Hello guys,

Am planning to open a sticker ecommerce portal in India. My aim is to also provide a lot of open source technology stickers so that tech enthusiasts like me, can use these anywhere they want. Mostly on laptops :)

Am also planning to share a percentage of profit with the DSF foundation. The terms of which I think we can figure out once we proceed.

Can you guys guide me as to how do I get the right permissions and can use the Django logo / artwork to promote it in India?

Looking forward to your replies :)

Thank you.

Sumeet

Hi Sumeet,

The Django project recently published a formal trademark license that to cover requests such as yours:

Your specific usage is covered by clause 4. So - if you want to sell Django stickers, you need to :

 1) Tell us exactly what you're planning to sell (stickers aren't exactly controversial, so this won't pose a problem)
 2) Formally submit the artwork for approval by the DSF. You can do this by mailing your sample artwork to found...@djangoproject.com
 3) Make a clear statement at the time of sale how much of the sale price will be donated to the DSF.

Yours,

Hello Russell,

This sounds really exciting!

Right now am just planning on releasing the default Django logo (PFA attached).

Regarding the amount of sale price I will be donating to DSF, I will clearly mention that on the product page. :)

I am also planning to hire designers or get open sourced designs of Django to feature stickers on the website. There are a lot of developers in India who want to to put stickers of their favourite open source technologies on their laptops etc. I just want to create a forum where they can avail that easily.

Again, thank you for your support. Can you tell me what will be the next step? Do I need to fill any form as such?

Looking forward to your reply.

Thank you.

Sumeet

P.S.: Can you give me any pointers on how to approach the foundation members of other open source technologies. I tried a lot but didn't find proper forums to talk to anyone who could help me.

There are no forms required. The purpose of the trademark license agreement is that it works in the same way as Django's copyright license - by using the trademark, you agree to adhere to the terms of use. The license requires that you get approval for artwork; consider this email to be that approval -- you are approved to produce stickers of the stock Django logo, provided that you adhere to the other terms of the license (in particular, the declaration of profits clause)

I'm not sure I can provide much assistance here. It *should* be as simple as finding the official contact email address for the foundation and asking (as an aside, I'll note that in this case, you've mailed the volunteers mailing list, rather than mailing the DSF directly -- our direct email address is found...@djangoproject.com).

Many projects won't have formal foundations; in which case, I'd try hitting the developer mailing lists (clearly flagging that you know your question isn't about development, but that you're not sure what the right forum is).

I will also note that in general, Open Source communities aren't well versed in the legal requirements around trademarks. The DSF is one of very few projects I'm aware of that has formal trademark licensing terms. As a result, many open source foundations may be in a position where they simply don't know how to answer your query. Unforunately, this may be manifesting as "lets ignore him and hope he goes away".

Hello Russell,

Thank you so much for giving the approval. Yup, I will stick to all the clauses and provide you more information on the profit share clause as and when I start marketing and selling stickers :) I know there are a lot of eager developers here in India who want to promote the technologies they use.

I also think that contacting the open source foundations regarding legal issues is pretty tricky. I did try contact the NodeJS community but to no avail till now. :| At present working on contacting the jQuery community and PSF. Let's hope for the best.

We recently had a very successful PyCon in India too. Hoping to spread more awareness and try promoting Python/Django awareness in more upcoming developers.

Even my team is using Django for the product we are developing. I am mostly associated with the AngularJS side of things, but it's fun to learn some new stuff in Django here and there. :)

Hey, do you have any social network id where I can connect with you too?

Thank you.

What contact did you use for the PSF? I know a few people on the PSF, so if it's a matter of not getting a response, I might be able to shake the tree for you.

Hi Sumeet,

I just poked Alex Gaynor at the PSF - he's going to look into this for you.

Hello Russ,

Thanks for all your support :) But David (Chair at PSF I think) replied to my mail and has approved the use of the logo :) As for the donation, he has mentioned that I need to do a business of atleast $1000 minimum to be able to donate to the PSF :( I sure do hope that we can reach that amount. Nevertheless, I will see what I can donate to the PSF too :)

Again, thank you for all your help. Let me know if I can ever be of any help to you in the future :)

Thank you.

Sumeet
