Ghalita said developers could protect
their rights by referring disputes to the Property Court where
contractual agreements would be enforced. "The message we want to send
out to the developers and lending banks is to consider the situation
of the investor before they take action," he said. "In this time of
crisis, everyone should work together and everybody's rights will be
protected."

Meanwhile, Rera has announced that a revision of Law No 8 is being
considered by Dubai Land Department.

"For new sales and purchase agreements the booking amount has been set
at a fixed amount rather than the previous rate of five to 10 per cent
of the contract value," said Al Mansoori . "In January, Rera will set
up a technical audit team. The new system will enable stricter
auditing of the escrow account, the developer and the trustee."

He added that Rera was introducing regulatory procedures covering Law
No 13, which established the Interim Real Estate Register.

A land department spokesman said 100,000 units had already been
registered.

Hi, I have also purchased a flat in Hanover Square and paid 80% and
also the registration fee they have asked. Reading all these groups,
i am getting extremely worried with mental tension and depressed. Can

I was also wondering if we were still negotiataing with the lawer for the final deal or the deal that Nigel forwarded in one of him mail around a month back was final.
