Nigel,

This is Steven here, I remember that you had investment with Indigo Properties as well.  We have met couple of times when you were still in Dubai, do you still remember ? 
I have settled with Indigo for Indigo Optima, How about yours ?

I have lot of experience in dealing with Properties stuff, I have initiated more than 10 cases & won all of them & got 90% of my money back.

You are the one who established this group & you deserve to be helped by group members.

Hi Members
 
I am still looking for anyone that can help me with my D1 investment, a few
members have said they would kindly offer help but when I reply to their
offer they do not make contact with me directly it all seems very strange
why they should offer help and then not reply to me when I make contact
with them through their email address.
 
The developer claimed force majeure to get out of paying refunds for not
completing our Apartments on time, I never received a letter from them
claiming force majeure because I never signed the S&P agreement with it
containing draft wording within it, I felt it gave them too much power to
change the agreement at a later date. So if any investor as got a copy of
the force majeure letter, I would very much like to see a copy of it,
because I heard that they were claiming force majeure on the grounds that
the utilities (power and water) were not in place to allow them to complete
the building and handover the finished Apartments. At the time they had got
RERA to agree they were 70% complete making us pay 70% of the Apartment
price, then at the beginning of 2014 they made a statement in the press
that they were 90% complete and the Apartments would be finished in 2014.
 
Now in the last correspondence I had from them which was a couple of weeks
ago they told me they were looking to get an engineers report to allow them
to start handing over Apartments in December 2014, so if they can handover
Apartments they cannot be waiting for utilities and if this is the case
they cannot now claim force majeure on that basis, so we should be entitled
to a full refund for them not completing our Apartments within the time
frame they originally gave us.
 
Some feedback from D1 investors regarding my comments would be most welcome.

Yes I remember you we met at Arabian Ranches Golf club, I hope you are keeping well, I lost my money with Indigo, they said they were going to build and got RERA to cancel my agreement because I refused to pay anymore money 

I am glad that you succeeded in getting most of your money back :)

I really need help in selling my Apartment, the developer is not really offering a good refund and they will be chasing me for the remaining 30%, once they complete the unit.

Dear All,

Even though I have been successfull in getting money out through the legal system I still have alot more to recover. Most people I have met are still in the same situation as they where 5 years ago. The new laws that are coming out and the procedures and practices in the judicial system still need to be changed to be more conducive to the investor or should at least give us a level playing field. I apologize for not being very active on this group a responsibility Nigel intrusted me with at his departure. Its high time we re group and become proactive so that are issues are sorted out and we can all finally move on in our lives. Open to any suggestions and inputs on how to take this forward,

Thanks Farah . Yes it's been a while !! Very nice you took the initiative of writing and inviting people to reform the group . 
Although I don't live in Dubai but I am always available whatever way I can support the group . 
Let me update you about our project Reliance 8 . According to email we had submitted our data online in Dubai court website due date was 30th Nov . This is all happened cos of the liquidation committee formed by the court etc . 
No choice now except to wait God knows how many months /years more .

As per my meeting with RERA two projects have already been sorted out and the cases closed by the cancelled project committee set up in the court, so if your projects turn has come up for review as per them it shouldn't be too long hopefully so hang in there.

Hi Farah,

Hope you are keeping well :) 

When you say sorted out did you get any money back?, Reliance directors left Dubai with our money and on Reliance 17 I only know the plot was fully paid for, but how do we get them to sell it and then share money from sale with investors? They only seem to be looking at what money is left in the bank accounts, but with Reliance we know they took it, so only the land will give us any money back.

Hope you feeling better . 
Everyone is just wondering like you how do we get our money back!!! 
I feel since long plots market have  picked up and if committee decide to sell all Reliance plots may be possible can fatch  a good price and can distribute our money . 

However this practice some how didn't convince me by selling whatever is left and pay the investors!!! ..... Dubai should bring back the Reliance owners from US with the help of Interpol charged them and try to recover money from them ( They looted all our money and spending quality time there with their families ). 
This can only be done by Dubai Government.       
Let's keep our fingers crossed till then ,

Bought town houses in Royal Estate Dubai Investment Park in Dec 2007 up till now I have no news what the developer is doing.

Hi Nigel,

Yes I have gotten money back. I have cases in almost all major emirates and am having success. So if what your saying is correct, that the plot is paid up than this can be achieved easily through the legal system. They are even figuring out a way to deal with issues where the plot has not been paid up they have been holding meetings with Nakheel so this is good. Also there are ways to bring back or have Interpol warrants issued if the dollar amount is over US $ 10 million so there are ways and then there are ways if you know what I mean. I have learnt one thing go after it and refuse to loose and you come out on top.

Thats great but i would have honestly taken them to court you recover all you paid even premium in some form and you get compensated for all these years so atleast there is some sort of retribution.

Can we make a master list of all the projects and have an update status w/ links and details?  This can be put up on Google docs and perhaps have a couple of admins that can make changes while only others have read only access.  I invested in German Sports Tower 2 and never hear any news about it.  If someone does have news, they can tell an admin to update the spreadsheet.

I think this would be helpful to all.
