Opus Sampling Rate Negotiation

So after reading the RFC, i am a little puzzled as to why opus will only send audio (from chrome WebRTC) at 48k

i added maxplaybackrate=16000 to my fmtp settings that i send in my 200 OK, but it is still sending me a 48k stream.

Do i need to advertise opus/16000/2 in my 200 OK (i thought this was not legal by the RFC?)
