Hi Guys, 

I just had a very disappointing conversation with Sadashiv. Now, I am feeling there is no point talking with DLF regarding anything, they will simply point to ABA which is written to exploit the buyers. Here is what I asked and responses. 

1. Registration cost notice will be after 2 months from possessions.
2. Is club-house outside the premises or inside ? 
Answer : outside because DLF doesn't get approvals. 
3. is Club house for owners or for outsiders also 
Answer only for owners. 
4. Why are we charged for Annual subscription fees,etc for club house, when we are paying for it.
Answer : Currently DLF is handling it operations and this charges will be the operating charges and its mandatory. After 2 years once the operations will be handed over to Owners association they can decide what they want to charge. 
5. How far it will be from complex ? Outside complex means it will not be safe for people to go to club house at evening. Like currently where I am staying I go to gym/swimming at 9:00 PM. Now if I go outside the complex, returning to Maiden heights would be risky. 
Answer : around 200 meters. No answer on security.
6. DLF should compensate us for club house. because club house outside the complex will significantly reduce the price of the house. 
Answer : there is no compensation , in ABA it is mentioned DLF will build clubhouse conditioned on getting approval from govt, Since it is not getting approval it cannot build club house inside. 
7. Delayed payment compensation.
Answer : delayed payment compensation is conditioned on that buyer will not miss any date of payment. 
(I have taken loan from Bank and my installments were sent by Bank only. It anyways is really unfair to not giving compensation if we miss by few days of payment and even after taking hefty interest of delay)
8. Increase in super area is there an increase in apartment area also. 
Answer : no there is no increase in apartment area. this super area is total area which is constructed by DLF(like water treatment plant etc) , excluding open area and roads etc.
9. Status of water : 
Answer : water will be provided by water tankers for the time being and BWS has promised to build pipeline for water in the area. Once the BWS build the pipeline DLF will connect to it. 
10: who will pay for water tanker. 
Answer : owners. 

I have asked few more questions in email to Sadashiv. Waiting for the response. 

We should go prepared in the meeting with DLF otherwise it will be waste. Also this gives me a feeling that talking to DLF wouldn't be fruitful until and unless, somehow we put pressure on DLF. 
DLF will point everything to ABA which has all the clauses to protect DLF and exploit owners. 

After this little rather disappointing and discouraging talk I am in 100% favor of legal action, if there is any hope to get the our rights is by legal actions only.

I just checked my final demand note, appx 60% to 70% of demand is rubbish.

I think we should plan to take DLF legal way in consumer forum

Hey guys,

please push reply all, there are 2 groups and some people might not be in both the groups. 

I just spoke to Rasheed Usmani from westend heights, very helpful person. Not able to understand everything because of bad mobile connection, but below are few things which I think might be helpful in planning 

2. 350 members have joined this suit already. 
3. they have spent around 2500K money in last 5 months on suit which comes < 10000  per person. 
4. There is no way to pressurize DLF except legal suit. 
5. DLF cannot put stay on possession. 
6. DLF tried to threatened people, with statements like we will not give possession until case is over etc, which they cannot do. Not even court will give such an order. 

Sorry wasn't able to understand much because of bad connection but this is what I understand.

From each apartment DLF is looting 2 to 3 lakh (through club charges, delay interest to customers & not paying delay penalty).. 
and if we spend half of that money from each apartment to Legal, atleast two things can happen, "Will teach a lesson to DLF and we might end up in paying atleast something less".

DLF Westend Heights guyz have filed a class action suit against DLF in NCDRC.
We can/should also file that.
These are also the extact responses that DLF Westend Heights also got. So, this is a general way to handle buyers, by DLF
DLF just refers to some or the other clause of the ABA, which we already know is one sided and totall screwed up.

Exactly same path that Westend Heights guys went through.

We should discuss more about this with the Westend height guys, specifically, Rasheed and Karthikey Khanna. Both are very helpful.

Guys I understand that Dlf is utilizing it's one sided agreement that we all have signed. Now if they are misusing a loop hole or point blank cheating only a lawyer and the final judgement can tell us.

What is your opinion about the time frame for solving this issue legally. If it is more than 3 or 6 months then we probably will be getting the possession by then at least for some of us.

In that scenario what are you people proposing pay the money and fight for refund  post possession or withhold further payment and fight to the end? 

If the case drags for years and if we do not pay the demand then they also have a clause to cancel our booking and resell the apartment where we might loose much more.

I am writing this with no intention to scare or act as a detriment to anybody. DLF has put a lot of money and experience into their ABA and we must ensure our judgement is not affected due to our emotions.

Requesting others to share their thoughts on this please.

Hi Deepak, 

Court procedure is generally takes minimum of 1 year to finish, but we will not loose anything in that in terms of possession, etc. But there is a very high chance to get our money back from DLF. After talking to Sadashiva, I am sure there is no other solution then legal action to get our rights. 

1. DLF cannot cancel the allotment if the decision is pending in court. 
2. There is a way to deposit the money in court under protest, then DLF have to give possession. Under protest means we don't agree with DLF terms and this money is subject to decision to of court and we should get interest on this money from DLF decided by count. 



