In Toronto, collaborative family law and mediation are increasingly popular options in order to avoid costly family litigation.  However, this option generally works only for those spouses who are equally motivated to settle their legal issues in a relatively amicable manner, free from acrimony and bitterness.

When one or both spouses, however, are intent on litigating a contentious divorce, custody, or child support issue, legal costs and access to justice become a concern.  Across Ontario, by some recent estimates, approximately 60% of family litigants go self-represented before family court.  Many of these litigants don;t qualify for Legal Aid, yet they can't afford the extensive legal fees that come with full legal representation.

There is, however, an intermediate, more affordable legal option open to such spouses.  It is called unbundled legal services, offered by family lawyers who are willing to accept files on a limited retainer, offering affordable legal assistance on a task-by-task basis.  Rather than risk the cost consequences of open-ended billing on an hourly rate, a self-represented litigant can manage a tight legal budget by negotiating with a lawyer for a fixed fee.  That way, they'll know what they're in for - in terms of that lawyer's legal costs - from the outset.
