Some may think that way, others don't. Yes a choice may need to be
made, but these modes cannot be distributed with my OS of choice

At least that is better than the alternative, but I still can't see why
it isn't open now.

I put effort into the battles that I believe can be won, but there is no
doubt that I would prefer to see the internals of amateur radio
equipment designed by amateurs under open source licences. It could be
done, and in some cases it is.
The world benefits enormously from reusable code from Free Software and
open source projects, I would love to see the future of amateur radio
in the hands of its users. I would pay to use open designs where they
are available. In fact I already do where I can.