I think now we have list of issues that we are going to discuss with DLF and DLF's responses. So, lets try to work for a solution which should be legitimate and represent both parties, one sided solutions will not work, especially when its against DLF. Our actions should be for both long time and immediate effect on final demand amount. 



one solution that can be proposed regarding Club house: 
a. Club house location : 
Solution : We need to check why govt has rejected club house construction. If the reason can be resolved or not. Is it DLF engineered rejection. Until we get these things done, DLF should remove the club house cost from final demand note or at least delays it for the time we take to verify things.  DLF hasn't invested anything in club house yet, so ideally they should agree to this if all speak in same voice. 
b. subscription and other charges : We can ask to remove the money from final demand note, because this money is not required for possession. We can form owner's association by the time CH is ready and owner's association can take the charge from first day.

Great Going GUYS !!!. completely support the legal course, that is the only possible way. However, be united. There are many threads, many issue sheets circulating around over whatsapp, Telegram, FB and different Google groups and threads within the same, I'm quite confused which one to stick to. If we are just few DLF would succeed in their strategy of DIVIDE and rule. I suggest whatever the decision you take keep Anand patel and Zeba in loop. They would consolidate all the things at one place.

This is in continuation to the discussions we had at the DLF Maiden Heights site yesterday. Axis Bank is Ok to fund for the additional costs as demanded by DLF and also for the Registartion costs. We have a special BT offer running that we have given for customers of DLF Westend Heights and which could be extended to the customers in Maiden Heightsfor a Balance Transfer & Enhancement of your existing loans.

 

Let me explain the whole process involved to you in detail:

 

Stage 1: Initially we will be sanctioning a loan to you based on the Demand Note that you have recd from DLF. You will have to provide us with the following 3 documents from your existing Banks:

·         Foreclosure letter.

·         List of Original Documents.

·         Statement of your loan account.

We do understand that your existing Banks might take between 3-7 days to give these documents. Hence instead of wasting time waiting for these documents we will process your loan based on your information of the loan balance in your existing Bank + DLF Demand + approx 5% Registartion Costs. Please note that this sanction can be used to pay to your existing Bank due amounts, DLF Demands and Sub Registrar DDs as the case may be. If the sanctioned amount is excess it will have to be freezed.

(Stage 1 might take upto 5-6 working days once you have submitted all documents).

 

Stage 2: Once the loan is sanctioned and based on the documents provided by your existing Bank we will start the disbursement process to close your existing loan. This will take 4-5 working days. The DD will be handed over to your existing bankers in your presence & acknowledgement taken)

(Stage 2 might take upto 4-5 working days once you have submitted all documents).

 

Stage 3: The existing Bank will take between 3-7 days to retrieve your original documents (ABA / NOC / TPT etc.) and will call you to hand over the same. If they do not call you please follow up after 5 days to get the documents collected on a priority.

(Stage 3 might take upto 5-7 working days depending on your Bank).

 

Stage 4: Once the documents are submitted to Axis Bank and the original NOC / TPT issued by DLF in favour of your old Bank handed over to DLF they will issue a fresh NOC in favour of Axis Bank. Based on this & also the original documents that you have collected from your existing we will start the process of disbursement to DLF as per their current demand.

(Stage 4 might take upto 5-7 working days including the Bank work & DLF NOC / TPT works).

 

Hence you will see that we have just about enough time to complete the process by 15th February. While we are confident that with your support we can do this we will need your push to kick start the process today itself.

To all those customers who do not have any existing loan we can finish the process in 15 days flat (Stage 1 & 4 will suffice).

To my NRI friends please note that we have to add extra days for courier up & down and hence you can add a minimum of 15 days.

 

To start the process we will need the following documents from salaried customers:

·         Application form duly Filled.

·         1 Photograph each of applicant & Co-applicant.

·         Processing Fees cheque from Salary Account.

·         ID proof (PAN Card front & backside copy compulsory) Driving License or passport.

·         Relationship proof if spouse name is not part of ID proof.

·         Address proof (Latest bank Statement. / Telephone Bill).

·         Latest 3 months’ Salary Slips (Net downloaded good enough).

·         Latest 6 months Bank Statement where Salary gets Credited (Net downloaded good enough as long as it shows Bank emblem & balance column).

·         Last 2 -3 years continuity proof. *

·         Last 2 Years Form 16.

·         If your / co-applicant passport does not have spouse’s name we will need a relationship proof like marriage certificate.

·         Latest CTC.  

·         Statements of any existing loan accounts.

I think most of you would have received a call from one of my team members today. If not, please drop a mail with your address and someone from my team will get in touch with you. I reiterate the loan offer from Axis Bank once again as below:

Please note that we have taken special approvals only for DLF. Our current card rate is 9.65% and the best rate that we are currently offering are only 9.55%. Whatever happens to the Base Rate you will always be Base + 0. (FYI, ICICI is currently at Base +0.20% & SBI is also at similar spread).

 

Processing Fees would be Rs 5,000/- plus service Tax. Kindly refer the mail as below from Akshay which clarifies on the Processing Fees.

 

Also the most important thing I forgot to add in my earlier mail. You will get the whole loan as a single loan & hence will be able to avail Income Tax benefit on the interest paid.

not sure where you read they haven't deposited the money and what relation money deposit has with our case. 
My point is if CCI and SC found DLF guilty and even if they don't charge any penalty, ABA can be challenged in court.

What is this Compensation amount.  I guess EPR is paid separately then what is this amount?  I heard they are not paying Delay penalty then what is this amount.
