Dear Mahesh/Sushant,

       The maintenance amount for the flat 007 is pending from a long time since Jul 2014 till date. Even after several attempts to reach and after several reminders we did not receive a single acknowledgement yet.
       Association has decided to get the rent transferred to association account from Tenant (Sushant) until the pending maintenance amount is cleared and here on tenant should transfer the maintenance amount monthly starting from Feb 2016.

The Total pending amount for 19 months is (Rs.2800/- X 19) = Rs. 53200/-. 

Dear Sushant,

     Please acknowledge to the mail with your confirmation on the same. Association account details attached.

       IF NO ACTION TAKEN EFFECTIVE FEB 16, THE BASIC FACILITIES WILL BE STOPPED TO THE FLAT.

As of now i have not get any response

We usually pay our rental in the first week so till then if we don't
get the needful response from Mr Mahesh then we will have no other
choice than to transfer our rental amount towards maintenance charges

Lets hope for a positive response from him at the earliest

maintenance amount and he also was telling me that he wanted some
clarifications from you

I asked him to reply on the same mail as he is also in cc for which
he said that definitely he will reply back

Kindly do the needful and help us to lead a peaceful tenure as a
tenant as i am having tension from both sides as a tenant if i don't
pay rent the owner may ask us to vacate the flat and if the maintenance
amount is not paid then the association is telling me that the basic
facilities like water and electricity will be disconnected

Finally request you to both the parties i.e. the association and the
owner of the flat do sort out this matter in quick time

We await a positive resolution from your side

It is a matter between me and association and our tenant Sh Sushanta may not be allowed in this isuue.
When association was started I used get regular updates , balance sheet and bank account statements etc
and I used to pay maintenence amount regularly but in recent past I am not aware of what is hapenning
theire. I am ready to pay the maintenance amount in instalments provided each association members should
get the fallowing information on regular basis
1) balnce sheet of every month in soft copy through e-mail
2) bank statement of association of every month through e-mail
3) any other miscellaneous expenditure receipts scanned through e-mail
You are requested to not disturb my tenant and have proper communication between association members

Hi Mahesh,

     Happy to receive an acknowledgement from you after several attempts to reach you. Coming back with your below requirements after holding 19 months of maintenance without responding for any mails or calls for these many months is not expected.
     The balance sheet till Dec 2015 was already shared by Ganesh to all owners. Also attached the same as per the mail sent from ganesh on 8th Jan 2016. All the receipts for miscellaneous expenses will be in the form of hard copy only and accounting of those was already shared as part of balance sheets.
      Please transfer the pending maintenance amount immediately OR clear the balance maintenance in 3 months if you want to clear in installments provided the first installment should be paid immediately. 
      The monthly accounting details to be shared to all association members by Treasurer to be decided in the association meetings. Please attend the Annual General Body meeting in April for discussing the same.
      Kindly acknowledge with your confirmation.

Its quite long I wanted to spell out my thoughts. Actually the amount Rs 53000 change Mahesh Kamble is holding , has a part of my maintenance amount I pay every month.

In order to avoid Mr Mahesh Kamble the luxury of enjoying others money as a grant, I am not going to pay  Rs 1716 (of Rs 53200 ) + 90 ( this month ) from my maintenance. I am again sure this month he wont pay.

Hope you are doing well. I thought of taking some time to understand your concerns if any, and so I called your cell (+91-9423859536) today afternoon, but my call was not responded to. Hence listing down my thoughts here. Hope you see the reasons for paying the maintenance amount. If not, the easier option is for us to get onto a call and discuss and close the matter instead of prolonging, which is inconvenient to everybody. Please consider this and give me a call on my cell at +91-9880115186, or to any of the office bearers (Pavan - President at +91-9986007837, Vivek - Secretary at +91-9880199884, Ganesh - Treasurer at +91-9611700661). Thanks.

Here are my thoughts:

1. Association is something that is formed by all the owners and the elected representatives manage things on behalf of all the owners. Hence, it should not be termed as "YOU did not provide the statement of accounts to me; so I will not give YOU the maintenance amount". YOU and I are all a part of the association and we are collectively responsible for the upkeep of the apartment complex.

2. All the office bearers are not exclusively working on association activities. They also have their family, work, etc. Hence it is possible that there are delays once in a while, in one or two activities. However, stopping maintenance amount is not a solution. Remember, they are actually doing the work to make sure everybody is safe and secure, and at peace. This is just like how the army is guarding the territory of our country so that we can be at peace. Imagine what would happen if we don't provide the necessary equipment for the army personnel to safeguard us!

3. Imagine if everybody stops paying the maintenance amount. Would the apartment complex be a good place to live? There won't be water, no cleaning, no security, no common electricity, no lift, no generator, etc. Is that what is being thought of as the right way to resolve things?

4. The statement of accounts is now available till the month of Dec-2015 and has been published. What is now stopping people from paying the maintenance amount, though even that can't be a reason for non-payment?

5. The office bearers are maintaining the apartment complex well and are looking for suggestions to improve the way the owners/tenants experience the living. Suggestions - not confrontations nor defiance - would help.

6. Numerous e-mails have been sent. Numerous times many people have tried reaching, but there is no response to either of these. How would anyone be able to sort out things? If the genuine reason for payment is non-disclosure of statement of accounts, then at least by e-mails and phone calls or messages that could have been communicated. Why is such an act of defiance being shown?

7. Cutting off basic services to the apartment is the only option. Remember, the services will be cut off for the apartment; if a tenant happens to live there, then it is unfortunate, but that is a necessity.

8. Immediate transfer of funds or cutting off the basic services seems to be the only option, now that the association has waited for 19 months. During the recent meeting that happened, all the participants unanimously agreed to this, effective 01-Feb-2016. However, since you responded to one of the e-mails and a line of communication was established, it was decided to give you two more days. With no more communication from you, if the transfer of funds does not happen by 03-Feb-2016, we don't have a choice other than cutting of the basic services to the apartment. It is very unfortunate if things come to that state, but I hope you understand and make the payment immediately. I am sure you too have everybody's well-being in mind. Let us get this issue closed now.

      An official notice in the form of hard copy has been already issued today to your flat. Kindly verify the same by liaising with your family members and proceed accordingly with your actions of alternative arrangements. 
      We did not receive any confirmation yet from Mahesh after these many mails and association has decided to discontinue the basic amenities like Electricity, Car parking and water supply with effect from tomorrow EOD.

Mahesh called me up at about 5 pm today. He explained that he has not been getting any communication from the association and that it was definitely not his intention not to pay, etc. I suggested him to join our WhatsApp group and also Yahoo / Google group. He wants to pay the outstanding in installments as follows:
On 04-Feb-2016: Rs.10,000
Mar-2016: Rs.15,000
Apr-2016: Rs.15,000
May-2016: Rs.15,000
Jun-2016: Balance as of that date.

He said he will transfer Rs.10,000 to the association's account by tomorrow positively. Just to be sure that he has the correct account details, please share the account details (account number, name, IFSC, account type, etc.) by replying to this e-mail.
