As we all may know that May 1st was the deadline set out by ARRA for
all Developers to register and regularise themselves in accordance
with Law No. 8 of 2008 and additional requirements, if any.
As per the updates received from the concerned authorities, Al Rashed
has failed to comply with.
Please be further informed that we represent some multiple floor
owners in their disputes against Al Rashed Real Estate pertaining to
Humaid City Projects. Hence, we have been in regular touch with all
those concerned with the aforesaid Project including but not limited
to Al Rashed (Old Management), Al Rashed (New Management or
Representatives of M/S Ali Moosa namely Mr. Ali and Mr. Sameer), ARRA
& etc. We are in a position to appraise all with the following
assessment:
Irrespective of the status i.e. whether the Original Promoters or the
Current Promoters (rumor has it that M/S Ali Moosa too has wiped its
hands off Humaid City Project) may not be willing to issue refunds and
for adopting such an approach the Promoters alone are not to be blamed
i.e. ACI too has played a significant role and so have independent sub-
agents who may have received FOCs in lieu of luring investors. As all
the monies paid by the investors may not have even reached the
accounts of Al Rashed.
We are of the opinion (something that we have been following and are
determined to carry on): that the said issue could solely resolved by
making legal representations at ARRA, serving the concerned Developer
with Legal Notice / s and if ARRA agrees to second the investors’
motion i.e. it extends its helping hand, which it may do subsequent to
such representations. Then based on the evidence provided or grounds
confirmed by ARRA and along with that already in our possession file a
case in the Ajman Court.
Kindly try and appreciate that similar to Dubai Real Estate
Developer's, Ajman Developer's too shall only pay heed to the
decisions of the Court. Until and unless the concerned Corporate
Entity turns out to have a Human Conscience/Approach enabling it to
arrive at a mutually agreeable conclusion and prevent further expenses
and delays. Its time to be swift in your thinking and have noticeable
patience before enacting!
