I double checked some of the application and contract language from round 1 of the grant and here is what I found.
Regarding the time to complete the project it states in both the application and the contract that was executed by the awardees; "The Developer shall construct and complete the Project in an expiditious and workmanlike manner ... Developer shall commence construction within 90 days from the date of this Agreements and Developer shall complete the Project within 120 days thereafter".
This looks pretty clear that what I stated today was wrong that Developer has 120 days from the execution of the contract to complete the project. They actually do have a maximum of 30 days to execute the contract, 90 days from then to start construction, and 120 days from then to complete for a possible 240 days!
Regarding the requirement for a C of O being required before payment can be issued, it is not identified in either the application packet or the contract. However the application does state "All required municipal or governmental permits must be obtained prior to construction starting up" which would require the Developer pull all appropriate construction permits which would also require appropriate site plan reviews. The contract also states that funds will be disbursed basis based on completion of work, executed contracts and/or contractor invoices must be presented prior to disbursement of program funds and no construction liens have been filed at the site.
If we were to add a C of O requirement the language should probably state if applicable since some of the projects will not need one.
