Here is the revised MOU attached. To me it looks fine.

Can each one of you share the following details
Name | Flat no | Refund Period (60/90) days/working days

Please share the details by EOD today so that i can inform imtiaz to send  MOU to each of them with required changes

After going through the MOU, i observed couple of points on which i would need clarifications. Could you please revert back for below points
1) MOU date should be 20th Jan 2014 and not 24th Jan 2014- as MD sir told we will mention date in mou 20th jan 2014.
2) Carpet area will be minimum of 70% of super-built up area. This is not mentioned in MOU.

3) In case of cancellation, Refund time limit should be as per old MOU.- we will mention in mou as per the old mou.

   a. Time commited during discussion with MD was 15 months inclusive of grace period and hence timeline Should be changed to 12 months + 3 months grace period- we can mention 15 month in MOU.


   b. Please confirm what will be monthly rent paid in case of further delay. Previous MOU say as per Market value but this has changed to agreement between first and second party. Please confirm how much will be paid per sft- sir we will provide the rent as per the market value of this particular area, as per how much rate will be there  after 15 month in that area.

I will wait till today EOD and will send list received till today to Imtiaz for making necessary changes for refund period in MOU.
Rest of people who dont respond and want the refund period to be updated, please track it individually

I spoke to imtiaz and he needs the copy of the old MOU and once we give he will prepare the MOU and give it in an hour.

If people have it with them, please share the copy of the same with me or share the same with imtiaz directly.

Dear all , me and Bhushan went to Dreamz office today to collect allotment letter and mou after showing old mou information. We got it in hand but as always again we had to spend 4 Hrs at Dreamz office to get all verified as there was still couple of gaps b/what discussed and presented. Now I asked imtiyaz to use it as master copy for other Ekdant customers...

Findings:
1. Within penalty clause its was mentioned that in case of mis  agreement b/ first party and land owner . money will be refund as per RBI Guidelines interest...refund within how many days was not mentioned which was 60 days for me as per old you.---- now this has been included
2. In case of delay post 15 months , it was mentioned that rent will be paid as per agreement--- since their is no agreement as such , we asked him to write rent on monthly basis as per marker value for that area .

Rest looks OK to me . request u guy's to have a look.

Hi Folks, I got my new MOU on Saturday.  The only change I noticed is that the project completion date, which is updated to 15 months instead of 20 months. 

Rest looks the same. Please let me know your inputs which I need to re-check once.

I got call from dreamz yesterday, they were asking me to pay service tax and VAT for the booking amount i had paid!!!..it got me to suprise and furious and i bashed them... is any one  aware that we need to pay the service tax and vat for booking amount..did someone got similar call?

Hi, yes Rajesh even I got the same call and asked them why this was not communicated before and why this is not included in any document.

I think they are not doing a fair job, when I asked he guy who called me for money why we need to pay he said we don't know why they are collecting money.

Service tax is applied on under construction property and this is a government norm..some 8.27%..but when is the right time to pay I don't know but some day we have to pay that is for sure..

I asked them to first concern the CRM dept.

Aakash,
Until and unless your property is under construction wave you are not liable to pay any taxes.
And why should we pay so much tax until and unless I am not able to show this during tax declarations.
We need to talk to ppl who have booked with other builders and know if there is some service taxes that they hv paid and if yes then when did they paid that.

Kailash .i am already paying these amount for my other property and that is still under construction.. I am paying for 2.5 yrs now..and 1 more thing , u will not get  tax exemption for under construction property.. You can only claim post possession and for tax rebate during construction period , u can claim only post possession that will be refunded in 5 yrs time frame..if u want , get it confirmed for any lawyer but I am 100% sure on this..thanks

Hi,

All hope all you guys are doing fine.
Firstly even I got the same call, its their same old strategy trying to extract some additional money from investors.
They have already tried this last year once when they were asking for same tax amount.
VAT and Service tax is applicable on the construction agreement , on construction cost.
Secondly it is not on the entire amount, it is only on the construction cost, because that is a service.

Finally you do not get any tax exemption on this tax amount.
You will get tax exemption amount on under construction property if you take bank loan and the emi you pay, seperately for the interest part and outstanding part.

I got the mail from Dreamz today regarding the 5% on construction cost and vatamt to 8.5% to be paid by 7th march.
I am still doubtful abt 8.5% as I hv asked some of my friends who hv booked with other builders and they hv paid it only at the time of registration and not during this time.
We should be ok with paying 5% to get the construction agreement so that we may apply for the loan.
Let me know if we can meet this Saturday or Sunday again to discus this so that's we all pay the same amount.

We should ideally be not signing any sale agreement until bbmp approval comes...further vat and serv tac amount is payable at the time of construction agreement or regstn on the construction cost only...
So we all need to be on the same page
