Commenting Showing up on Heading Tags

I'm working on a commenting system to review a series of proposals.
I've run into a few issues with the parser. First, I take it that list
commenting is still problematic? We're using ul/ol tags and whenever I
turn on list parsing, I get an error about invalid HTML. Is there a
trick to this that I'm missing?

The other issue is that heading elements in the text are getting
designated as paragraphs for commenting. Is this suppose to happen? I
feel like I've looked at some other examples of using digress.it where
people don't have comments on headings.
