There is a second Herrara case, different Herrara, that involves MERS.  I think we need to distinguish why it is wrong, but am not sure just how to go about it entirely.  I ran out of time since this brief had to be filed tomorrow.  But I have a reply and oral argument coming up.

 

Any suggestions?
